liquors, or intoxicating spirits of any character whatever, which are used and drunk as a beverage, including native wine, within five miles of the University of Arkansas, at Fayetteville, in the State of Arkansas.

SECTION 2. That whoever violates this law shall be fined in the sum of not less than fifty dollars, nor more than two hundred dollars.

SECTION 3. That this Act take effect and be in force from and after its passage.

ACT 275.

AN ACT to amend Section 5655 of Kirby's Digest.

SECTION

I.

Amends Section 5655 of Kirby's Digest, relating to formation of new wards in cities.

2. Laws in confiict repealed; Act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That section 5655 of Kirby's Digest of the statutes of Arkansas be amended so as to read as follows: "All aldermen elected in such city previous to such division shall give place to such new aldermen at the time for the organization of the new council, as above provided, and from that date the terms of office of all such previously elected aldermen shall cease and determine. Provided, however, That it shall be lawful to form one ward out of parts of one or more wards without affecting the terms of office of the then aldermen of the city. And when that is done

and the boundaries of other wards are not changed, the terms of office of the aldermen of the wards not changed shall not be affected, and the aldermen of the ward or wards from which territory is taken to form a new ward shall be and remain the aldermen of the remaining part of said old ward or wards," and new aldermen shall be elected only for the new ward or wards actually formed out of territory of old wards.

SECTION 2. That all laws or parts of laws in conflict herewith are hereby repealed, and this Act shall take effect and be in force from and after its passage.

AN ACT to amend Section 4156 of Kirby's Digest.

SECTION

I.

Amends Section 4156 of Kirby's Digest, relating to beneficiaries of the Deaf Mute Institute. Extends time to thirteen years.

Laws in conflict repealed; Act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That section 4156 of Kirby's Digest be amended so as to read as follows: Any deaf mute who may be admitted into the institute and supported as a beneficiary at the expense of the State, shall be permitted to remain in said institute for thirteen years, unless, in the judgment of the trustees, he or she shall be sooner discharged.

SECTION 2. That all laws and parts of laws in conflict with this Act are hereby repealed, and this Act be in force from and after its passage.

ACT 277.

AN ACT to require the Iron Mountain Railroad Company to erect and maintain a suitable depot at White Hall, Poinsett County, Arkansas.

SECTION

1. Requires Iron Mountain Railway to erect and maintain a depot at Whitehall, Poinsett County.

Failure to comply with Act within six months subject to fine.

Act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the St. Louis and Iron Mountain Railroad Company be, and they are hereby required to erect and maintain a good and suitable depot at White Hall, Poinsett County, Arkansas. Said depot shall be erected within six months after the passage of this Act.

SECTION 2. That each day's failure to comply with this Act, after six months have expired after the passage of this Act, shall be a separate offense under this Act. Upon any violation of this Act, the said railroad company shall be fined not less than fifty dollars, nor more than one hundred dollars.

SECTION 3. This Act shall take effect and be in force from and after its passage.

AN ACT to amend Section 6382 of Kirby's Digest.

SECTION

I.

Amends Section 6382 of Kirby's Digest. Cocaine may not be sold or given away except upon written prescription of physician or druggist; penalty for violation of Act.

Acts in conflict repealed; Act in force thirty days after passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION 1. That section 6382 of Kirby's Digest be and is hereby amended to read as follows: No person shall sell or give away cocaine or any of its salts, or any preparation or mixture thereof, to anyone except upon a written prescription of a physician or dentist, licensed under the laws of the State. No prescription containing cocaine shall be filled more than once, and each prescription shall have written plainly upon it the name and address of the patient, and shall be filed and preserved by the pharmacist, who shall not give a copy thereof to anyone.

This section shall not be so construed to apply to sales in original packages by manufacturers or dealers, to any druggist, physician or dentist licensed under the laws of this State. Any person who shall sell or give away any of the articles mentioned in this section in violation thereof, and any person who shall prescribe any such articles to anyone addicted to the habitual use of cocaine or any preparation or compound thereof, in any form, shall be punished by a fine of not less than $25, nor more than $100, or by imprisonment in the county jail for not less than thirty (30) days nor more than ninety (90) days, and if the person so offending shall be a licensed physician, dentist or pharmacist, in addition to the penalty above set forth,

such offender's license shall be revoked upon conviction. Upon complaint being made of a violation of the provisions of this section, the prosecuting attorney of the county wherein the offense is alleged to have been committed shall prosecute such complaints, and to that end shall be authorized to examine the books and files of any dealer within the State for the purpose of tracing the sales of any of the articles herein mentioned.

SECTION 2. All Acts and parts of Acts in conflict with this Act are hereby repealed, and this Act shall take effect and be in force from and after thirty days after its passage.

AN ACT to legalize and validate all the acts, writs, process, executions, certificates, filings and other official acts of any of the Clerks of the Circuit Courts, ExOfficio Recorder and Clerks of the Chancery Courts, and of the County and Probate Courts of Benton County, Arkansas, which acts, writs, process, executions, certificates, filings and other acts were done and performed in the name of any person, such Clerks or Recorders by any person other than the Clerks or their legally appointed and acting deputies.

SECTION

I. Certain Acts, writs, etc., of clerks of various courts done by others than the said clerks made legel and valid.
