authorized to have said printing done at an expense not to exceed one dollar and fifty cents for each one hundred names on said list. The fees of the county clerk for all services to be rendered by him in filing, recording and furnishing to the election commissioners a certified copy of said list shall be ten cents for each one hundred words contained in said list and the certified copy so furnished to said commissioners.

SECTION 2. That all laws in conflict herewith are hereby repealed, and this Act shall take effect from and after its passage.

ACT 266.

AN ACT to fix the rate of taxation for general State purposes, and to amend Section 6888 of Kirby's Digest.

SECTION

I. Amends Section 6888 of Kirby's Digest relating to levy of taxes.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION 1. That section 6888 of Kirby's Digest of the laws of Arkansas be, and the same is hereby amended to read as follows:

For defraying the general expenses of the State government, including the charitable institutions of the State, and to supply deficiencies, there shall be levied for each fiscal year, beginning on the first Monday in February, 1905, one and three-fourths mills on the dollar. For the

support of common schools, two mills on the dollar. There shall also be levied annually one dollar per capita on every male inhabitant of the State, over twenty-one years of age, for common school purposes. Provided, This Act shall not be construed to affect the levies provided for in sections 5962, 6493, 242, and that provided for a capital fund by the Act of April 29, 1901.

SECTION 2. Be it further enacted, That this Act take effect and be in force from and after its passage, and that all laws in conflict herewith be and the same are hereby repealed.

AN ACT to authorize Mineral Springs Special School District, Howard County, Arkansas, to mortgage its property, and for other purposes.

SECTION

I. Mineral Springs Special School District authorized to borrow money and mortgage school property.

Mortgage to be in form as other like instruments.

3. Rights of the school district in law or equity.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the Board of Directors of Mineral Springs Special School District, situated in Howard County, Arkansas, be and the same is hereby authorized and empowered, for the purpose of borrowing money to build and equip Mineral Springs high school building, to mortgage

any part, or all, of the real property of said district, and to issue bonds, notes or other evidences of indebtedness, not to exceed in amount the sum of ten thousand dollars. ($10,000), under such conditions as to time and manner of payments as the said board of directors of said district may prescribe. And said board of directors is further empowered to pledge or use one mill of the levy of taxes. annually of said district for the purpose of paying or of creating a sinking fund for the payment of the money borrowed, with interest, for building or equipment purposes, as herein provided.

SECTION 2. That said mortgage of real property shall be in form in all respects as are other instruments of like kind, and shall be construed and held to have the same force and effect as though it had been the act of an individual, and against said instrument said district shall be allowed no defense by virtue of its capacity as a school district, nor be allowed any defense in law or equity not accorded to individuals.

SECTION 3. That nothing in this Act shall be so construed as to prevent or cut off from said school district any rights in law or equity which as a real person it might claim, but in every action by or against said district under this Act, it shall be deemed and treated, so far as may be practicable, as a real person.

SECTION 4.

That this Act take effect and be in force

from and after its passage.

Amends Section 1 of Act of April 13, 1905, relating to coal and other mining corporations operating railways.

Laws in conflict repealed; Act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION 1. That section one (1) of an Act approved April 13, 1905, entitled "An Act to authorize coal and other mining corporations to construct and operate short connecting lines of railway or tramway, and granting to them the right of eminent domain in condemnation suits," be amended to read as follows, towit: Section 1. That all persons owning or controlling, by lease or purchase, any copper, lead, zinc, iron, marble, stone, rock, granite, slate, coal or other mineral lands in this State, shall have the same right to incorporate, own, construct and operate such short lines of railway or tramway as may be necessary to the successful mining, quarrying and marketing of said coal, marble, stone, rock, granite, slate and other mineral.

SECTION 2. That all laws and parts of laws in conflict with this Act be, and the same are hereby repealed, and this Act shall be in full force and effect from and after its passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That section 5745 of Kirby's Digest of the laws of Arkansas be amended so as to read as follows: Section 5745. The powers and authority of notaries public shall be co-extensive with the State for the purpose of swearing witnesses, taking affidavits and depositions, and taking acknowledgments of deeds and other instruments in writing and authorized by law to be acknowledged.

SECTION 2. That this Act take effect and be in force from and after its passage.
