as aforefaid, and fubject to the feveral regulations of this Act, and to receive intereft for the fame, not exceeding four pounds for one hundred pounds by the year.

13. And be it further enacted, That it fhall and may be lawful for any college or hall within the Universities of Oxford and Cambridge, or for any other corporate bodies poffeffed of the patronage of ecclefiaftical livings or benefices, to advance and lend any fum or fums of money, of which they have the power of difpofing, in order to aid and affift the feveral purposes of this Act, for the building, rebuilding, repairing, or purchafing, of any houses or buildings for the habitation and convenience of the Clergy, upon livings or benefices under the patronage of fuch college or hall, upon the mortgage and fecurity directed by this Act for the repayment of the principal, without taking any intereft for the fame.

14. And be it further enacted, That whenever the Patron of any living or benefice, to which the provifions of this Act are propofed to be extended, fhall happen to be a minor, idiot, lunatic, or feme-covert, it fhall and may be lawful for the Guardian, Committee, or Husband of every fuch Patron, to tranfact the feveral matters aforefaid for fuch Patron, who fhall be bound thereby, in fuch manner as if he or the had been of full age, of found mind, or feme-fole, and had done fuch act, or given his or her confent thereto.

15. Provided alfo, and be it further enacted, That all acts herein-before required to be done or confented to by the Ordinary and Patron, fhall be done by the Ordinary alone, when fuch Ordinary shall happen to be the Patron of the living; and that no deed, bond, transfer or other writing, inftrument, or proceeding, made, had, or done, under the powers or authority of this Act, fhall be charged or chargeable with any ftamp-duty, or fee of office, except as herein mentioned; any Law or Statute to the contrary notwithstanding.

16. Provided always, and it is hereby further enacted, That in all cafes where any act is required to be done by the Ordinary, in the execution of any of the purposes of this Act, and fuch Ordinary fhall be a body corporate aggregate, every fuch act shall be done and fignified under the feal of fuch body corporate.

17. Provided always, and be it further enacted, That where the Incumbent of any chapelry or perpetual cure fhall be nominated by the Rector or Vicar of the parish wherein the fame is fituated, in every fuch cafe the confent

of fuch Rector or Vicar, together with the consent of the Patron of fuch Rectory, fhall be neceffary in all fuch matters wherein the confent of the Patron is required by the former provifions of this Ac.

18. Provided likewife, and be it further enacted, That whenever any controverfy or difpute fhall arife touching the refidence of the Incumbent, with refpect to any of the matters contained in this Act, the fame fhall be adjusted and determined by the Ordinary of the diocese.

19. Provided alfo, and be it further enacted, That it fhall and may be lawful for the Patron, Ordinary, and Incumbent of any fuch living or benefice as aforefaid, or any two of them, of which the Ordinary to be one, by writing under their hands, to make fuch allowance to the perfon or perfons to be nominated by them, for the purpose of paying and applying the money fo to be raised as aforefaid, as they fhall think fit, not exceeding the fum of five pounds for every one hundred pounds fo to be laid out and expended as aforefaid.

20. Provided alfo, and be it further enacted, That in all cafes where the patronage of any living or benefice herein-before defcribed fhall be in the Crown, and fuch living or benefice fhall be above the yearly value of twenty pounds in the King's Books, the confent of the Crown to the feveral proceedings hereby authorized respecting fuch living or benefice, fhall be figned by the Lord High Treafurer, or First Lord Commiffioner of the Treasury for the time being; but if fuch living or benefice fhall not exceed the value of twenty pounds in the King's Books, fuch consent shall be fignified by the Lord High Chancellor, Lord Keeper, or Commiffioners of the Great Seal for the time being; or if fuch living or benefice fhall be within the patronage of the Crown in right of the Duchy of Lancaster, then fuch confent fhall be fignified by the Chancellor of the Duchy for the time being, by writing under their refpective hands, in the form or to the effect for that purpose contained in the fchedule hereunto annexed; and that in all fuch cafes where fuch deed is hereby required to be executed by the Patron as well as the Ordinary and Incumbent, fuch deed fhall be valid and effectual to all intents and purposes whatfoever, if executed by the Ordinary and Incumbent only, after fuch confent fhall have been obtained as aforefaid from the faid Lord High Treafurer, Firft Commiffioner of the Treafury, Lord Chancellor, Lord Keeper, Lords Commiffioners of the Great Seal, or Chancellor of the Duchy

