in the number of vessels approved for sale under the Merchant Ship Sales Act of 1946 as of September 30, 1948. The total stood at 1,788 compared to 1,790 on June 30, 1948, and represented total sales of approximately $1,723,000,000. Chartered vessels in foreign trade were redelivered to the Commission at a lower rate in July and August than in May and June, but a considerable increase occurred again in September due to the west coast maritime strike. During the quarter a net decrease of 131 vessels chartered under the act occurred, reducing the number on charter under this authority to 489 at the end of the period compared to 620 on June 30. Toward the end of the period new policies per-¡ taining to the chartering of vessels under the act were adopted by the Com mission. The reserve fleets showed a net increase of 143 vessels, the total standing at 1,818 at the end of the quarter compared to 1,675 at the beginning. The number of vessels for which adjustments for prior sales to citizens had been approved by the Commission stood at 60 at the end of the quarter, adjustments for 6 vessels having been approved during the period.

SHIP SALES

As of September 30, 1948, the Commission had approved the sale of 1,788 vessels, 671 for American flag operation and 1,117 for foreign flag operation. During the quarter the sale of the S. S. America and five other vessels was approved. The Commission canceled approvals of 8 vessels, all for American flag operation, at the request of the approved applicants, leaving a net decrease of 2 vessels from the total of 1,790 (673 for American flag operation and 1,117 for foreign flag operation) reported as of June 30, 1948.

The vessels for American flag operation have been approved for sale of 165 operators (appendix B). Those for foreign flag operation have been approved for registry under the flags of 34 nations (appendix C).

At the end of the quarter, ships approved for sale for American flag operation comprised 412 dry cargo and passenger vessels and 259 tankers. The dry cargo vessels comprised 385 of large types, including 237 C types (20 C1, 129 C2, and 88 C3), 122 Libertys and 26 Victorys; 1 passenger vessel, the America; and 26 coastal types. Tankers comprised 202 large T type, 49 Liberty type, and 8 coastal tankers.

MORTGAGE SALES TO NONCITIZENS

Appendix E shows that the lines of credit to foreign purchasers of war-built vessels as recommended by the National Advisory Council have generally not been reached, and that credits granted by the Commission are within $115,424,550 of the $377,100,000 approved by the NAC. Credits totaling $30,622,493 approved by the Commission have been unused.

ADJUSTMENTS OF PRIOR SALES TO CITIZENS

As previously stated the total number of vessels for which applications have been filed for adjustment of prior sales to citizens under section 9 of the Merchant Ship Sales Act of 1946 is 204, of which 11 vessels were subsequently withdrawn, leaving for consideration applications covering a total of 193 vessels.

The number of vessels for which adjustments had been approved by the Maritime Commission stood at 60 as of September 30, 1948, adjustments for 6 vessels having been approved during the quarter. The number of vessels for which tentative adjustment agreements had been executed was 39 at the end of the period, adjustment agreements for 6 vessels having been executed during the quarter, covering approvals of the previous quarter. Vessels for which adjustment agreement had not been executed totaled 21 as of the end of the quarter. During the quarter the Commission, as the result of intensive investigation and study, has resolved certain complex policy matters which avoids in a number of instances the necessity of tentative adjustments and permits processing of final settlements of the section 9 applications. Adjustments covering an additional nine vessels have been completely processed and are awaiting final consideration by the Commission. The processing of applications covering an additional 58 vessels is approaching completion.

VESSEL CHARTERS

At the beginning of the quarter a total of 620 vessels were under charter or allocated for charter to United States citizens and to one Philippine company pursuant to the Merchant Ship Sales Act of 1946, as amended. In addition, 40

vessels were then under charter in accordance with other authorities of law, making an over-all total of 660 vessels. The rate of redelivery from charter of vessels employed in foreign trade was lower in July and August than in the preceding months of May and June, but increased considerably again in September due to the maritime strike on the west coast. During September 79 vessels were returned to the Commission by charterers, and as of the close of the quarter the over-all total under charter was 507, a decrease of 153 from the July 1 total. Notices of termination of charter for 138 of these 507 vessels had been received. (Appendix F includes 18 vessels chartered pursuant to other authorities of law. These vessels consisted of 4 chartered in the Alaskan service under Public Law 12, 80th Cong., 10 under the Philippine Rehabilitation Act of 1946, 3 prewar-built passenger ships chartered under the Merchant Marine Act of 1936 to Moore-McCormack Lines, and 1 under Public Law 101, 77th Cong., to United States Lines.)

