Secretary to pay county agricultural societies.

CHAPTER 98.

AN ACT to authorize the Secretary of State to audit the annual ap propriations to county Agricultural Societies.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. All county agricultural societies that have received into thier [their] treasury one hundred dollars in cash, and have disbursed the same for premiums, and have also held a county fair in the year 1859, and have made any report of the same to the officers or places required to be done, by chapter 53, of the General Laws of 1858, shall be entitled to, and receive the one hundred dollars each, for the year 1859, notwithstanding any informalities as to time and manner in making thier [their] reports, and the proper officers are hereby directed to audit and pay the same.

SEC. 2. This act shall take effect and be in force from and after its passage.

CHAPTER 99.

Remits penalties.

Proviso.

AN ACT to authorize the Commissioners of School and University Lands to remit penalties in certain cases, and to change the time for the annual distribution of the School Fund Income.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. In all cases where the interest due on school, university and swamp lands, or lands selected in lieu of swamp lands, or upon loans of money from the school, university or drainage fund, shall be paid to the State Treasurer, on or before the last day of May, in each year, including the year A. D. 1860, the Commissioners of School and University Lands shall remit the five per cent. penalty now required to be paid by the provisons of chapter 28, of the Revised Statutes: Provided, that nothing in this act shall be so construed as to prevent any forfeiture, pursuant to the provisions of said chap

Section one, of chapter 24, of the Revised Annual Statutes, is hereby amended, so that, after the year 1860, tribution the income of the State fund for the support of common schools, which shall be received up to the last day of May, in each year, shall be distributed between the tenth and fifteenth days of June, in each year, or as soon thereafter as practicable, among the several counties of this State, from which reports have been received by the State Superintendent, agreeably to law.

SEC. 3. All acts, and parts of acts, so far as they conflict with the provisions of this act, are hereby repealed. SEC. 4. This act shall take effect and be in force from and after its passage.

AN ACT to repeal chapter one hundred and thirty-two, of the Private and Local Laws of 1856, entitled "An act to authorize the city of Oshkosh to aid in the construction of a railroad;" also chapter five hundred and two, of the Private and Local Laws of 1856, entitled "An act to authorize the city of Oshkosh to aid in the construction of a railroad," approved Oct. 11, 1856; also chapter one hundred and thirty-eight, of the Private and Local Laws of 1858, entitled "An act to authorize the city of Oshkosh to aid in the construction of a railroad."

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. Chapter one hundred and thirty-two, of the Private and Local Laws of 1856, entitled "An act to authorize the city of Oshkosh to aid in the construction of a railroad;" and chapter five hundred and two, of the Private and Local Laws of 1856, entitled "An act to authorize the city of Oshkosh to aid in the construction of a railroad," and chapter one hundred and thirtyeight, of the Private and Local Laws of 1858, entitled "An act to authorize the city of Oshkosh to aid in the construction of a railroad," are hereby repealed: Provided, that in all cases where bonds have already been issued and delivered, under the provisions of either of said acts, the liability of said city for the payment of the principal, and the interest which has or may accrue thereon, shall in no manner be affected by the repeal of said acts.

SEC. 2. This act shall take effect and be in force from and after its passage and publication.

AN ACT relating to the State tax of the county of Door.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. The sum of nine hundred and twenty- Tax remitted. seven dollars and fifty cents ($927 50), being all the State tax apportioned or assessed, up to the thirty-first day of March, A. D. 1857, to the county of Door, is hereby released, discharged and cancelled, and the said county is. hereby discharged from payment of the same.

SEC. 2. This act shall take effect and be in force from and after its passage.

CHAPTER 105.

AN ACT to annex certain territory to Geneva school district number

one.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. The following described territory, situated and being in the towns of Linn and Geneva, in the county of Walworth, viz : fractional sections one, two, three, and four, and the east half of fractional section five, in said town of Linn, and the east half of fractional section thirty-two, all of fractional sections thirty-three, twentyeight, and twenty-seven, lying south of Como lake, and all of section thirty-four, and the west half of section. thirty-five, in said town of Geneva, is hereby annexed to "Geneva school district number one," as heretofore incorporated, and is hereby made a part of said district to all intents and purposes, and shall be subject to all the provisions of the act incorporating said district.

Moneys and SEC. 2. All school moneys, and other property, beproperty belonging to any school district or districts, composed whollong. ly of said territory, or to which such district or districts may be entitled, by virtue of any law of this State, shall vest in and belong to said Geneva school district number one; and all such school moneys shall be paid over on demand to the treasurer of said Geneva school district number one.

SEC. 3. Said district number one shall maintain one primary school in the territory of union district number six, annexed by this act, the same number of months that school is taught in the other departments of said district number one. And in case said district number one shall fail or neglect to maintain a school as above provided, the town superintendents of Geneva and Linn shall not apportion any school moneys to said district number one, for the year such failure or neglect shall oc

cur.

SEC. 4. This act shall be published immediately, and shall take effect as soon as published.
