ligion, to make and fubfcribe, the declaration aforefaid, and allo to take the faid oaths or declaration of fidelity herein after mentioned, in cafe fuch perfon fcruples the taking of an oath, Penalty for and upon refufal thereof, fuch justice of the peace is hereby re- refufing. quired to commit fuch person to prifon without bail or mainprize, and to certify the name of such person to the next general or quarter-feffions of the peace to be held for that county, city, town, part or divifion, where fuch perfon then refides; and "if fuch perfon fo committed fhall upon a fecond tender at the general or quarter-feffions refuse to make and subscribe the declaration aforefaid, fuch person refufing shall be then and there recorded, and he fhall be taken thenceforth to all intents and purposes for a popish recufant convict, and fuffer accordingly, and incur all the penalties and forfeitures of all the aforefaid laws.

XIII. And whereas there are certain other perfons, diffenters from Quakers how the church of England, who fcruple the taking of any oath; be it exempted. enacted by the authority aforefaid, That every fuch perfon fhall Altered as to make and fubfcribe the aforefaid declaration, and alfo this de- Geo. 1. c. 6. Quakers by 8 claration of fidelity following, viz.

A. B. do fincerely promife and folemnly declare before God and Declaration of the world, that I will be true and faithful to King William and Queen Mary; and I do folemnly profefs and declare, that I do from my heart abhor, deteft, and renounce, as impious and heretical, that damnable doctrine and pofition, That princes excommunicated or deprived by the pope, or any authority of the fee of Rome, may be depofed or murthered by their fubjects, or any other whatfoever. And I do declare, that no foreign prince, perfon, prelate, ftate, or potentate, hath or ought to have, any power, jurifdiction, fuperiority, pre-eminence, or authority ecclefiaftical or fpiritual within this realm.

And shall subscribe a profeffion of their chriftian belief in these words:

A. B. profefs faith in God the father, and in Jefus Christ his Profeffion. eternal fon, the true God, and in the holy fpirit, one God blessed for evermore, and do acknowledge the holy fcriptures of the Old and New Teftament to be given by divine infpiration.

Which declarations and fubfcription fhall be made and entred of record at the general quarter-feffions of the peace for the county, city, or place where every such person shall then refide.' And every fuch perfon that fhall make and subscribe the two declarations and profeffion aforefaid, being thereunto required, fhall be exempted from all the pains and penalties of all and every the aforementioned ftatutes made against popifh recufants, or protestant nonconformists, and alfo from the penalties of an act made in the fifth year of the reign of the late Queen Elizabeth, in- 5 Eliz. c. 1. tituled, An act for the affurance of the Queen's royal power over all eftates and fubjects within her dominions, for or by reafon of fuch perfons not taking or refufing to take the oath mentioned in the faid act; and alfo from the penalties of an act made in the thirteenth

13 & 14 Car. 2. thirteenth and fourteenth years of the reign of King Charles the Second, intituled, An act for preventing mischiefs that may arife by certain perfons called Quakers, refusing to take lawful oaths; and enjoy all other the benefits, privileges, and advantages under the like limitations, provifoes, and conditions, which any other diffenters fhall or ought to enjoy by virtue of this act. XIV. Provided always, and be it enacted by the authority aforefaid, That in cafe any perfon fhall refuse to take the faid oaths, when tendred to them, which every juftice of the peace is hereby impowered to do, fuch person fhall not be admitted to make and fubfcribe the two declarations aforefaid, though required thereunto either before any juftice of the peace, or at the general or quarter-feffions, before or after any conviction of popish recufancy, as aforefaid, unless fuch perfon can, within thirty one days after fuch tender of the declarations to him, produce two fufficient proteftant witnesses, to testify upon oath, that they believe him to be a protestant diffenter, or a certificate under the hands of four proteftants, who are conformable to the church of England, or have taken the oaths and subscribed the declaration above mentioned, and fhall alfo produce a certificate under the hands and feals of fix or more fufficient men of the congregation to which he belongs, owning him for one of them.