During the quarter the number of vessels employed in the intercoastal and coastwise trades decreased from 57 to 48, all operating pursuant to the terms and conditions outlined in the Commission's report for the quarter ended September 30, 1947.

The interim bare-boat charter agreement made by the Maritime Commission with Alaskan operators in 1947, pursuant to Public Law 12, was terminated as of June 30, 1948. The authority extended by Congress to the Maritime Commission under Public Law 866, Eightieth Congress, to allow special conditions for the charter of vessels to Alaskan operators, has not been used and vessels required by these operators subsequent to July 1, 1948, have been sold or chartered to them pursuant to the Merchant Ship Sales Act of 1946. Twelve vessels were chartered under these conditions. (Four additional vessels remained under the interim agreement but will be redelivered upon completion of current voyages.) The Commission, having given further consideration to certain policies adopted on April 26, 1948, relating to the charter of vessels under the Merchant Ship Sales Act of 1946, adopted the following resolutions, notice of which was given to all interested charterers.

The first was adopted on September 22, 1948:

"Whereas the Commission on April 26, 1948, adopted certain policies relating to the charter of vessels under the provisions of section 5 of the Merchant Ship Sales Act of 1946, as amended, which, among other things, provided that it would not thenceforth enter into such charters or allocate vessels under then existing charters if "The applicant or charterer owns no dry-cargo or passenger vessels of 1,500 gross tons or over documented under the laws of the United States and operated in the foreign or domestic commerce of the United States,' and also provided that further consideration was to be given to terminating existing charter with operators not eligible to charter vessels by reason of such nonownership of American-flag vessels; and

"Whereas the Commision after having given such further consideration has determined that in the light of all existing facts and circumstances it is not consistent with the purposes and policies of the Merchant Marine Act, 1936, as amended, and the Merchant Ship Sales Act, 1946, as amended, for such nonowners except under special circumstances to continue to have vessels under charter pursuant to charter entered into under section 5: Now, therefore, be it

"Resolved, That the Commission cancel all existing charter contracts entered into pursuant to the provisions of section 5 of the Merchant Ship Sales Act of 1946, as amended, with respect to all vessels which are being operated in foreign commerce if the charterer is not as of the date of adoption of this resolution the owner of at least one oceangoing dry cargo or passenger vessel of 1,500 gross tons or over documented under the laws of the United States and operated in the foreign or domestic commerce of the United States: Provided, however, That any requested exceptions to the foregoing are to be individually considered and determined by the Commission in keeping with the facts and circumstances involved; "Resolved further, That said cancellation shall be effective November 30, 1948 (without prejudice to any other rights of termination reserved in the charter): Provided, however, That any vessel then on voyage need not be redelivered to the Commission and the charter shall not terminate with respect thereto until the completion of its ten current voyage."

The second was adopted on September 24, 1948:

"Whereas the Commission on April 26, 1948, adopted certain policies relating to the charter of vessels under the provisions of section 5 of the Merchant Ship Sales Act of 1946, as amended, which, among other things, provided that it would not thenceforth enter into such charters or allocate vessels under then

existing charters "if the applicant or charterer or any interested person or related company, as defined in clause 30 (c) of the form of charter designated SHIPSALESDEMISE 303, owns, operates, or charters foreign-flag vessels or acts as agent or broker for foreign-flag vessels or charters vessels to foreign-flag ship operators," and also stated that "the Commission is now making a determination of the limitation to be placed upon the number of dry cargo and passenger vessels which may be under charter to an operator in proportion to the number of similar vessels owned by such operator"; and

"Whereas the Commission has determined that the Commission's policy with respect to the chartering of war-built vessels pursuant to the provisions of the Merchant Ship Sales Act of 1946, as amended, should be modified to the extent hereinafter set forth: Now, therefore, be it

