The CHAIRMAN. If you get a new site there, what are you going to do with the old site?

Mr. MARTIN. Sell it.

The CHAIRMAN. Have you any idea what that is worth?
Mr. WETMORE. $150,000 at least.

Mr. MARTIN. It will probably sell for more than that.

Mr. PHILP. Yes. They tell me they can get a good deal more than that. In fact, some of them have said $300,000.

The CHAIRMAN. The amazing thing is that whoever made the original estimate only guessed half of what you are guessing at now. Mr. MARTIN. The original estimate had in mind alternate legislation.

Mr. PHILP. I do not know who made the original estimate, but I went out there myself, and when I saw it I could not understand why the original estimate was ever made.

SOMERS WORTH, N. H., POST OFFICE, ETC.

CONSTRUCTION OF BUILDING

The CHAIRMAN. The next item is for Somersworth, N. H., post office, and so forth: For construction of a building under an estimated total cost of $75,000. Tell us about that item.

Mr. WETMORE. The population of Somersworth, N. H., in 1930, was 5,990, and the postal receipts for the same year were $12,743. This is a building on a Government-owned site. The building proposed is a basement and one story, having a ground area of approximately 4,600 square feet, brick faced, stone or granite trim, and fireproof construction. The proposed building will provide approximately 3,640 square feet for the post office and 500 square feet for the civil service.

SOMERVILLE, N. J., POST OFFICE, ETC.

ACQUISITION OF SITE AND CONSTRUCTION OF BUILDING

The CHAIRMAN. The next item is for Somerville, N. J., post office, etc. and so forth: acquisition of site and construction of a building, under an estimated total cost of $135,000.

Mr. WETMORE. The population of Somerville, N. J., in 1930, was 8,255, and the postal receipts for the same year were $52,495. Á site and building are proposed in this project, the building to consist of a basement and one story, having a ground srea of approximately

6,800 square feet, brick faced, stone trim, and fireproof construction. The proposed building will provide approximately 5,240 square feet for the post office and 400 square feet for the Labor Department.

SOUTH HAVEN, MICH., POST OFFICE, ETC.

The CHAIRMAN. The next item is for South Haven, Mich., post office, and so forth: For acquisition of site and construction of a building under an estimated total cost of $115,000.

Mr. WETMORE. The population of South Haven, Mich., in 1930, was 4,889, and the postal receipts for the same year were $41,407. The project covers a site and building, the building to consist of a basement and 1-story, having a ground area of approximately 6,000 square feet, brick faced, stone trim, and fireproof construction. The proposed building will provide approximately 4,940 square feet for the post office.

SPENCER, IOWA, POST OFFICE, ETC.

The CHAIRMAN. The next item is for Spencer, Iowa, post office, and so forth: For acquisition of site and construction of a building, under an estimated total cost of $105,000.

Mr. WETMORE. The population of Spencer, Iowa, in 1930, was 5,019, and the postal receipts for the same year were $46,053. The project covers a site and building, the building to consist of a basement and 1-story, having a ground area of approximately 6,100 square feet, brick faced, stone trim, fireproof construction. The proposed building would provide approximately 4,990 square feet for the post office only.

SPRING VALLEY, ILL., POST OFFICE, ETC.

CONSTRUCTION OF BUILDING

The CHAIRMAN. The next item is for Spring Valley, Ill., post office, and so forth: For construction of a building under an estimated total cost of $60,000.

Mr. WETMORE. The population of Spring Valley, Ill., in 1930 was 5,272, and the postal receipts for the same year were $11,506. The project covers a building on a government-owned site. The building proposed consists of a basement and one story, having a ground area of approximately 3,700 square feet, brick faced, stone trim, and fireproof construction. The proposed building will provide approximately 3,040 square feet for the post office and 500 square feet for the civil

service.

STILLWATER, OKLA., POST OFFICE, ETC.

The CHAIRMAN. The next item is for Stillwater, Okla., post office, and so forth: For acquisition of site and construction of a building, under an estimated total cost of $135,000.

Mr. WETMORE. The population of Stillwater, Okla., in 1930, was 7,016, and the postal receipts for the same year were $49,195. The

project covers a site and building, the proposed building to consist of a basement, one story and attic, having a ground area of approximately 6,800 square feet, brick faced, stone trim, fireproof construction. The proposed building will provide approximately 5,540 square feet for the post office and 180 square feet for the internal revenue.

STROUDSBURG, PA., POST OFFICE, ETC.

ACQUISITION OF SITE AND CONSTRUCTION OF BUILDING

The CHAIRMAN. The next item is for Stroudsburg, Pa., post office, etc. For acquisition of site and construction of a building, under an estimated total cost of $130,000.

Mr. WETMORE. The population of Stroudsburg, Pa., in 1930, was 5,961, and the postal receipts for the same year were $47,875. The project covers a site and building, and the proposed building consists of a basement and two stories, having a ground area of approximately 5,600 square feet, brick faced, stone trim, fireproof construction. The proposed building will provide approximately 4,490 square feet for the post office, 500 square feet for the civil service, and 300 square feet for the internal revenue.

SYLACAUGA, ALA., POST OFFICE, ETC.

CONSTRUCTION OF BUILDING

The CHAIRMAN. The next item is for Sylacauga, Ala., post office, etc. For construction of a building, under an estimated total cost of $75,000.

Mr. WETMORE. The population of Sylacauga, Ala., in 1930, was 4,111, and the postal receipts for the same year were $17,531. The project covers a building on a government-owned site. The building consists of a basement, one story and attic, having a ground area of approximately 4,400 square feet, brick faced, stone trim, and fireproof construction. The proposed building will provide approximately 3,300 square feet for the post office.

