district. The president of said levee board shall on the second Tuesday of May in each year, make a report to the Governor of this State, showing the lands confirmed to said levee district by the courts of chancery, as provided for in this Act and all other lands hereby conveyed, showing the disposition, if any, made of those lands during the preceding year, the funds realized and where and how expended. SECTION 33. Any member of the board of directors, or any person appointed by said board, may in case of the threatened danger, or urgent necessity, order out all, or as many as may be necessary, of the persons living within the levee district who are liable for road duty under existing laws, and cause them to work on the levees. For such emergency service all persons serving thereon shall be paid by the board, at such fate as may be fixed by said board. Any person subject to road duty, who being duly notified shall fail to attend and render immediate service, shall be guilty of a misdemeanor, and on conviction whereof before any justice of the peace of the county, shall be fined not less than five nor more than twenty dollars. SECTION 34. That it shall be unlawful for any hog, pig or shoat to run at large on levees in the Red River Levee District No. 1, and all parties owning or controlling hogs, pigs or shoats within two miles of the levee along the Arkansas River in said Red River Levee District No. 1, shall either keep said hogs, pigs or shoats within an enclosure, or put rings in their noses, one on each side of the nose, about one and one-half inches apart and fastened securely so as to prevent the falling out of said rings, and in such a manner as to prevent the hog, pig or shoat from rooting in or destroying the levee, and at any time hogs, pigs or shoats are found running at large and depredating on said levees without being ringed as aforesaid, the officers or agents of said levee board may impound, at the expense of the owner of said hogs, and if allowed to run at large a second time by the owners, then the officers or the agents of said levee board may kill or destroy said hog, pig or shoat without being liable therefor. SECTION 35. All parties allowing hogs, pigs or shoats to run at large are herein prohibited, shall upon conviction therefor be fined in any sum not less than one nor more than twenty-five dollars. SECTION 36. This Act take effect and be in force from and after its passage. AN ACT for the appropriation of ten hundred and seventytwo dollars and thirty-eight cents to pay the State's proportion of fees due assessors for the year 1904. SECTION 1. Appropriation to pay the State's proportion of fees due assessors for 1904. Be it enacted by the General Assembly of the State of Arkansas: SECTION I. That the sum of ten hundred and seventy-two dollars and thirty-eight cents ($1,072.38) be and the same is hereby appropriated out of any money in the treasury of the State of Arkansas, not otherwise appropriated, for the purpose of paying the State's proportion of assessors' fees for the year 1904. SECTION 2. This Act to be in force from and after its passage. Approved March 17, 1905. ACT 99. ✓ AN ACT to promote the efficiency of the Arkansas State Guard, and for other purposes. SECTION 1. Appropriation for maintenance of State guard. 2. How above sums may be drawn from the State treasury. 3. Laws in conflict repealed; Act in force from passage. Whereas, the strength of the Arkansas State Guard, shown by official roster, active force, aggregates 2,141 officers and men, and, Whereas, said forces are Arkansas' citizen soldiery, serving as volunteers without any pay from the State, as the regular enlisted, organized, and uniformed militia, at all times subject to call of lawful authority, and, Whereas, said organization has heretofore been recognized by the National Government, receiving therefrom all allotments, under section 1661, Revised Statutes as amended, or other laws, and, Whereas, it is essentially required of the organized militia, if same shall have further support of the National Government, that certain duties be actually performed according to the laws of Congress relating thereto, and, Whereas, in order to carry out the provisions of the Act of Congress, approved January 21, 1903, it is necessary that the State render financial aid to its citizen soldiery, therefore, Be it enacted by the General Assembly of the State of Arkansas: SECTION I.
