ACT 34.

AN ACT to amend Section 3 of Act 184, of the Acts of

1903.

SECTION

I.

Amends Section 3, of Act 184, of General Assembly of 1903.
Relates to three-mile law of Ashdown, Little River
County.

Act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. Section three (3) of Act 184 of the Acts of 1903 shall be amended so as to read as follows: "Section 3. It shall be the duty of all sheriffs, deputy sheriffs, constables, deputy constables, marshals, deputy marshals, mayors, justices of the peace, living or residing within the territory described in section I of this Act, to arrest, or cause to be arrested, and brought to trial, all persons violating the provisions of this Act, and any such officer having information or knowing of the violation of this Act, who shall fail or refuse to arrest, or cause to be arrested, and brought to trial the person violating the same, he shall be deemed guilty of a misdemeanor, and upon conviction thereof, be fined in any sum not less than fifty dollars."

SECTION 2. That this Act shall take effect and be in force from and after its passage.

ACT 35.

AN ACT to encourage the study of Arkansas History, and to promote the spirit of patriotism in the public schools of Arkansas.

SECTION

Birthday of Robert E. Lee, January 19, to be observed in all public schools of Arkansas.

Superintendent of Public Instruction to prepare a program of exercises annually for the public schools of the State.

3. Duty of county examiners, superintendents and principals of public schools to aid in the work.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the 19th of January, the birthday of Robert Edward Lee, shall be observed in all the public schools of this State as a day for patriotic exercises and the study of the history and achievements of Arkansas men.

SECTION 2. The State Superintendent of Public Instruction is hereby authorized to prepare and publish annually for use in all the schools of the State, a program of exercises, dealing with events in the life of General Lee and other distinguished Southern men, giving attention also to the achievements and work of eminent men who have served this State in civil and military life.

SECTION 3. It shall be the duty of county examiners, city superintendents, and principals of schools to aid in carrying on this work, and they shall arrange the

exercises of their various schools in accordance with the provisions of this Act.

SECTION 4. This Act shall be in force and effect from

AN ACT to amend Section 6681 of Kirby's Digest of the Statutes of Arkansas.

SECTION

I. Grade to be established by railroads at crossings; bridges may be built in certain cases.

Laws in conflict repealed; Act takes effect from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. Whenever any railroad company, or corporation, has constructed, or shall hereafter construct, a railroad across any public road or highway or street in any incorporated city or town of this State now established or hereafter to be established, or where any public road or highway or street in any incorporated city or town hereafter established shall cross any railroad now established, such railroad company, or corporation, shall be required to so construct such railroad crossing, or so alter or construct roadbed of such public road or highway or street in any incorporated town or city, that the approaches to the [rail] roadbed on either side shall be made and kept at no greater elevation or depression than one perpendicular foot for every ten feet of horizontal distance, such elevation or

depression being caused by reason of the construction of said railroad; provided, at any crossing of any public highway or street in any incorporated city or town, such railroad may be crossed by a good and safe bridge to be built and maintained in good repair by the railroad company, or corporation, owning or operating such road.

SECTION 2. That all laws and parts of laws in conflict with this Act be and the same are hereby repealed, and this Act take effect and be in force from and after its passage.

ACT 37.

AN ACT to amend Section 3620 of Kirby's Digest.

SECTION

1. Relates to the transportation of wild fowls, fish or game from the State; penalty for violation.

2. Laws in conflict repealed; Act in effect from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. It shall be unlawful for any person, or persons, or corporation, to ship, export or carry beyond the lines of this State, any deer, turkey, wild fowl, game fish, or game of any description, and any railroad company, express company, corporation, or individual who shall ship, export, or carry, or receive for shipment, or export, or carry beyond the State line of Arkansas, any game fish, deer, turkey, or game of any kind, except rabbits, shall be deemed guilty of a misdemeanor, and

upon conviction shall be fined in a sum not less than one hundred dollars, nor more than five hundred dollars for each separate offense. Provided, That rabbits shall be shipped in bunches or open crates, and at all times open to inspection.

SECTION 2. That all laws and parts of laws in conflict herewith are hereby repealed, and this Act take effect and be in force from and after its passage.

ACT 38.

AN ACT to require the St. Louis and San Francisco Railroad Company to erect and maintain a depot at the town of Centerton, Benton County, Arkansas.

SECTION

I. St. Louis & San Francisco Railroad required to build a depot at Centerton, Benton County.

2.

An agent shall be kept at said depot during certain hours.

3. Failure to comply with this Act a misdemeanor and subject to a fine.

4.

Laws in conflict repealed; Act takes effect from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the St. Louis and San Francisco Railroad Company shall within thirty days after the passage of this Act, begin the erection of a depot at the town of Centerton, in Benton County, and shall complete the same within ninety days after the passage of this Act; said depot shall be kept open from 8 a. m. until 6 p. m.,