XV. Provided also, and be it enacted by the authority aforefaid, That until fuch certificate, under the hands of fix of his congregation, as aforefaid, be produced, and two protestant witneffes come to atteft his being a proteftant diffenter, or a certificate under the hands of four proteftants, as aforefaid, be produced, the juftice of the peace shall and hereby is required to take a recognizance with two fureties in the penal fum of fifty pounds, to be levied of his goods and chattels, lands, and tenements, to the use of the King's and Queen's majesties, their heirs and fucceffors, for his producing the fame; and if he cannot give fuch fecurity, to commit him to prifon, there to remain until he has produced fuch certificates, or two witneffes, "as aforesaid.

Laws for di. XVI. Provided always, and it is the true intent and meanvine fervice in ing of this act, That all the laws made and provided for the frequenting of divine fervice on the Lord's day commonly called Sunday, fhall be ftill in force, and executed against all perfons that offend against the faid laws, except fuch perfons come to fome congregation or affembly of religious worship, allowed or permitted by this act.

XVII. Provided always, and be it further enacted by the authority aforefaid, That neither this act, nor any clause, article, or thing herein contained, fhall extend or be construed to extend to give any ease, benefit or advantage to any papist or popish recufant whatsoever, or any person that shall deny in his preaching or writing the doctrine of the bleffed Trinity, as it is declared in the aforefaid articles of religion.

XVIII. Provided always, and be it enacted by the authority aforefaid, That if any perfon or persons, at any time or times after

XIX. Provided always, That no congregation or affembly for Place for worreligious worship fhall be permitted or allowed by this act, until hip to be certhe place of fuch meeting fhall be certified to the bishop of the diocefe, or to the archdeacon of that archdeaconry, or to the juftices of the peace at the general or quarter feffions of the peace for the county, city, or place in which fuch meeting shall be held, and regiftred in the said bishop's or archdeacon's court refpectively, or recorded at the faid general or quarter feffions; the register or clerk of the peace whereof refpectively is hereby required to regifter the fame, and to give certificate thereof to fuch person as shall demand the fame, for which there shall be no greater fee nor reward taken, than the fum of fix pence.

E your Majefties most dutiful and loyal subjects, the commons aflembled in parliament, having entred into a ferious confideration of the extraordinary occafions which engage your Majesties in a great and prefent expence for the necessary defence of your realms, and being defirous to raise proportionable aids and fupplies, do humbly prefent your Majefties with the free gift of the rates and affeffments herein after mentioned, and befeech your Majefties that it may be enacted; II. And be it enacted by the King and Queen's most excellent majefties, by and with the advice and confent of the lords fpiritual and temporal, and commons in this prefent parliament affembled, and by the authority of the fame, That their Majesties fhall have and receive the rates and affeffments hereafter mentioned, of and from every perfon, fpiritual and temporal, of what estate or degree foever he or they be; which faid rates or affeffments fhall be taxed, affeffed, levied and paid into their Majefties receipt of exchequer, according to the tenor of this act, and in manner and form following; (that is to fay) That

all and every person and perfons, bodies politick and corporate, guilds and fraternities within this kingdom of England, dominion of Wales, and town of Berwick upon Tweed, having any estate in goods, wares, merchandizes, or other chattels or perfonal eftate whatsoever, either in their own poffeffion, or in the poffeffion of others in truft for them, (except, and out of the premiffes deducted, fuch fums of money as he or they do bona fide owe, and also the stock upon lands, and fuch goods as are used for houthold-stuff) fhall yield and pay unto their Majefties twelve pence in the pound, according to the true yearly profit thereof for one year, to be affeffed, levied and collected in manner herein after mentioned; (that is to fay) for every hundred pounds worth of fuch goods, wares, merchandizes, or other chattels, or personal estate, the fum of fix fhillings; and fo after that rate for every greater or leffer quantity.

