construction will consist of joisted wood construction supported on steel girders and wood posts, with six skylights, each approximately 6 ft. by 10 ft, in area; that there will be no cellar other than a boiler room approximately 12 ft. by 25 ft. in area enclosed in brick walls with fireproof arch construction in the floor above; that there will be four non-fireproof windows and two doorways in the rear wall facing on the adjoining vacant property on 139th street, under the same ownership; and WHEREAS, the decision of the fire commissioner, upon which the appeal is based, is in the form of an objection to the alteration application, and reads in part as follows:

"***, sprinkler system necessary as floor area exceeds 7,500 sq. ft. and roof is of non-fireproof construction."

Resolved, that the appeal be and it hereby is granted to permit the omission of a sprinkler system in a onestory non-fireproof garage approximately 9,700 sq. ft. in

area.

WHEREAS, Otto L. Spannhake, architect, on behalf of Morris Cohen, owner, filed, August 2, 1917, with the board of appeals, an appeal from a decision of the fire commissioner requiring additional means of exit in a stable and garage being altered into a public garage, at premises 306-308 West 117th street, south side 100 ft. west of Eighth avenue, Manhattan; and

WHEREAS, it appears that an application known as "Alt. No. 851-17" was filed in the bureau of fire prevention July 19, 1917, to alter and convert into a single public garage two adjoining three-story non-fireproof buildings 25 ft. by 100 ft. in area each, No. 306 being occupied as a stable and No. 308 having been recently converted from a stable into a garage by covering the floors and ceilings with fire-retarding material; that the proposed alteration consists of covering the floors and ceilings of No. 306 with fire-retarding material enclosing the existing stairs with fire-retarding partitions, extending the existing stairs to the roof, removing the brick wall dividing the two buildings, supporting the floor beams by columns and girders; that the removal of the brick wall will eliminate a horizontal exit; that the only additional means of egress besides the stairs previously mentioned will consist of a fire escape on the front of No. 308 consisting of balconies at the second and third stories and at the roof level connected by 45-degree stairs with counterbalanced stairs from the second story balcony to the ground, egress to the fire escape in each story being by means of fire doors at the floor level; and

WHEREAS, the decision of the fire commissioner, dated July 30, 1917, from which the appeal is taken is in the form of an objection to the application and reads:

"3. Provide approved additional means of exit i accordance with article 8, chapter 5, code of ord nances.";

Resolved, that the appeal to accept the existin stairs enclosed in fire-retarding partitions and extende to the roof and a fire escape on the front, as satisfactor means of egress, be and it hereby is granted. Adopted, October 9, 1917.

Welstead and Hugh Cavanagh, owners, file August 3, 1917, with the board of appeals, an appe from a decision of the superintendent of buildings, r fusing to accept the existing stairway enclosed in fir resisting partitions and a new fire escape, as satisfacto means of egress in a building being converted from tenement to a business building, at premises 462 Four avenue, northwest corner 31st street, Manhattan; and WHEREAS, it appears that an application to alter, "A 1391-17", was filed in the bureau of buildings to alter a convert an existing four-story non-fireproof teneme building with stores in the first story, approximately ft. by 79 ft. in area in the first story and 22 ft. by 56 in the upper stories, into a business building with stor in the first story; that the height of the building is a proximately 46 ft. above the curb; that the proposed e facilities of the building as altered will consist of (a) An existing stairway, 2 ft. 8 in. wide, containi winders, extending from the first story to the roof. closed in approved fire-resisting partitions with fire doo at the openings therein, with egress to 31st street in t first story through a hallway similarly enclosed, and

(b) A new fire escape to be located on the 31st str front approximately 12 ft. from the Fourth avenue fro to consist of balconies at the existing window sill levels ft. wide protected by railings 5 ft. high, at each sto above the first connected by 45-degree stairs 22 in. wi with counterbalanced stairs from the second story b cony to the street and all openings leading to balcon protected with double-hung automatic fire windows; have not more than fifty persons engaged above the f story at any one time; and

WHEREAS, the decision of the superintendent of bu ings, dated July 27, 1917, from which the appeal is tak is in the form of an objection to the application, a reads:

"Occupancy of building has been changed. E facilities must conform to article 8. Stairs should at least 3 ft. 8 in. wide."

Resolved, that the appeal, to accept the existing w stairway. 2 ft. 8 in. wide, enclosed in fire-resisting pa tions. and a new fire escape on the 31st street front. satisfactory means of egress, be and it hereby is gran as a modification of the law, considering the small a of the building, on condition that not more than five sons be employed at manufacturing in the building.
