4 ESTABLISHING TOTAL AMOUNT OF GOVERNMENT OUTLAYS

SEC. 4. (a) After receiving and giving consideration to 6 the recommendation of the Joint Economic Committee with 7 respect to a fiscal year, the Committees on Appropriations of 8 each House of Congress shall, not later than ten days after 9 receiving such recommendations, report to its House a bill 10 or joint resolution establishing the total amount of outlays 11 to be made during that fiscal year by the United States 12 Government.

13 (b) (1) A bill or joint resolution reported under subsec14 tion (a) of this section shall be highly privileged in each 15 House. It shall be in order at any time after the third day 16 following the day on which such a bill or joint resolution is 17 reported to move to proceed to its consideration (even 18 though a previous motion to the same effect has been dis19 agreed to). Such a motion shall be highly privileged and 20 shall not be debatable. An amendment to the motion shall not be in order, and it shall not be in order to move to re22 consider the vote by which the motion is agreed to or dis23 agreed to.

(2) Debate on such bill or joint resolution, and all

25 amendments thereto, shall not exceed five consecutive calen

1 dar days, which shall be divided equally between those 2 favoring and those opposing the bill or joint resolution. Once 3 debate on such bill or joint resolution has begun, no other 4 measure or matter may be considered by that House. A 5 motion to recommit the bill or joint resolution shall not be 6 in order, and it shall not be in order to move to reconsider 7 the vote by which the bill or joint resolution is agreed to or 8 disagreed to.

9 (3) Motions to postpone, made with respect to the 10 consideration of such a bill or joint resolution and motions 11 to proceed to the consideration of other business, shall be 12 decided without debate.

(4) Appeals from the decisions of the Chair relating to 14 the application of the rules of the Senate or the House of 15 Representatives, as the case may be, to the procedure relat16 ing to such a bill or joint resolution shall be decided without 17 debate.

(c) If, prior to the passage by a first House of Congress 19 of any such bill or joint resolution of that House, such House 20 receives from the second House such a bill or joint resolu

21 tion, then the following procedure applies:

(1) Such bill or joint resolution received from the

second House shall be reported to the first House not

later than three days after being received.

(2) On any vote on final passage of such a bill or

joint resolution of the first House, such a bill or joint resolution of the second House shall be automatically

substituted for the bill or joint resolution of the first House.

5 (d) If the amount specified in such a bill or joint reso6 lution with respect to a fiscal year agreed to by the Senate 7 and House of Representatives is not the same, conferees on

the part of the Senate and the House of Representatives 9 shall be appointed not later than two days after the House 10 of Congress passing the bill or joint resolution last passés 11 such bill or joint resolution, unless within those two day's 12 both Houses of Congress agree upon the same total amount 13 of outlays of the United States Government with respect to 14 such fiscal year without the convening of a committee of 15 conference. Upon appointment of conferees, the committee 16 of conference shall meet immediately to resolve their differ17 ences. The provisions of subsection (b) shall be applicable 18 with respect to the consideration of any report of a com19 mittee of conference on any such bill or joint resolution.

(e) Except as otherwise provided in section 6 of this 21 Act, upon the enactment of such a bill or joint resolution: 22 establishing the total amount of outlays of the United States 23 Government with respect to such fiscal year, the total amount: so established shall be effective for such fiscal year.

(f) Except as otherwise provided in section 6 of this

1 Act, if there has not been enacted into law, within forty2 five days of continuous session of Congress after the budget 3 with respect to such fiscal year has been transmitted to Con

4

gress, a bill or joint resolution establishing the total amount 5 of outlays pursuant to this section, then the total of the budget 6 outlays set forth in the budget shall constitute the total 7 amount of outlays with respect to such fiscal year. The con

8

tinuity of a session of Congress is broken only by the ad9 journment of that session until the next regular or special 10 session of Congress, and the days on which either House is 11 not in session because of an adjournment of more than three 12 days to a day certain are excluded in the computation of the 13 forty-five-day period.

14 ENACTMENT OF GENERAL APPROPRIATIONS AND OUTLAYS

MEASURE

SEC. 5. (a) There shall be reported from the Committees

on Appropriations of the House of Representatives and the 18 Senate, in any form as such committees may determine, only 19 one general appropriations measure with respect to a fiscal 20 year (other than a measure reported, after such general 21 appropriations measure has been enacted into law, making 22 deficiency, supplemental, or emergency appropriations for 23 such fiscal year). That general appropriations measure so 24 reported

(1) shall specify for each activity, program, or

project of the United States Government, excepting those with permanent appropriations, the amount of new

budget authority (including new contract authority)

available for obligation during the next fiscal year and shall specify whether and for how long such authority shall remain available if not obligated during such year;

(2) notwithstanding any other provision of law, shall specify for each activity, program, or project of the United States through which budget authority has

been provided through contract authority the amount of

such unobligated authority which shall be available for obligation with respect to such fiscal year;

(3) notwithstanding any other provision of law, shall 14 specify the amount of budget authority previously provided 15 for through the State and local Financial Assistance Trust 16 Fund which shall be available for obligation with respect 17 to such fiscal year;

18 (4) shall specify, for each activity, program, or project 19 of the United States Government (including outlays for the 20 payment of contracts and outlays from trust funds, and 21 whether or not an appropriation is required for such activity, 22 program, or project) the total amount of outlays that may 23 be made with respect to such activity, program, or project 24 for such fiscal year including estimated or projected outlays 25 for those activities, programs, or projects for which legal