III. And be it further enacted by the authority aforefaid, That all and every perfon and perfons, commiffioner and commiffioners, having, uting or exercifing any office, or imployment of profit (fuch military officers who are or shall be in mufter, or pay in their Majefties army or navy only excepted) fhall yield and pay unto their Majefties the fum of twelve pence for every twenty fhillings, which he or they do receive in one year by virtue of any fees, profits accruing to him or them, by reafon or occafion of their feveral offices or employments, to be affeffed, impofed, levied and collected, in fuch manner as hereafter is mentioned. And to the end a further aid and fupply for their Majefties occafions may be raised by a charge upon all lands, tenements and hereditaments with as much equality and indifferency, as is poffible by a pound rate of twelve pence for every twenty fhillings of the true yearly value for one year only and no longer;

IV. Be it further enacted by the authority aforefaid, That all and every the manors, meffuages, lands and tenements, as well freehold as copyhold, as alfo all quarries, all and every the mines of coal, tin or lead, and all iron works and falt works, all allom mines or works, all parks, chafes, warrens, woods, underwoods and copices, fifhings, tythes, tolls, and all other yearly profits and hereditaments of what nature or kind foever they be, fituate, lying and being, happening and arifing within the kingdom of England, dominion of Wales, or town of Berwick upon Tweed, or within any the counties, cities, boroughs, towns, divifions, ridings, hundreds, lathes, wapentakes, parishes and places thereof as well within ancient demefne and other liberties and privileg'd places as without, fhall be, and are hereby charged for one year only and no longer, with the fum of twelve pence for every twenty fhillings of the true yearly value. And all and every perfon and perfons, bodies politick and corporate, guilds, myfteries, fraternities and brotherhoods, whether corporate or not corporate, having or holding in his, her or their actual poffeffion, any manors, meffuages, lands, tenements, or other the hereditaments or premiffes, fhall yield and

pay unto their Majefties the fum of twelve pence for every twenty fhillings by the year, which the said manors, meffuages, lands, tenements, hereditaments and other the premiffes are now worth to be leased, if the fame were truly and bona fide leafed or demised at a rack rent, and according to the full true yearly value thereof, without any refpect had to the present rents referved for the fame, if fuch rents have been referved upon fuch leafes or eftates made for which any fine or income hath been paid or fecured, and without any refpect had to any former rates or taxes thereupon imposed: which faid fum of twelve pence for every twenty fhillings by the year of the faid true yearly value of the premiffes fhall be affeffed, levied and collected in manner hereafter mentioned, and shall be paid into the receipt of their Majefties exchequer by two equal payments; the firft payment thereof to begin and to be made upon the first day of December, which fhall be in the year of our Lord one thousand fix hundred eighty and nine.

V. And whereas many of the manors, meffuages, lands, tenements, tythes, hereditaments or premiffes intended by this act to be charged with the pound rate, as aforefaid, stand incumbred with, or are fubject and liable to the payment of feveral rent-charges or annuities iffuing out of the fame, or to the payment of divers fee-farm rents, rents-fervice, or other rents thereupon reserved, by reafon whereof the true owners and proprietors of fuch manors, meffuages, lands, tenements, hereditaments and premiffes, do not in truth receive to their own ufe the full yearly value of the fame, for which nevertheless they are by this act charged to pay the full pound rate of twelve pence for every twenty fhillings of the true yearly value.

VI. It is therefore declared and enacted by the authority aforefaid, That it fhall and may be lawful to and for the landlords, owners and proprietors of fuch manors, meffuages, lands, tenements, hereditaments and premiffes as are charged with the pound rate as aforefaid, to abate and deduct, and to retain and keep in his or their hands twelve pence in the pound out of every fee-farm rent, and other annual rent or payment charged upon, or iffuing out of the premiffes, or any part thereof, or thereupon referved; and all and every person or perfons, bodies politick or corporate, being indebted in any fum or fums of money upon contract for intereft, fhall, for the better enabling them to pay and bear the rates and charges herein before refpectively impofed upon them, be allowed by virtue of this act, after the rate of twelve pence in the pound out of all fuch interest money which fhall be paid and grow due for any time between the thirtieth day of November one thousand fix hundred eighty nine, and the thirtieth day of November one thousand fix hundred ninety, by his or their respective creditor or creditors, out of the debts fo by them owing, as aforefaid, and may, and are hereby enabled to deduct, retain and discount the fame, any contract or agreement, mortgage, bond, condition, provifion, or other affurance to the contrary in any wife notwithstanding; and
