7. That in case the originals of any documents or records are in the files of the United States or Mexican Sections of the International Boundary Commission, they shall be produced on request, as soon as may be, either at Washington or Mexico City, or at the offices of the respective sections in El Paso, Texas, as may be most convenient;

8. That either party inspecting any document under the terms of this agreement, shall be permitted, at the expense of that party, to take a certified copy of the document or record so inspected;

9. That it is agreed by both Agents that subject to any order which the International Boundary Commission, acting upon its own initiative may make in the premises, both Agents waive the production at the trial of the following:

a. Any document or record printed or relied upon in the cases, the inspection of which was not requested in accordance with the terms of this agreement;

b. Any document or record, the inspection of which was requested, unless notice of the intention to move for the production of the original or a certified copy of said document shall have been given to the opposing Agent within twenty days after such inspection shall have been granted;

10. The notice required by No. 9 Section "b," may be filed with the Mexican Embassy in the City of Washington, or with the Embassy of the United States in the City of Mexico, as the case may be;

II. That the foregoing arrangement applies mutatis mutandis to the inspection of originals of documents or records printed or relied upon in the respective counter-cases except that the two Agents shall have until May first to present their respective lists of documents or records, the inspection of which is requested.

I did not reply as soon as I received your note because it arrived while Mr. Francisco L. de la Barra our new Secretary of State was on his way to Mexico, and I considered that it was convenient to consult his opinion.

Now I have the pleasure to say that your suggestions meet my approval and that therefore your proposals are accepted.

As this letter will take six days to reach you, we may consider that the agreement goes into effect on the 15th instant.

No. 325. Numero 1. Presentacion de Ponze al Presidente. Sor. Presidente de este Partido, El C. Juan Ma Ponce de Leon vecino de esta villa del Paso Ante V. como mejor alla lugar en derecho se presenta y dice. Que hase el espacio de ocho meces tiene empretado de su S. S. el ayuntamiento de la meama le mande posecionar del Terreno de la otra Banda (que con su permiso descubrio para labor segun consta de expediente formado de ante mano) y asta la presente no se ha efectuado por justos motibos que interrumpieron su huso e hicieron ocurrio a Consulta al Superior Gobierno cual hallandose en esta dicha villa y evacuado lo practicado en ella pide que V. se cirba mandarcele de copia alcalse de este tanto de lo resuelto por quella authoridad como del cumplimiento q. se le dio todo para los usos q. le conbengan por tanto. A. V. rendi'damte pido y suplico mande hacer como impetro en q. recibire gracia y justicia Juro y lo necesario.

a [The Joint Journal of the International Boundary Commission for May 12, 1896, contains the following passage:

"The witnesses Samaniego and Varela not being present, the United States Commissioner then presented certified copies of four official papers dated September 21st and 24th, 1827, from the Public Archives of Paso del Norte, Book No. 12, pages 59, 60, 61, and 62, corresponding to the year 1827, which embraces the application of Juan Maria Ponce de Leon for a grant of two caballerias of land opposite Paso del Norte, the grant of the same and the survey and field notes thereof; these two caballerias being the same that accretions thereto are the subject of this investigation, and for a more intelligent understanding of the case he requests that the Consulting Engineers be directed to plat the survey of the two caballerias on the sketch of the land, now in preparation by them, and that the papers above referred to be attached to the proceedings in the case." The "four official papers" here referred to and directed to be "attached to the proceedings of the case were not printed in the proceedings of the International (Water) Boundary Commission and have not been found in the archives of the United States. The representatives of the United States have thus far not succeeded in obtaining copies of these documents from the public archives of Ciudad Juarez. The documents, however, are transcribed in book “A” of the records of El Paso County and are here printed as they appear in these records.-Agent's note.]