of Lancafter refpectively, as the cafe fhall be, provided fuch confent fhall be registered at the Register Office aforefaid.

21. And be it further enacted, That it fhall and may be lawful for any Archbishop or Bishop of any diocefe, and alfo for any ecclefiaftical corporation fole or aggregate, being lord or lords of any manor within which there fhall be any wafte or common lands, parcel of the demefnes of fuch manor lying convenient for the house and buildings, and other the purposes of this Act, to grant a part or parts of fuch waste or common lands in perpetuity for the feveral purposes of this Act, leaving fufficient common for the feveral perfons having right of common upon fuch wastes or commons, and obtaining the confent of the leffee of fuch lands, if the fame fhall be in lease.

of the work propofed to be done by new buildings and repairs upon the faid glebe, and an eftimate of the expence attending the fame, after applying the faid materials, or the money to arife from the fale thereof, in fuch buildings and repairs; and alfo a particular account in writing, figned by the faid A. B. of the annual profits of fuch living, and of the rents, ftipends, taxes, and other

outgoings, annually iffuing thereout, verified upon oath, pursuant to the directions of an Act, paffed in the seventeenth year of the reign of his Majefty King George the Third, to promote the Refidence of the Parochial Clergy, by making Provifion for the more speedy and effectual building, rebuilding, repairing, or purchafing Houfes, and other neceffary Buildings and Tenements, for the Ufe of their Benefices; and having confidered fuch certificate, plan, and account: now, we do approve thereof; and do confent that fuch buildings and repairs fhall be made as therein specified; and that the faid A. B. do borrow and take up at intereft the fum of being the estimate of the expences, after deducting the value of the timber, and other materials, thought proper to be fold, and which appears to us, from the faid account, a fum not exceeding two years' net income and produce of the faid living; which money is to be paid to (a perfon nominated by us and the faid A. B.) and applied according to the direction of the faid Act.

confideration of the fum of five fhillings to him in hand paid, and of the fum of paid at or before the fealing and delivery hereof, into the hands of (a perfon or perfons (as the cafe fhall be) nominated by the faid Ordinary, Patron, and Incumbent, to receive the fame, purfuant to the direction of the said Act, (which nomination is alfo hereunto annexed,) and which receipt of the faid fum of.. have or hath acknowledged, by an indorsement on the back of this deed,) hath granted, bargained, fold, and demifed, and by these prefents doth grant, bargain, fell, and demife, unto the faid his executors, adminiftrators, and affigns, all the glebe lands, tithes, rents, modufes, compofitions for tithe, falaries, ftipends, fees, gratuities, and other emoluments and profits whatsoever, arifing, coming, growing, renewing, or payable to the Rector, Vicar, or Incumbent, (as the cafe shall be,) of the faid living in respect thereof, with all and every their rights, privileges, and appurtenances thereunto belonging, to have, hold, receive, take, and enjoy the faid premifes, with their and every of their appurtenances, unto the faid his executors, adminiftrators, and afligns, from henceforth, for and during the term of years, fully to be complete and ended, in as full, ample, and beneficial manner, and with fuch remedies and powers for obtaining and recover ing the fame, and every part thereof, to all intents and purposes, as the faid his fucceffors, Rectors, Vicars, & c. (as the cafe fhall be,) of the faid church, could or might, or ought to have held, enjoyed, received, taken, or recovered the fame, if these presents had not been made:
