than one imparlance, and by way of fummar complaint before the Court of Seffions, or profecution before the Court of Jufticiary in Scotland.

9、And be it further enacted, That it fhall and may be lawful, to and for the respective Courts aforefaid, to give and adminifter the Oaths aforefaid, to the perfon and perfons aforefaid, and, upon due tender of any perfon or perfons to take the faid Oaths, the faid Courts are hereby required and enjoined to adminifter the fame. For the taking and fubfcribing the faid Oaths the proper officer fhall have, take, and receive of every perfon, fo taking and fubfcribing the faid Oaths, the fum of two fhillings, and no more; of the taking and fubfcribing whereof a register fhall be kept in a book to be provided for that purpose by the proper officer, where the names of all fuch perfons, who shall take and fubfcribe the faid Oaths, fhall be fairly written, and when they took and fubfcribed the fame; to which faid regifter any perfon may refort, and infpect the fame, without fee or reward.

12. And be it further enacted by the authority aforefaid, That if any Head or Member of any college or hall within either of the Universities of Oxford or Cambridge, that are or fhall be of the foundation, or that do or fhall enjoy any exhibition, being of, or as foon as he fhall attain, the age of eighteen years, fhall neglect or refufe to take and fubfcribe the feveral Oaths in this Act mentioned, according to the true intent and meaning of this Act, or to produce a certificate thereof, under the hand of fome proper officer of the refpective Court, and caufe the fame to be entered in the register of fuch college or hall within one month after his having taken and fubfcribed the faid Oaths; and if the perfons in whom the right of election of fuch Head or Member fhall be, do neglect or refufe to elect fome other fitting or proper perfon, in the place or ftead of fuch Head or Member fo neglecting and refufing to take and fubfcribe the faid Oaths, as aforefaid, by the space of twelve months after fuch neglect or refufal, that then, and from thenceforth, it shall and may be lawful unto and for the King's most excellent Majefty, his heirs and fucceffors, under the great feal or fign manual, to nominate and appoint fome fitting perfon, qualified according to the local ftatutes of fuch college or hall, to fucceed to the place of such person who fhall neglect or refuse to take and fubfcribe the faid Oaths; and that every perfon fo to be nominated and appointed fhall have and enjoyfuch place, to which he fhall be nominated and ap

pointed, as aforefaid, to all intents and purposes whatsoever, and all benefits, privileges, and advantages, to the fame belonging and appertaining, as if fuch perfon had been elected and chofen by the proper electors of fuch college or hall.

-27. Provided always, That the Oath of Abjuration, and the affurance in this Act contained, fhall, in all cafes, be taken to be in lieu of the Oath of Abjuration, and the affurance formerly appointed.

Extract of an Act for indemnifying Perfons who have omitted to qualify themselves for Offices within the Time limited by Law, and for allowing further Time for that Purpofe; and for amending fo much of an Act paffed in the fecond Year of the Reign of his prefent Majefty, as requires Perfons to qualify themselves for Offices before the End of the next Term or Quarter Seffions; and alfo for enlarging the Time limited by Law for making and jub-foribing the Declaration against Tranfubftantiation; and for allowing further Time for Inrolment of Deeds and Wills made by Papifts, and for Relief of Proteflant Purchafers, Devifees, and Leffees.

ND whereas the time for taking and fubfcribing the Oaths appointed to be taken and subscribed by perfons on account of their offices, places, employments, or profeffions, or on any other caufe, in and by the said Act, made in the first year of the reign of his late Majefty King George the First, is, by an Act made in the fecond year of the reign of his prefent Majefty, intituled, An Act for indemnifying Persons who bave omitted to qualify themfelves for Offices and Employments within the Time limited by Law, and for allowing further Time for that Purpofe, and for repealing fo much of an Act of Parliament paffed in the first Year of his late Majefty King George the First, as requires Perfons to qualify themselves for Offices or Employments within three Months, and for limiting other times for fuch Qualifications; as alfo for the Repeal of fo much of an Act paffed in the thirtieth Year of the Reign of King Charles the Second, as relates to the fworn Servants of the King's or Queen's Majefty, limited to any time before the end of the next term, after he or they fhall be admitted into, or enter upon

any fuch preferment, benefice, office, or place, or come into any fuch capacity, or take upon him or them fuch practice, employment, or bufinefs, as is therein mentioned, or to any time before the end of the next Quarter Seffions of the county, city, or place, where fuch perfon fhall be or refide, after he or they fhall be admitted into, or enter upon any fuch preferment, benefice, office, or place, or come into any fuch capacity, or take upon him or them fuch practice, employment, or bufinefs, as is therein mentioned and whereas by the faid Act made in the twentyfifth year of the reign of King Charles the Second, the refpective perfons therein mentioned are required to make and fubfcribe the Declaration against Tranfubftantiation in the next term, or at the Quarter Seffions for that county or place where he or they fhall refide, next after his or their admittance or admittances into the refpective offices or employments therein mentioned, which times fo limited in the faid feveral Acts are found to be too fhort and inconvenient: now, for remedy thereof, and for amending the faid Acts, by enlarging the said times, be it enacted by the authority aforefaid, That all and every perfon and perfons that fhall be admitted, entered, placed, or taken into any office or offices, civil or military, or fhall receive any pay, falary, fee, or wages, by reafon of any patent or grant from his Majefty, his heirs, or fucceffors, or by his authority, or by authority derived from him or them, within that part of Great Britain called England, or in his Majefty's navy, or in the feveral iflands of Jerfey and Guernsey, or that shall be admitted into any fervice, office, or employment, in the household or family of his Majefty, or her Majesty, or of his Royal Highnefs Frederic Prince of Wales, or of any of his Majefty's iffue, and all ecclefiaftical perfons, Heads or Governors of what denomination foever, and all other members of colleges and halls within either of the Univerfities of Oxford or Cambridge, that are or fhall be of the foundation, or that do or fhall enjoy any exhibition, being of, or as foon as they fhall attain, the age of eighteen years; and all perfons teaching or reading to pupils in either of the aforefaid Universities, or elsewhere, and Schoolmafters and Ufhers, and all Preachers and Teachers of feparate congregations, high and chief Conftables, and every perfon who fhall act as Serjeant at Law, Counsellor at Law, Barrifter, Advocate, Attorney, Solicitor, Proctor, Clerk, or Notary, by practifing in any manner as fuch in any Court or Courts whatfoever, within

