TO AUTHORIZE THE ESTABLISHMENT AND MAINTENANCE OF PUBLIC LIBRARIES AND TO PROVIDE FOR THEIR CONTROL AND PROTECTION.

Be it enacted by the Legislature of the State of Idahor

SECTION 1. That the common council of every city and of every village of the State of Idaho shall have power to establish a public library and reading room, and for such purpose may annually levy and cause to be collected, as other taxes are, a tax not exceeding one mill on the dollar of the taxable property of such city or village, to constitute a library fund, which shall be kept by the treasurer separate and apart from other moneys of the city or village and be used exclusively for the purchase of books, periodicals, necessary furniture and fixtures, and what is required for the maintenance of such library and reading

room.

SECTION 2. The trustees of a school district in which is situated no incorporated town or village, on the petition of twenty electors thereof, shall, upon four weeks' notice published in some newspaper of general circulation published in the county wherein such district is situated, submit to the electors thereof, at the first election held therein for the purpose of electing a member, or members, of the board of trustees, following the publication of the said notice, the question whether there shall be a public library established in such school district for the use and benefit of the citizens thereof; and those voting at such election in favor of such library shall put upon their ballots the words, "Public Library, Yes," and those voting thereat against such library the words, "Public Library, No;" and if a
