In inflicting the punishment of death by hanging, Underan Under-sheriff, duly appointed and qualified, shall infict death have the same power and authority as the Sheriff by penalty. whom he was appointed; but before such punishment shall be so inflicted by an Under-sheriff, an order of the Court of Oyer and Terminer to that effect shall be first obtained. 2.
