Before a general court-martial which convened at Vera Cruz, Mexico, November 2, 1914, pursuant to Special Orders, No. 134, United States Expeditionary Forces, Vera Cruz, October 27, 1914, and of which Maj. EDWARD M. LEWIS, 19th Infantry, was president, and Capt. ARTHUR W. BROWN, acting judge advocate, was judge advocate, was arraigned and tried

Second Lieut. John O'Keefe Taussig, 7th Infantry.

CHARGE I.-Conduct unbecoming an officer and a gentleman, in violation of the 61st Article of War."

Specification 1.-"In that Second Lieutenant John O'Keefe Taussig, Seventh U. S. Infantry, having made in compliance with orders a memorandum record of his work, study and absences with hours thereof for October 1, 2, 3, 5, 6 and 7, 1914, in words and figures as follows:

did with intent to deceive submit said record to his company commander, Captain G. S. Turner, 7th U. S. Infantry, well knowing that such record was incorrect in that he, Lieutenant Taussig, had not on October 1, 5, 6 and 7, 1914, or on any one of such dates studied the subjects under them, respectively, either during the time indicated by him or during any other time. This at Vera Cruz, Mexico, on October 8, 1914."

Specification 2.-"In that Second Lieutenant John O'Keefe Taussig, Seventh U. S. Infantry, having made in compliance with orders and submitted to his company commander, Captain G. S. Turner, Seventh U. S. Infantry, a memorandum record of his, Taussig's work, study and absences, with hours thereof, for October 1, 2, 3, 5, 6 and 7, 1914, in words and figures as follows:

did, at the time the memorandum was submitted, with intent to deceive, knowingly and falsely state in effect to the said Captain Turner that it was a correct record as to the dates October 1, 5, 6 and 7, 1914, saving a possible error of one half hour in the hours stated therein; which statement was false in that the memorandum was, as to such dates, not a correct record in that Lieutenant Taussig had not on October 1, 5, 6 and 7, 1914, or on any one of such dates, studied the subjects shown under them, respectively, either during the time indicated by him or during any other time. This at Vera Cruz, Mexico, on or about October 8, 1914."

Specification 3.-"In that Second Lieutenant John O'Keefe Taussig, Seventh U. S. Infantry, having reported to his company commander, Captain G. S. Turner, Seventh U. S. Infantry, that he, Taussig, had in compliance with orders studied Spanish for certain periods on October 5, 6 and 7, 1914, and having been called upon by the said Captain Turner for an explanation as to the method employed by him, Taussig, in studying Spanish during such periods, did thereupon, with intent to deceive, willfully and falsely state in effect to the said Captain Turner that he, Taussig, made use of a dictionary, which statement was false in that he did not make use of a dictionary in studying Spanish on such dates or on any one of them. This at Vera Cruz, Mexico, on October 8, 1914."

CHARGE II. "Conduct to the prejudice of good order and military discipline, in violation of the 62d Article of War." Specification 1.—“In that Second Lieutenant John O'Keefe Taussig, Seventh U. S. Infantry, being required by the orders of his regimental commander and of his company commander to devote one hour daily except Saturdays and Sundays to the study of one of certain designated military subjects, did willfully fail to obey such orders on October 1, 5, 6 and 7, 1914. This at Vera Cruz, Mexico."

Specification 2.-"In that Second Lieutenant John O'Keefe Taussig, Seventh U. S. Infantry, being required by the orders of his regimental commander to devote one hour daily five

days a week to the study of Spanish, did willfully fail to obey such orders. This at Vera Cruz, Mexico, during the week October 4-10, inclusive, 1914."

To all of which charges and specifications the accused pleaded "Not Guilty."

FINDINGS.

Of Specification 1, Charge I, "Guilty, excepting the words 'either during the time indicated by him or during any other time' substituting therefor the words 'during the time indicated by him or during approximately that time'; of the excepted words Not Guilty and of the substituted words Guilty."

Of Specification 2, Charge I, "Guilty, excepting the words 'either during the time indicated by him or during any other time' substituting therefor the words 'during the time indicated by him or during approximately that time'; of the excepted words Not Guilty and of the substituted words Guilty."

Of Specification 3, Charge I, "Not Guilty."

Of Charge I, “Guilty."

Of Specification 1, Charge II, "Not Guilty."

Of Specification 2, Charge II, "Not Guilty."
Of Charge II, "Not Guilty."

SENTENCE.

"To be dismissed the service of the United States." The sentence having been approved by the convening authority and the record of trial forwarded for the action of the President under the 106th Article of War, the following are his orders thereon:

THE WHITE HOUSE, Washington, 25 March, 1915.

In the case of Second Lieutenant John O'Keefe Taussig, Seventh Infantry, as the allegations upon which the charges are based are not, in my opinion, proved beyond a reasonable doubt, I withhold approval of the sentence and direct that he be released from arrest and returned to duty.

Before a general court-martial which convened at El Paso, Tex., November 23, 1914, pursuant to Special Orders, No. 228, Southern Department, November 14, 1914, and of which Col. GEORGE H. MORGAN, 15th Cavalry, was president, and Maj. JOHN L. HINES, 6th Infantry, judge advocate, was arraigned and tried

First Lieut. Marr O'Connor, 14th Cavalry.

CHARGE. "Conduct unbecoming an officer and a gentleman, in violation of the 61st Article of War."

Four specifications.

To which charge and all specifications the accused pleaded "Not Guilty."

FINDINGS.

Of the 1st Specification of the Charge, "Not Guilty." Of the 2d, 3d, and 4th Specifications and of the Charge, "Guilty."

SENTENCE.

"To be dismissed the service of the United States."

The sentence having been approved by the convening authority and the record of trial forwarded for the action of the President under the 106th Article of War, the following are his orders thereon:

THE WHITE HOUSE,
24 March, 1915.

The sentence of dismissal imposed by the general courtmartial in the foregoing case of First Lieutenant Marr O'Connor, 14th Cavalry, is hereby confirmed and will be carried into execution.

WOODROW WILSON.

First Lieut. Marr O'Connor, 14th Cavalry, ceases to be an officer of the Army from March 27, 1915.
