ing money upon fuch fecurities; be it therefore enacted by the King's moft excellent Majefty, by and with the advice and confent of the Lords fpiritual and temporal, and Commons, in this present Parliament affembled, and by the authority of the fame, That the Incumbent of every living or benefice of which the glebes, tithes, rents, and profits, have been or fhall be mortgaged for the purposes of the faid Act, fhall, from and after the paffing of this Act, well and truly pay, or caufe to be paid, to every fuch Mortgagee, over and befides the intereft of the principal money due upon fuch mortgage, the fum of five pounds per centum per annum, if refident, or ten pounds per centum per annum, if non-refident, of the money originally advanced upon fuch mortgage, until the whole of the faid principal money shall be difcharged; and if, upon any fuch mortgage or mortgages already made, lefs fhall have been paid by the prefent Incumbent than what is hereby directed to be paid, he shall, and he is hereby required, within fix months after the paffing of this Act, to make up the deficiency; and in default of payment thereof within the time aforefaid, the fame fhall be recovered in fuch and the fame manner as the interest is recoverable by virtue of the provisions in the said recited Act.

2. And be it further enacted, That the forms contained in the said schedule refpecting the allowance of accounts, and the bond and receipt to be given by the Nominee, as directed by the faid recited Act, or forms to the like effect, fhall be observed and complied with in the execution of this and the said recited Act.

3. And be it further enacted, That this Act, and every thing herein contained, fhall be deemed, adjudged, and taken to be a public Act; and fhall be judicially taken notice of as fuch, by all Judges, Juftices, and other perfons whomsoever, without specially pleading the fame.

Form of the Condition of the faid Bond.

HE Condition of the above Obligation is fuch, that if the faid A. B. (naming the Nominee, as before mentioned) fhall and do juftly and truly pay and account for the fum of received by him this day from C. D. being the perfon to whom a mortgage hath been this day made and executed of the glebe, tithes, rents, and other profits and emoluments, of the rectory (vicarage, &c. as the cafe fhall be) of for the purpose of building (rebuilding, or repairing) of the said rectory, &c. (as the cafe fball be) according to the true intent and meaning of two several Acts of Parliament, paffed in the feventeenth and twenty-first years of the reign of his Majefty King George the Third, for those purposes; then this Obliga tion to be void, or otherwife to remain in force.

An Act for the better Prefervation of Parochial Libraries in :that Part of Great Britain called England.

WHEREAS in many places in the fouth parts of Great Britain called England and Wales the provifion for the Clergy is fo mean, that the neceffary expence of books for the better profecution of their ftudies cannot be defrayed by them; and whereas of late years feveral charitable and well-difpofed perfons have by charitable contributions erected libraries within feveral parishes and diftricts in England and Wales; but fome provifion is wanting to preferve the fame, and fuch others as fhall be provided in the fame manner, from embezzlement: Be it therefore enacted by the Queen's most excellent Majefty, by and with the advice and confent of the Lords fpiritual and temporal, and Commons, in this prefent Parliament affembled, and by the authority of the fame, That in every parish or place where fuch a library is or fhall be erected, the fame fhall be preferved for fuch use and ufes, as the fame is and shall be given, and the orders and rules of the founder and founders of fuch libraries fhall be obferved and kept.

2. And for the encouragement of fuch founders and benefactors, and to the intent they may be fatisfied that their pious and charitable intent may not be frustrated; be it also enacted by the authority aforefaid, That every Incumbent, Rector, Vicar, Minifter, or Curate of a parish, before he shall be permitted to use and enjoy fuch library, fhall enter into fuch fecurity by bond, or otherwise, for prefervation of fuch library, and due obfervance of the rules and orders belonging to the fame, as the proper Ordinaries, within their refpective jurifdictions, in their difcretion thall think fit; and in cafe any book or books belonging to the faid library fhall be taken away and detained, it fhall and may be lawful for the faid Incumbent, Rector, Vicar, Minifter, or Curate for the time being, or any other perfon or perfons, to bring an action of trover and converfion, in the name of the proper Ordinaries within their respective jurifdictions, whereupon treble damages shall be given, with full cofts of fuit, as if the

fame were his or their proper book or books; which da mages fhall be applied to the ufe and benefit of the faid library.

3. And it is further enacted by the authority aforesaid, That it fhall and may be lawful to and for the proper Ordinary, or his Commiffary or Official in his refpective jurifdiction, or the Archdeacon, or by his direction his Official or Surrogate, if the faid Archdeacon be not the Incumbent of the place where fuch library is, in his or their respective vifitation, to enquire into the flate and condition of the faid libraries, and to amend and redrefs the grievances and defects of and concerning the fame, as to him or them fhall feem meet; and it fhall and may be lawful to and for the proper Ordinary, from time to time, as often as fhall be thought fit, to appoint fuck perfon or perfons, as he fhall think fit, to view the state and condition of fuch libraries; and the faid Ordinaries, Archdeacons, or Officials refpectively, fhall have free ac cefs to the fame at fuch times as they fhall refpectively appoint.

4. And be it alfo further enacted by the authority aforefaid, That where any library is appropriated to the ufe of the Minister of any parish or place, every Rector, Vicar, Minifter, or Curate of the fame, within fix months. after his inftitution, induction, or admiffion, fhall make or caufe to be made a new catalogue of all books remaining in, or belonging to, fuch library, and fhall fign the faid catalogue, thereby acknowledging the cuftody and poffeffion of the faid books; which faid catalogue fo figned fhall be delivered to the proper Ordinary within the time aforefaid, to be kept registered in his court, without fee or reward for the fame.

5. And be it further enacted by the authority aforefaid, That where there are any parochial libraries alreadyerected, the Incumbent, Rector, Vicar, Minifter, or Curate, of such parish or place, fhall make or cause to be made a catalogue of all books in the fame, thereby acknowledging the cuftody and poffeffion thereof; which catalogue fo figned fhall be delivered to the proper Ordinary on or before the nine and twentieth day of September, which shall be in the year of our Lord one thousand feven hundred and nine; and where any library fhall at any time hereafter be given and appropriated to the use of any parish or place where there fhall be an Incumbent, Rector, Vicar, Minister, or Curate in poffeffion, fuch Incumbent, Rector, Vicar, Minifter, or Curate, fhall make