that part of Great Britain called England, who fhall at any time after the firft day of Auguft in the year of our Lord one thoufand feven hundred and thirty-fix, be admitted into, or enter upon, any of the afore-mentioned preferments, benefices, offices, or places, or fhall come into any fuch capacity, or fhall take upon him or them any fuch practice, employment, or bufinefs, as aforefaid, fhall take and fubfcribe the Oaths appointed by the Statute made in the first year of the reign of his late Majefty King George the First, in fuch form as by that Statute is directed, in his Majefty's Court of Chancery, King's Bench, Common Pleas, or Exchequer, or at the General or Quarter Seffions of the county, city, or place, where fuch perfon fhall be or refide, at any time within fix calendar months after he or they fhall be admitted into, or enter upon, any fuch preferment, benefice, office, or place, or come into fuch capacity, or take upon him or them fuch practice, employment, or bufinefs as aforefaid; and all and every perfon or perfons, who, by the faid Act made in the twenty-fifth year of the reign of King Charles the Second, are required to make and fubfcribe the Declaration against Tranfubftantiation, shall make and subscribe the faid Declaration at the fame places, and at the fame times, as are by this Act limited for taking and fubfcribing the Oaths aforefaid.

4. Provided always, That nothing in this A&t fhall extend to any perfon beyond the feas, who by virtue of this Act ought to take and subscribe the faid Oaths, or by virtue of the faid Act made in the twenty-fifth year of King Charles the Second ought to make and fubfcribe the faid Declaration, fo as such person do, within fix calendar months after his return to, or arrival in, that part of Great Britain called England, take and subscribe the said Oaths, in fuch manner and form, and at fuch place and places, as are appointed in and by the faid Act made in the first year of the reign of his late Majesty King George the First, and alfo receive the Sacrament of the Lord's Supper according to the ufage of the Church of England, and make and fubfcribe the said Declaration against Tranfubftantiation, in fuch cafes wherein the faid Sacrament. ought to have been received, and the faid Declaration ought to have been made and subscribed.

5. Provided always, and it is hereby further enacted by the authority aforefaid, That all and every person and perfons aforefaid that fhall neglect or refufe to take the faid Oaths, or who fhall neglect or refufe to make and

fubfcribe the faid Declaration in cafes where the fame ought to be made and fubfcribed, within the time and at the places aforefaid, according to the directions of this Act, fhall be liable unto and incur all fuch difabilities, incapacities, forfeitures, and penalties, as in and by the faid Act of the firft year of the reign of his late Majesty King George the First are provided and inflicted for not taking and fubfcribing the said Oaths, or are provided and inflicted by the faid Act made in the twenty-fifth year of the reign of King Charles the Second, for not making and fubfcribing the faid Declaration; and in cafe of executing any fuch office, place, or employment, after such -neglect or refufal as aforefaid, every fuch perfon and perfons, being thereof lawfully convicted, in fuch manner as by the said several Acts is directed, fhall be liable unto and incur all fuch disabilities, incapacities, forfeitures, and penalties, as in and by the faid Acts are provided to be profecuted, fued for, and recovered, in fuch manner as therein is prefcribed.

6. And it is hereby further enacted by the authority aforefaid, That all and every the powers, authorities, conditions, directions, and provifions, in and by the said Acts of the first year of the reign of his late Majesty King George the Firft, and of the twenty-fifth year of the reign of King Charles the Second, enacted or provided touching or relating to the taking and fubfcribing of the faid Oaths, and the making and fubfcribing the faid Declaration, or the neglect or refufal thereof, fhall be adjudged, deemed, and taken to be, in full force, as if the fame were herein particularly inferted and re-enacted, except only as to the alteration by this Act made in respect of the times limited for taking and fubfcribing the faid Oaths, and making and fubfcribing the faid Declaration, and also as to the indemnity hereby granted to fuch, who, on or before the first day of Auguft one thoufand feven hundred and thirtyfix, fhall take and fubfcribe the faid Oaths, and make and fubfcribe the faid Declaration, and receive the Sacrament of the Lord's Supper according to the ufage of the Church of England, where the fame are refpectively required by law; any thing herein before contained to the contrary thereof in any wife notwithstanding.
