shall each pay $150 per annum, that one-half of the apportionment allotted to each of said counties shall be paid at each regular term of said court therein as now prescribed by law as other circuit court expenses.

SECTION 3. That it shall be the duty of said stenographer to correctly take down in shorthand all evidence, [motions], exceptions and other matters in every criminal case pending in the courts of said circuit and to correctly and promptly transcribe the same in typewritten form whenever called upon by the attorney for either side of any criminal case. When notified to do so, transcribe same, which transcribed evidence and notes shall be included in the transcript of the circuit clerk upon appeal to the supreme court without charge therefor; that when not engaged in attending a criminal trial in progress said stenographer shall be at the disposal of the court or prosecuting attorney for the purpose of all criminal matters existing or pertaining to any of the departments of said court.

SECTION 4. That said stenographer shall subscribe to the same oath as now prescribed by law for all other officers of the State.

SECTION 5. That all laws and parts of laws in conflict herewith be and the same are hereby repealed and that this Act take effect and be in force from and after its passage.

PRIVATE ACT 1.

AN ACT for the relief of J. N. B. Schuler.

SECTION

I.

Appropriates $48 to pay J. N. B. Schuler.

2. Act in force from passage.

Whereas, The said J. N. B. Schuler was entitled to the sum of forty-eight dollars ($48) by reason of being a legal pensioner of the Confederate pension fund of the State of Arkansas, and

Whereas, The said J. N. B. Schuler failed to receive the sum allowed him by law on account of the clerk of his county failing to certify to the State Auditor his residence as required by law, therefore,

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I.

That the sum of forty-eight dollars ($48) be and the same is hereby appropriated out of any moneys in the State treasury not otherwise appropriated to pay J. N. B. Schuler for amount due him as a Confederate pensioner

for the year 1904.

SECTION 2. That this Act take effect and be in force from and after its passage.

PRIVATE ACT 2.

AN ACT to appropriate money to pay reward to J. L. Garrett.

SECTION

Garrett.

Whereas, Sometime during the year 1900, one Elias Powell, killed one James Gardner in the county of Miller, and on June 22, 1900, Hon. Dan W. Jones, then Governor of Arkansas, offered a reward of $100 and on May 7, 1901, Hon. Jeff Davis, Governor of Arkansas, issued his proclamation revoking all rewards offered prior to January 18, 1901, and

Whereas, James L. Garrett, marshal of the town of Augusta, did on October 24, 1904, arrest and turn over the said Elias Powell to J. T. Dillard, sheriff of the county of Miller, and since that time the said Powell has been tried and convicted, and is now under sentence to be hung January 31, 1905. Therefore,

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the Auditor of the State is hereby authorized and directed to draw a warrant on the Treasurer of Arkansas for the sum of $100 in favor of J. L. Garrett to pay him the reward offered for the arrest of Elias Powell. The said sum of money is hereby appropriated out of any money in the State treasury not otherwise appropriated.

SECTION 2. This Act to take effect and be enforced from and after its passage.

PRIVATE ACT 3.

AN ACT for the relief of Daniel Gimlin.

SECTION

1. Appropriates $48 to pay Daniel Gimlin.

2.

Auditor authorized to draw warrant for the above amount.

3. Act in force from passage.

Be it enacted by the General Assembly of the State of Arkansas:

SECTION I. That the sum of $48 is hereby appropriated out of any money in the State treasury, not otherwise appropriated, to pay Daniel Gimlin, a Confederate pensioner, his pension for the year 1904.

SECTION 2. The Auditor of this State is hereby ordered to issue his warrant on the treasury for $48.

SECTION 3. All laws in conflict herewith are hereby repealed and this Act take effect from and after passage.

PRIVATE ACT 4.

AN ACT to provide additional and reasonable compensation for William F. Kirby for service rendered in making the Digest of the Statutes of Arkansas for 1904, and also for W. W. Mansfield as examiner of said Digest.

SECTION

Appropriates $1,500 to pay Wm. F. Kirby; $166.66 2-3 to pay Judge W. W. Mansfield.
