Several other persons were also arrested in connection with this

case.

Mr. ADLERMAN. Were any of the people arrested in this case connected with WYEAC?

Captain McCooL. I don't believe so, sir.

Mr. ADLERMAN. All right.

Captain McCooL. On August 23 a patrol division officer observed Herman Brown, who is a WYEAC worker, carrying a pump action type shotgun from one of the WYEAC vans inside the premises of 735 North Madison Street.

Mr. ADLERMAN. 735 North Madison Street. Is that one of the Centers?

Captain McCooL. That is a private residence.

On August 25, a WYEAC van, Delaware registration PC-15526, was hit with several bullets while it was parked in the 1500 block of Todds Lane. Several arrests of WYEAC workers took place as a result of the investigation of this incident. The persons arrested were Lawrence Brown

Mr. ADLERMAN. Will you identify Lawrence Brown?

Captain MCCOOL. He is a youth organizer.

Mr. FIALKEWICZ. Lawrence Brown is in the youth organizer group. Mr. ADLERMAN. Making $7,748 a year.

Mr. FIALKEWICZ. That is the class. Whether that was his salary at the time I couldn't say.

Mr. ADLERMAN. The next one.

Captain MCCOOL. John Freeman.

Mr. ADLERMAN. What is his status?

Captain McCooL. Assistant center director, Northeast.

Mr. ADLERMAN. What is his position, assistant director of the Northeast Center?

Mr. FIALKEWICZ. That is correct, making $4,966.

Mr. ADLERMAN. George Brown?

Captain McCOOL. George Brown was arrested. He is the director of WYEAC.

Mr. ADLERMAN. He is the headman on the entire project?

Captain MCCOOL. Yes, sir.

Mr. ADLERMAN. His salary was $9,932.

Mr. FIALKEWICZ. That is correct.

Mr. ADLERMAN. He was arrested at the same time?

Captain MCCOOL. That is correct.

Mr. ADLERMAN. This was the so-called Todds Lane arrest?

Captain MCCOOL. That is correct.

Mr. ADLERMAN. This was the time there was a shooting affray which involved these people and some other people?

Captain MCCOOL. Yes, sir; there was a shooting on this occasion. Mr. ADLERMAN. A van was shot up?

Captain McCooL. That is correct.

Charles Miller was also arrested at this time.

Mr. ADLERMAN. What was his position?

Mr. FIALKEWICZ. He is a youth organizer, $7,748.

Mr. ADLERMAN. They seem to be the top bracket people.

Captain McCooL. Three females were arrested, Joyce Saunders, Signoria Tucker, and Annette Bryant.

Mr. ADLERMAN. Had they been in the van?

Captain McCooL. I don't know, Mr. Adlerman, whether they had been in the van or not.

Mr. ADLERMAN. Were any connected with WYEAC?
Captain MCCOOL. I don't believe so.

Senator CURTIS. Were they charged with anything?

Captain McCooL. Yes. All of the subjects that were mentioned were charged with unlawful entry. This was after the investigating officers had found them inside of the home of Lois Brown, who resides at 1528 Dodds Lane. They were found hiding inside the house.

Mr. ADLERMAN. This is a pending case?

Captain MCCOOL. Yes. And the prosecution has rested in the case. Mr. BIONDI. The prosecution has rested its case and the motion has been made by the defense for a verdict of acquittal.

Senator MUNDT. Go ahead.

Captain MCCOOL. There were three weapons found lying outside of this location, in the immediate area outside of this location. The three weapons included a .22-caliber Stevens semiautomatic rifle. A 25caliber automatic pistol and another .22-caliber semiautomatic rife that was an Ithaca make.

There are detailed investigative reports along with some photographs available in regards to this case.

Senator CURTIS. I would like to ask you, did this incident occur in the daytime?

Captain MCCOOL. No, sir; this occurred during the evening hours. This occurred after midnight.

Earlier I had mentioned the Cherry Island incident, and I would now like to elaborate on this. This occurred on August 31 of this year. Cherry Island can be described as a marshlike area in the city of Wilmington where there are no private residences. There are some industrial operations in this area such as our city disposal plant. It is an area that is checked by patrol officers and on this particular date Patrolman Tasker and Patrolman Spencer while out on patrol in this area heard gunshots. Their investigation revealed a WYEAC van from the South Street branch parked in a desolate area of Cherry Island. On further observation of the officers they observed six men attired in black berets walking around this area. The men did not see the patrol officers. They were taking turns firing four different guns that they passed among themselves. One shot went over the heads of the police officers Tasker and Spencer.

At this time they called in to central for assistance and some initial cars were dispatched to that location. I also responded there along with members of the tactical patrol force of which I was in charge at that time. We closed the area off and the six men that the officers had under observation started to return to their vehicle still apparently unaware that the police were present.

