An Act to amend the Laws of the Customs.

[Assented to 20th September, 1876.]

HEREAS it is expedient to alter the duties of Customs Preamble. imposed in the Province of South Australia in manner hereinafter provided-Be it therefore Enacted by the Governor of the Province of South Australia, with the advice and consent of the Legislative Council and House of Assembly of the said Province, in this present Parliament assembled, as follows:

Act.

1. Act No. 10 of 1870, intituled "An Act to amend the Laws Repeal of existing of the Customs in South Australia," is hereby repealed, except so far as relates to anything lawfully done or commenced or contracted to be done before the commencement of this Act, and except so far as may be necessary to enable any punishment to be inflicted, or penalty enforced, for any act, matter, or thing contrary to the provisions of the said Act, and also except as to any duty, or arrears of duty, or drawback due or payable at any time before the passing of this Act, under the provisions of the said Act hereby repealed.

2. In lieu of all other duties of Customs there shall be raised, Duties. levied, collected, and paid unto Her Majesty for the uses of the said Province, and support of the Government thereof, the several duties of Customs set forth in the Schedule hereto, and no others.

3. The Collector of Customs, and all officers of Customs are Indemnity to Colhereby indemnified, protected, and held harmless, against any lector of Customs.

action, claim, or damage to which he or they might otherwise have been liable by reason of any refusal to deliver any goods imported into the said Province after the twenty-fifth day of July, one thousand eight hundred and seventy-six, or in bond on that day without payment of the duties set forth in the Schedule hereto, or, without payment of the duties authorized to be levied by any Act in force within the said Province at the time of the coming into operation of this Act.

4. The Collector of Customs shall, subject to the approval of the Governor, have power to make regulations fixing the amount to be paid by proprietors or occupiers of bonded warehouses or baggage warehouses which have been or shall be appointed for the free warehousing and securing of goods under the provisions of "The Customs Act, 1864"; and every such proprietor or occupier shall pay to the said Collector, pursuant to such regulations, whatever amount may be so fixed: And until such regulations shall be made every such proprietor or occupier shall pay for each and every year, or proportional part of a year, after the coming into operation of this Act, during which such appointment shall be in force, the sum of Fifty Pounds, or a proportional part thereof, for each such bonded warehouse or baggage warehouse situated in Adelaide or Port Adelaide, and the sum of Twenty Pounds, or a proportional part thereof, for each such bonded warehouse or baggage warehouse situated in any other part of the said Province: Provided always, that the amount to be paid yearly in respect of each bonded warehouse or baggage warehouse under such regulations shall not exceed One Hundred Pounds.

Implements, viz. :-Engines not exceeding sixty horse-power, Iron and Brass Castings, and Wrought Iron; Forged Work used in the manufacture of Steam Engines; Pumps, Iron and Brass, exceeding 3-inch bore; Boilers for Steam Engines and steam purposes; Chaff Cutters, Corn Crushers, Grain Sowers, Horse Powers, Mowing Machines, Reaping Machines, Scarifiers, Horse Rakes, Ploughs (Triple), Ploughs (Double), Ploughs (Single), Harrows, Moulding Boards, Ploughshares.

NOTE. In all cases where duty is charged at per gallon, one dozen reputed quart bottles will be taken as two gallons, and one dozen reputed pint bottles as one gallon.
