The NASA Procurement Regulation (NPR) (NHB 5100.2) prohibits the use of this clause in all fixed price type contracts except Research and Development contracts, and then only when ALL of the following conditions are present:

1) the total fixed-price of the contract is $1,000,000 or more;

2) the period of performance under the contract is in excess of twelve months or the period of performance overlaps the succeeding fiscal year; 3) funds are not available to fund the total fixed-price of the contract at the time of entering into the contract; and

4) initial funding of the contract is not less that fifty percent of the total fixed-price.

The NPR does not authorize the use of this clause in construction or A&E contracts