The CHAIRMAN. That is one of the places where the Government owns the site.

Mr. WETMORE. Yes, sir.

TEXARKANA, ARK.-TEX., POST OFFICE, COURTHOUSE, ETC.

The CHAIRMAN. The next item is for Texarkana, Ark.-Tex., post office, courthouse, etc.

Mr. WETMORE. This provides

Provision for this project in act of July 3, 1930, shall include the construction of a building on the enlarged site for the accommodation of United States courts, of Texas and Arkansas, authorized to hold terms of court in said city, post office, and other Government offices, under the limit of cost established in said act.

That is a case where the previous act omitted mention of the building. It fixed a limit of cost but it did not specifically authorize the construction of a building.

Mr. BACON. In which State will they hold court?

Mr. WETMORE. They will hold court in both States. This building is on the State line. The Arkansas court is on one side of the building and the Texas court is on the other side.

The CHAIRMAN. What about the change in the Texarkana item? Mr. MARTIN. The original legislation omitted authority to construct the building. It was an error. We have a limit of cost sufficient to buy the land and build the building, but we omitted language that would authorize the construction of the building. This is for correcting that error.

The CHAIRMAN. You are asking permission now to build a building. Mr. MARTIN. Yes, sir.

The CHAIRMAN. Do they have a court there now?

Mr. MARTIN. They have two courts.

Mr. PHILP. They have one on each side of the State lines.

The CHAIRMAN. Is it the same court, or do they have two courts? Mr. PHILP. They are separate courts.

Mr. HEFFERNAN. The trial of a criminal case, of course, must be held in the State where the offense is committed. The trial of a case where the offense is committed in Arkansas must be held on the Arkansas side of the line, and if the offense was committed in Texas, the trial must be held on the other side of the building.

The CHAIRMAN. The building is on the line?

Mr. HEFFERNAN. Yes, sir.

The CHAIRMAN. Does the same judge act in both courts?

Mr. HEFFERNAN. No, sir; of course, the same judge could act by designation of the senior circuit judge. He could try cases on one side of the line one day and try cases on the other side the next day, or on the same day.

The CHAIRMAN. When they have a trial down there, do they make a survey to see whether the offense was actually committed on one side of the line?

Mr. HEFFERNAN. They have to do that if an attorney raises a question involving the jurisdiction of the court.

Mr. PHILP. The State line runs up the middle of the street. They had a courthouse in Texas, and the original scheme was to have a court house in Arkansas, or a court house on both sides, but they finally got the consent of Senator Sheppard to sell the courthouse in Texas and have both courts in one building, rather than maintain two separate buildings. The post office is all in one building. There will be no partition so far as the post office is concerned, but there will be a partition between the court rooms.

The CHAIRMAN. You are sure you have a provision in here to build a courthouse?

Mr. MARTIN. Yes, sir.

THOMASTON, GA., POST OFFICE, ETC.

The CHAIRMAN. The next item is for Thomaston, Ga., post office, and so forth. For acquisition of site and construction of a building, under an estimated total cost of $95,000.

Mr. WETMORE. The population of Thomaston, Ga., in 1930 was 4,946, and the postal receipts for the same year were $21,041. The project covers a site and building. The proposed building consists of a basement and one story, with a ground area of approximately 5,700 square feet, brick faced, stone or marble trim, and fireproof construction. The proposed building will provide approximately 4,540 square feet for the post office.

THOMSON, GA., POST OFFICE, ETC.

CONSTRUCTION OF BUILDING

The CHAIRMAN. The next item is for Thomson, Ga., post office, and so forth. For construction of a building, under an estimated total cost of $70,000.

Mr. WETMORE. The population of Thomson, Ga., in 1930, was 1,960, the postal receipts for the same year were $9,662, and the project covers a building on a Government-owned site. The building is to consist of a basement, one story and attic, having a ground area of approximately 3,850 square feet, brick faced, stone trim, and fireproof construction. The proposed building will provide approximately 2,910 square feet for the post office.

TOCCOA, GA., POST OFFICE, ETC.

The CHAIRMAN. The next item is for Toccoa, Ga., post office, and so forth: For construction of a building, under an estimated total cost of $65,000.

Mr. WETMORE. The population of Toccoa, Ga., in 1930, was 4,602, and the postal receipts for the same year were $12,014. The project covers a building on a Government-owned site, the building consisting of a basement and one story, having a ground area of approximately 4,000 square feet, brick faced, stone trim, and fireproof construction. The proposed building will provide approximately 3,000 square feet for the post office.

TOOELE, UTAH, POST OFFICE, ETC.

Mr. WETMORE. The population of Tooele, Utah, in 1930, was 5,135, and the postal receipts for the same year were $12,708. The project contemplates the site and building, the building consisting of a basement and one story, having a ground area of approximately 3,300 square feet, brick faced, stone or terra cotta trim, and fireproof construction. The proposed building will provide approximately 2,865 square feet for the post office.

TOPEKA, KANS., POST OFFICE AND COURTHOUSE

DEMOLITION OF OLD AND CONSTRUCTION OF NEW BUILDING

The CHAIRMAN. The next item is for Topeka, Kans., post office and courthouse: For demolition of building and construction of a new building, under an estimated total cost of $950,000.

Mr. WETMORE. The population of Topeka, Kans., in 1930 was 64,120, and the postal receipts for the same year were $1,140,355. The proposal is for a new building on the present site, the present building to be demolished. The proposed building consists of a
