of the glebe land (or of the tithes, as the cafe fhall be) belonging to the faid rectory, &c. herein-after mentioned ; that is to fay, (bere defcribe the particulars of the land or tithes propofed to be fold or exchanged;) which contract is hereby ratified and confirmed by the faid Ordinary, Patron, and Incumbent. Now this indenture witneffeth, that the faid A. B. C. D. and E. F. in order to carry the faid contract into execution, and to fulfil the purposes of the faid recited Act in purfuance of the powers thereby to them given, and in confideration of the fum of

the receipt whereof is acknowledged on the back of this deed; which fum hath been paid and applied in the purchafe of the lands herein-before defcribed; have, and each of them hath granted, bargained, and fold, (and exchanged, if the fame be by exchange,) and by these presents do, and each of them doth grant, bargain, fell, and exchange, if by exchange,) unto the faid G. H. and his heirs and affigns, all, &c. (bere defcribe the lands or tithes, as the cafe fhall be) with their and every of their rights, privileges, and appurtenances, to hold to and to the ufe of the faid G. H. his heirs and affigns for ever. (If done by exchange, add the following words, ) [in exchange for certain lands which belonged to the faid G. H. and are, by indentures of equal date herewith, exchanged and conveyed to the faid C. D. in truft, for the fole ufe and benefit of the faid E. F. and his fucceffors, Rectors, Vicars, &c. (as the cafe fhall be) of the faid living or benefice, for the time being, for ever.] And the faid A. B. C. D. and E. F. do hereby feverally covenant for themfelves, their feveral executors and adminiftrators, to and with the faid G. H. his heirs and affigns, that they, nor any of them, have or hath done any act whereby the faid lands (or tithes, as the cafe fhall be) can or may be incumbered; and that the faid G. H. his heirs and affigns, fhall and may, from time to time, for ever hereafter, peaceably and quietly hold and enjoy the faid glebe lands or tithes (as the cafe fball be) according to the true intent and meaning of the faid Act, without any let, hindrance, or interruption, of or from them, or any of them.

(or) [the parfonage houfe belonging to the faid rectory, &c. is become fo ruinous and decayed, (or fo mean) that it is not fit for the habitation of the Minifter of the faid rectory, &c.] and one year's net income or produce of the faid living or benefice will not be fufficient to rebuild or repair the faid houfe, with the neceffary offices belonging thereto: And whereas a certain meffuage, house, or tenement, with the buildings thereunto belonging, fituate in the property of the faid A. B. and lying within the diftance of yards from the church (or chapel, as the cafe fhall be) of the faid rectory, &c. appears to the faid Ordinary, Patron, and Incumbent, proper and convenient for the habitation and ufe of the Minifter of the faid rectory, &c. [and more commodious than the prefent house and buildings upon the glebe of the faid rectory, &c.] (in cafes where there are any ;) and a contract hath been made, by the direction and with the approbation and confent of the faid Ordinary, Patron, and Incumbent, with the faid A. B. which is hereby ratified and confirmed by the faid Ordinary Patron, and Incumbent, for the abfolute purchase of the faid meffuage, house, or tenement, and buildings, for the price or fum of pursuant to the directions of an Act, paffed in the feventeenth year of the reign of his Majefty King George the Third, intituled, An Act, &c. fet forth the title of the A&t :).

{[And whereas a contract has likewise been made with the faid A. B. by the like direction, approbation, and confent, which is hereby likewife ratified and confirmed by the faid Ordinary, Patron, and Incumbent, for the abfolute purchase of the inheritance of a certain yard, garden, orchard, and piece, or parcel of land (defcribing them particularly, as the cafe fhall be) lying near or convenient to the faid meffuage, houfe, tenement, and buildings, containing, by admeasurement, for the price or fum of which have been agreed by the faid Ordinary, Patron, and Incumbent, to be raised by the fale (or exchange) of certain lands or tithes as the cafe fball be) belonging to the said rectory, &c. herein-after defcribed, pursuant to the powers given by the faid A&t; viz. (bere give a full defcription of the land fo agreed to be fold ;) (if the equivalent is to be by exchange, then after the word Incumbent, last mentioned, infert) [and the faid A. B. to be exchanged for] certain lands or tithes, &c. (as above)]. Now this indenture witneffeth, that the faid A. An Act to explain and amend an Act, made in the Seven-teenth Year of the Reign of his prefent Majefty, intituled, An Act to promote the Refidence of the Parochial Clergy, by making Provifion for the more speedy and b effectual building, rebuilding, repairing, or purchafing Ar Houfes, and other neceffary Buildings and Tenements, for the Ufe of their Benefices.

WHEREAS by an Act, paffed in the seventeenth year of the reign of his prefent Majefty, intituled, An Alt to promote the Refidence of the Parochial Clergy, by making Provifion for the more speedy and effectual building, re building, repairing, or purchafing Houfes, and other necessary Buildings and Tenements, for the Ufe of their Benefices, it is Jaenacted, amongst other things, That the Incumbent of every living or benefice, of which the glebe, tithes, rents, and profits, fhall be mortgaged for the purposes of the faid Act, fhall pay the intereft arifing upon every fuch mortgage yearly, as the fame fhall become due; and also five pounds per centum per annum, if fuch Incumbent was refident, and ten pounds per centum per annum, if non-refident, of the principal remaining due, by yearly payments; which words, if literally understood and obferved, would, contrary to the true intent and meaning of the faid Act, render the difcharge of the principal fum impracticable, and thereby difcourage perfons from lend
