Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That hereafter the road supervisor of Jackson County shall be entitled to three dollars ($3) per day for his services as road supervisor, whilst actually engaged in the discharge of his duties.

SECTION 2. Be it further enacted, That all Acts and parts of Acts in conflict with this Act be repealed, and that this Act take effect and be in force from and after its passage.

ACT 46.

AN ACT to authorize the incorporated town of Booneville, Arkansas, to make contribution to the public school funds of School District No. 65, in Logan County, Arkansas, known also as the Special School District of Booneville, Arkansas.

Laws in conflict repealed; Act takes effect from approval. Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the town council of the incorporated town of Booneville, Arkansas, is hereby authorized and empowered to appropriate and contribute out of any funds in the treasury of the said incorporated town of Booneville, Arkansas, from time to time, sums of money,

not to exceed $3,500 and interest thereon, to School District No. 65, in Logan County, Arkansas, known also as Special School District of Booneville, Arkansas, the said amounts to be applied to the payment of the indebtedness of said school district, now existing, contracted for the purpose of building and furnishing the school building in said district, the said indebtedness amounting to $3,500 and interest thereon, and said power of making appropriations and contributions by said town council to said school district to continue until said indebtedness and interest is paid.

SECTION 2.

That all laws and parts of laws in con

flict with this Act be, and the same are hereby repealed, and this Act shall be in force and effect from and after its passage and approval.

ACT 47.

AN ACT to amend Section 4129 of Kirby's Digest of Laws and Statutes of the State of Arkansas.

SECTION

I. Provides for an additional member of the Board of Trustees of the State Charitable Institutions.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That Section 4129 of Kirby's Digest of the Statutes of Arkansas be amended to read as follows: Section 4129. The Governor shall biennially appoint one board of trustees for the School for the Blind, the Deaf

Mute Institute, and the Insane Asylum, to be composed of seven members, one from each congressional district, who shall have charge of said institutions and discharge all the duties now required by law, and four members of said board shall constitute a quorum for the transaction of all business, and each member of said board shall receive the sum of $5 per day for every day in session, and five cents per mile for each mile traveled to and from the seat of government. Provided, That the seventh member of said board shall be appointed immediately upon passage of this Act, and his term of office shall expire simultaneously with that of the other six.

SECTION 2. That all laws and parts of laws in conflict herewith be, and the same are hereby repealed, and that this Act take effect and be in force from and after its passage.

ACT 48.

AN ACT to require the St. Louis, Iron Mountain and Southern Railway Company to keep and maintain a depot agent at Pottsville, a station on its line known as Galla, in Pope County, Arkansas.

SECTION

I.

Duty of the St. Louis, Iron Mountain and Southern Railway to keep an agent at Pottsville (Galla), Pope County.

2. Duties of the said railway company in relation to Galla station.

3. Penalty prescribed for failure to comply with the Act.

Whereas, The incorporated town of Pottsville, in Pope County, Arkansas, is located on the Little Rock and Fort Smith Division of the St. Louis, Iron Mountain and Southern Railway Company; and is a station on said line known as Galla, in Pope County, Arkansas, and is located about six miles west of the town of Atkins, and about six miles east from the town of Russellville, and does an annual business of about $60,000 a year, and,

Whereas, Said town has a population of about 225 inhabitants of prosperous and industrious people, with five general merchandise stores, which buy and ship about 1,500 bales of cotton each year, and one drug store, one wholesale mattress factory, one wholesale broom factory, one cotton gin, two grist mills, one blacksmith shop and wagon factory, three church houses for whites, and a high school with 125 pupils, and is surrounded by fertile and productive lands, and by a densely populated community, and,

Whereas, There is already a good and convenient depot and side track at said station, and,

Whereas, In the reconstruction of said road a few years ago, in consideration of certain changes in the streets and public roads, in and near said town, and the elevation of the track and other physical changes incurring inconveniences forborne by the citizens of said town and community, the division superintendent of said road agreed and promised to keep and maintain a depot agent at said town and community, and,

Whereas, Said railway company has failed, neglected and refused to keep a depot agent at said station, and,

Whereas, Notice has been published in a county paper in Pope County, near the point and place to be effected by this bill for thirty days next before the introduction of

this bill, of the intention to apply to this General Assembly for a local law in this behalf, as provided for by section twenty-six (26) article five (5) of the Constitution of this State, proof of which notice is hereby attached, Therefore,

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That hereafter it shall be the duty of the St. Louis, Iron Mountain and Southern Railway Company, or its assigns and successors, to keep and maintain a depot agent at the town of Pottsville, a station on its line known as Galla, in Pope County, Arkansas.

SECTION 2. That it shall be the duty of said railway company, its successors and assigns, to receive and receipt. for all property tendered to it in good condition for shipment, either by freight or express, from or to Pottsville, or Galla, in Pope County, Arkansas, and to receive and care for property, under the usual regulations of said railway company, all freight, express, and baggage shipped, expressed and checked to the said station of Galla. And to sell passenger tickets and check baggage to and from said station under the same rules, regulations, and liabilities as apply to other depot stations in this State.

SECTION 3. That should said St. Louis, Iron Mountain and Southern Railway Company, its successors and assigns, fail, refuse, neglect, or omit to comply with any of the provisions of this Act, it shall be liable to pay a penalty of not less than ten dollars ($10) nor more than twenty-five dollars ($25) for each separate breach and violation of duty or omission under any of the provisions of this Act, and each day any such breach or violation of duty, or violation of any of the provisions of this Act shall continue, shall be deemed and constitute a separate offense and violation of duty, for which the penalty shall apply
