THE Author begs to express his grateful sense of the favourable reception with which the first Edition of this Treatise has been honoured, and to state that he has spared no pains to render the Work equally acceptable to the Profession in its present form.

THE circumstance of this Treatise having been ably edited in America, has led to the introduction of some few American cases into the present Edition. This, it is hoped, will be considered an improvement; but, at all events, the innovation seems justified by the opinion of one of our most eminent Judges, who has characterized those authorities as being "intrinsically entitled to the highest respect (a)," although they may not serve as a direct foundation for legal proceedings in England.
