thereof, shall be deemed guilty of a felony and upon conviction thereof shall be punished by imprisonment in the penitentiary for not less than one nor more than five

years.

SECTION 22. That to the payment of both the principal and interest of the bonds to be issued under this Act the entire revenues of said Levee District No. 1, of Faulkner County, Arkansas, arising from any and all sources, is by this Act pledged; and the board of directors of said levee district is hereby required to set aside each year from the revenues collected from any source whatever a sufficient amount to secure and pay the interest on said bonds, and the bonds maturing that year.

SECTION 23. The said board of directors of Levee District No. 1, of Faulkner County, Arkansas, hereby created, shall and are hereby declared to be the legal successors of the now existing Levee District No. 1, of Faulkner County, Arkansas, created by the County Court of Falkner County, Arkansas, and all books, papers, proceedings and contracts of the now existing Levee District No. 1, of Faulkner County, Arkansas, established by the order of the County Court of Faulkner County, Arkansas, shall become a part of the hooks, papers, proceedings and contracts of the board of directors of Levee District No. 1, of Faulkner County, Arkansas, hereby created, and shall be delivered to same upon the organization of said board of directors. The board of directors hereby created shall become the owners of all properties, works, contracts and rights belonging to the board of directors of Faulkner County, Arkansas, now existing under the order of said county court, and shall assume the performance and payment of all contracts and obligations and liabilities of said board of directors of Levee District No. 1, of Faulkner County, Arkansas, created by order of said county court; and shall repay to

any landowner in said levee district any assessment or part thereof advanced or paid by such landowner to the board of directors of the now existing levee district, so created by said order of said county court.

SECTION 24. That all laws and parts of laws in conflict with this Act be and the same are hereby repealed, and that this Act take effect and be in force from and after its passage.

[This bill having remained with the Governor five days (Sunday excepted) and the General Assembly being in session, it has become a law this February 6, 1905.]

AN ACT to legalize Fencing District No. 4, in Independence County, and to provide for the impounding of stock, and the collection of assessments on real estate and for other purposes.

SECTION

I. Legalizes Fencing District No. 4, Independence County,

Names board of directors. Officers of board; secretary to keep a record of proceedings.

4. Property owners to hold election for directors on second Monday in August, 1906, and every two years thereafter; to vote upon rate of taxation for district purposes, etc.

5. County collector and treasurer to receive commission for handling the funds of the district.

6. Vacancies in the board may be filled by the county judge.

Unlawful for any kind of stock to run at large in fencing district.

8. Public pounds for stock and poundkeeper to be provided.

9. Poundkeeper shall take an oath of office and allowed compensation, to be fixed by the board.

10. Interfering with duties of poundkeeper a misdemeanor.

Certain offenses named are termed misdemeanors.

Good gates to be maintained.

13. After gates have been approved, stock running at large in the enclosure may be impounded.

14. Laws in conflict repealed; Act in force from passage.

Whereas, A petition signed by more than two-thirds of the landowners who were of full age, and the guardians of those who were minors and landowners of certain territory in Independence County, hereinafter described in this Act, was presented to the County Court of Independence County at the October, 1902, term of said court, praying for the establishment of a fencing district, and said court by an order made at said term upon said petition, establishing a fencing district in said county, embracing said territory, to be known and designated as "Fencing District No. 4, of Independence County," and

Whereas, The board of directors of said district, duly appointed heretofore by said court, are causing said district to be enclosed by a fence of the manner and kind designated as a lawful fence by the Statutes of Arkansas, said fence being partly of posts and wire, and posts, plank, and wire, and posts, rails and wire, and of rails alone, commonly known as worm fence, and also partly of stone, all of the required height and specifications as is required by law. Except, however, that the portion of said

district which fronts on White River is not enclosed on the river side by any fence, the river itself, and the banks thereof, forming a sufficient barrier to prevent the entrance of stock to said district on that side, therefore,

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the establishing of said Fencing District No. 4, in Independence County, by order of the county court of said county, as aforesaid, and the enclosing and fencing of said district in the manner as described aforesaid in the preamble to this Act, be, and the same is, hereby declared lawful for all purposes.

SECTION 2. The boundaries of said district shall be as follows: Beginning at a point 1,550 links east of corner on west boundary line of sections 6 and 7 in township 12 north, range 5 west, thence north 75 degrees, east 2,850 links, thence south 87 degrees, east 1,633 links, thence north 10 degrees, east 150 links, thence north 21 degrees, west 1,200 links, thence. north 28 degrees, west 700 links, thence north 21 degrees, west 550 links, thence north 81⁄2 degrees, east 1,800 links, thence north 10% degrees, west 700 links, thence north 25 degrees, west 900 links, thence north 40 degrees, east 600 links to bank of White River, this being a part of the west line of said district.