As they came into view of the policemen two of the men were wearing ammunition bandoliers across their chests. All of the men had black berets on and three of them had badges on the berets which said,

"I have already been drafted into the Liberation Army." That is what the badge they had on the beret stated.

These men were taken in custody at this time and they were found to be the following subjects:

Meredith Wiggins, who is a center director for South Street WYEAC.

Mr. ADLERMAN. What salary?

Mr. FIALKEWICZ. $6,000 salary.

Senator MUNDT. What time of day or night was this incident? Captain MCCOOL. This was around 12:30 in the afternoon, around noontime.

Senator MUNDT. Broad daylight.
Captain McCOOL. Yes, sir.

Senator MUNDT. A working day?

Captain McCOOL. This was on a Saturday, Saturday afternoon. At this time Wiggins had two bandoliers around his chest and he was carrying a 12-gage shotgun. The second party who was taken into custody was Warren Mowbray. He is a youth worker for WYEAC. Mowbray was carrying a 16-gage shotgun.

Mr. ADLERMAN. What position does he hold?

Mr. FIALKEWICZ. A youth worker in the Northeast Center, $4,500 to $4,800 class.

Mr. ADLERMAN. Go ahead.

Captain MCCOOL. The third subject was Allan Steed. He is a youth aid worker for WYEAC.

Mr. ADLERMAN. What is he connected with?

Mr. FIALKEWICZ. Northeast Center, $3,400 to $3,800.

Captain MCCOOL. He had a bandolier around his chest and was carrying a 30-30 caliber rifle with a 2-power scope mounted on it.

Mr. FIALKEWICZ. Allan Steed was off the payroll as of May 24, 1968. At the time of arrest he was not on the payroll.

Captain MCCOOL. But prior to that our records reveal he had been a worker in a youth aid capacity.

The fourth subject that was taken into custody was Nelson Hudson, who the records indicated had been a youth aid worker, WYEAC. Mr. ADLERMAN. In the Northeast.

Mr. FIALKEWICZ. Listed as youth worker on the payroll at the Northeast Center.

Mr. ADLERMAN. Salary?

Mr. FIALKEWICZ. $4,500 to $4,800 class.

Captain MCCOOL. The fifth subject who was taken into custody was William Robinson. At this time he was carrying a 12-gage shotgun. The sixth subject that was taken into custody was James Barber.

All these subjects were placed under arrest and the WYEAC van was impounded. After obtaining a search warrant for this van it was found to contain a quantity of marihuana, a small quantity of marihuana. Mr. ADLERMAN. In the van?

Captain MCCOOL. That is correct. The photographs are available at this time of the Cherry Island area. I would like to submit them into evidence. The arrests started a series of events which resultedMr. ADLERMAN. Do any of them show the van at all? Senator MUNDT. You may proceed.

Captain MCCOOL. The arrests started a series of events which resulted in the obtaining of search warrants and the subsequent raids on the home of some of the individuals that had been arrested. Allan Steed's home at 393 Spruce Street was found to contain a total of 3,235 rounds of assorted ammunition. One 18-inch machete was found there also.

Mr. ADLERMAN. These were search warrants obtained as a result of the arrests?

Captain McCooL. These were search warrants that were obtained on September 3. In the case of Steed, his was by authorization of the gentleman who resided at 933 Spruce Street. In fact, he came to police headquarters and requested that the police officers go down there and remove these articles from the home.

Senator CURTIS. For the record, I would like to ask how much is a round of ammunition?

Captain MCCOOL. A round is referred to as one projectile. It would be one 12-gage shotgun shell, or one .38 caliber bullet.

Senator MUNDT. Is this the picture of the van that was taken out at Cherry Island?

Captain MCCOOL. Yes, it is.

Senator MUNDT. It will be received as an exhibit and given the appropriate number.

Senator MUNDT. Is this a picture of the police car?

Captain MCCOOL. That is a police car. The weapons displayed on the police car are the weapons and ammunition confiscated from the six arrested subjects.

Senator MUNDT. It may be received and given an appropriate

number.

Senator MUNDT. What is this? Looks like a table.

Captain McCooL. Those are some articles recovered in the home of Nelson Hudson by a subsequent search warrant that was issued. Senator MUNDT. It may be marked as an exhibit with the appropriate number.

Captain MCCOOL. The articles I just mentioned were discovered in the home of Allan Steed.

Captain MCCOOL. Additional weapons and ammunition were found in the homes of Nelson Hudson, which is the picture to which you just referred. The home of William Robinson was found to contain additional weapons, ammunition, and certain subversive-type literature. (The photographs referred to were marked "Exhibits Nos. 232 and 233" for reference and appear on pp. 2860 and 2861.)

(At this point Senator Curtis withdrew from the hearing room.) Senator MUNDT. Maybe you can finish your testimony before we have to go to the rollcall.

Captain MCCOOL. The home of Meredith Wiggins revealed weapons, including a .22 caliber magnum rifle and additional ammunition.
