Theodrick Smiley was in the home of Wiggins at the time the raid was conducted on September 3. There are photographs and more detailed information available.

It should also be noted that James Barber was arrested only 4 days prior to the Cherry Island incident. He was arrested on a charge of rioting involving an incident that occurred at 529 Vandever Avenue, known as the R & S Delicatessen. This was after officers who were on stakeout duty observed Barber along with several other persons pouring gasoline on the front steps of this location and inside the front door and go around to the rear door where they placed a bottle of gasoline. The R & S Delicatessen has been the scene of constant harassment and four fires were started there the night before Barber's arrest. This statement has been very lengthy, but I have tried to summarize a period of over 2 years and our gang activity in the city of Wilmington has been rather extensive. There are very recent incidents that could be listed but I feel they will come out in the testimony before this committee.

One such incident of just last week involved Calvin Loper, the paid WYEAC worker who during the month of June 1967 was arrested on two charges of assault with intent to commit murder.

In this latest incident he was arrested on a charge of riot involving the assault on a police officer at BJ's Corner.

Senator MUNDT. Is he still on the payroll of WYEAC, 2 weeks after he had previously been apprehended?

Captain McCOOL. As of 2 weeks ago I don't know, Mr. Chairman. Senator MUNDT. Does anybody have information on that?

Mr. FIALKEWICZ. I will check the records and I will have the answer for the committee.

Senator MUNDT. That would be astonishing if he were still being paid by the taxpayers after he was already apprehended.

Captain McCOOL. The incident did take place at BJ's Corner. In fact, Calvin Loper went inside of BJ's Corner when the officers attempted to place him under arrest.

Senator MUNDT. Find out and put in the record whether or not he was still on the payroll.

Captain McCooL. I would like to let the list of activity that we have presented to this committee, along with additional testimony, speak for itself as to whether or not WYEAC has been effective in lessening tensions among different gangs and whether they have provided a form of leadership that could be conducive to inspiring the young members of any community to channel their efforts and activities into more constructive fields of endeavor other than gang rumbles and violence.

Senator MUNDT. Thank you very much, Captain McCool, for your informative and competent testimony.

We have to go now for a vote. After the vote I have another committee which I must attend. Senator Curtis will come back and preside over the committee meeting for the next witness.

Mr. ADLERMAN. Mr. Fialkewicz, do you know whether or not Mr. Loper was employed at the time of his last arrest?

Mr. FIALKEWICZ. Loper was arrested in June for the assault on the police officers. Since then he has been carried on the payroll and was an employee of WYEAC at the time of his arrest last week.