"Resolved first, That beginning December 1, 1948, the aggregate number of war-built vessels permitted to be operated at any one time under any charter or charters from the Commission shall be limited as follows:

"(a) Not to exceed two chartered Liberty vessels to each Liberty vessel or other freighter of similar or equivalent type owned by the charterer and documented under the laws of the United States and operated in the foreign or domestic commerce of the United States;

"(b) Not to exceed four chartered vessels, regardless of type, to each Victory (AP-2 or AP-3), C-1 or C-2 type vessel owned by the charterer and documented under the laws of the United States and operated in the foreign or domestic commerce of the United States;

"(c) Not to exceed three chartered vessels, regardless of type, to each C1M-AV1 type vessel owned by the charterer and documented under the laws of the United States and operated in the foreign or domestic commerce of the United States;

(d) Not to exceed five chartered vessels, regardless of type, to each C-3 type vessel owned by the charterer and documented under the laws of the United States and operated in the foreign or domestic commerce of the United States. "Second, That any exceptions requested by charters to the foregoing ratios set for in resolved first hereof shall be individually considered and determined by the Commission in keeping with the facts and circumstances involved.

"Third, That the following types of foreign-flag affiliations be and hereby are determined to constitute disqualifications for any charterer of Commission-owned vessels, subject to such conditions or exceptions as the Commission may direct in individual cases:

"(a) Agency representation of foreign-flag vessels or lines competitive with established American services, which involve freight or passenger solicitation activities, or where the agency compensation is fixed in relation to vessel revenue, and the agent accordingly has a direct interest in the financial result of the oper ation; and

"(b) Ownership and/or time or bare-boat charter of foreign registered vessels which are operated in competition with established American lines.

Provided, however, That such disqualifications shall become effective December 1, 1948, and any exceptions requested by charterers to such disqualifications shall be individually considered and determined by the Commission in keeping with the facts and circumstances involved.

"Fourth, That all charterers having vessels chartered from the Commission in excess of the number of vessels permitted to be chartered to them under the provisions of resolved first hereof on December 1, 1948, be notified to forthwith thereafter contact and make arrangements with the Bureau of Operations of the Commission for the prompt and orderly redelivery in accordance with the provisions of the charter of the excess number of vessels by the charter. The vessels to be redelivered shall be those which on December 1, 1948, are in United States ports and not being loaded and if the number of such vessels to be redelivered is not sufficient to eliminate the excess number of chartered vessels the charterer shall arrange for the redelivery of the vessels next arriving after December 1, 1948, in United States ports until arrangements have been made for the redelivery of a sufficient number of chartered vessels to eliminate such excess.

“Fifth, That all charterers of Commission-owned vessels be notified that if they are disqualified on December 1, 1948, by reason of foreign affiliation as provided in resolved third bereof, they shall forthwith thereafter contact and make arrangements with the Bureau of Operations for the prompt redelivery pursuant to the provisions of the charter of all vessels then chartered to them.

"Sixth, That the Secretary be and hereby is authorized and directed forthwith to send appropriate notices of the foregoing action taken by the Commission to all charterers of war-built vessels owned by the Commission."

RESERVE FLEETS

Due to the movement of vessels in and out of the reserve fleet, the survey of the condition of all vessels in the fleets which is being made to reflect the estimated cost of necessary repairs remains 80 percent complete, but is being continued to provide a current record for these vessels as well as for new arrivals in the reserve fleets. It will provide a basis for the selection of vessels for the national defense reserve fleet. Already 558 vessels have been selected in this manner.

All vessels delivered to the fleets have had primary protective measures applied including mooring, draining, and the application of preservation compound to exposed working parts. Final preservation measures, averaging 55 percent of completion, have been accomplished on all permanent reserve types and on other better type vessels which have been in the fleets a sufficient length of time to make such action necessary in order to prevent deterioration. The increase from 51 to 55 percent in the completion of final preservation work was effected in the last 3 months in spite of the large number of vessels placed in the reserve fleets during that period.
