shall be calculated on the value at the place of production or fabrication of the object imported, with the addition of the cost of transport, insurance, and commission necessary for the importation into Italy, its dominions and possessions, as far as the port of discharge.

For the levying of these duties, the importer shall make a written declaration at the Custom-house, stating the value and description of the goods imported, with the addition aforesaid. If the Custom-House authorities shall be of opinion that the declared value is insufficient, they shall be at liberty to take the goods on paying to the importer the price declared, with an addition of 5 per cent,

This payment, together with the restitution of any duty which may have been levied upon such goods, shall be made within the 15 days following the declaration.

Per far luogo al pagamento di questi dazi, l'importatore deve fare alla dogana una dichiarazione scritta, nelle quale siano indicati il valore e la natura degli oggetti importati, coll' aggiunta di cui sopra. Se le autorità doganali sono di parere che il valore dichiarato è insufficiente, sarà loro facoltativo di appropriarsi la mercanzia mediante il pagamento all' importatore del prezzo dichiarato, con un compenso del 5 per cento.

XII. The subjects of each of the Contracting Parties shall have, in the dominions and possessions of the other, the same rights as native subjects in regard to trade marks and designs of every description applicable to articles of manufacture.

XIII. It shall be free for each of the Contracting Parties to appoint Consuls-General, Consuls, Vice-Consuls, and Consular Agents, to reside in the towns and ports of the dominions and possessions of the other. Such Consuls-General, Consuls,

XVI. I sudditi di ciascuna delle Parti Contraenti avranno piena libertà, negli stati e possessi dell'altra, di acquistare, possedere, e disporre di ogni sorta di proprietà che le leggi del paese permettono agli stranieri, di qualsiasi nazione, di acquistare e di possedervi. Essi potranno acquistare e disporre delle loro proprietà per compra, vendita, donazione, permuta, matrimonio, testamento, successione ab intestato, o in qualsiasi altra maniera, alle stesse condizione che sono stabilite dalle leggi locali per tutti gli stranieri. I loro eredi o rappresentanti potranno succedere in queste proprietà e prenderne possesso, sia in persona, sia per mezzo di agenti per loro conto, nella stessa guisa e nelle stesse forme legali richieste pei nazionali. In mancanza di eredi o di rappresentanti, le loro proprietà saranno trattate nell' istessa maniera come se appartenessero ad un suddito del paese posto in eguali condizioni.

XVI. The subjects of each of the Contracting Parties in the dominions and possessions of the other shall be at full liberty to acquire, possess, and dispose of every description of property which the laws of the country may permit any foreigners, of whatsoever nation, to acquire and possess. They may acquire and dispose of the same, whether by purchase, sale, donation, exchange, marriage, testament, succession ab intestato, or in any other manner, under the same conditions as are established by the laws of the country for all foreigners. Their heirs and representatives may succeed to and take possession of such property, either in person or by agents acting on their behalf, in the same manner and in the same legal forms as subjects of the country. In the absence of heirs and representatives the property shall be treated in the same manner as the like property belonging to a subject of the country under similar circum

stances.

In none of these respects shall they pay upon the value of such property any other or higher impost, duty, or charge, than is payable by subjects of the country. In every case the subjects of the Contracting Parties shall be permitted to export their property, or the proceeds thereof if sold, freely, and without being subjected on such exportation to pay any duty as foreigners, or any other or higher duties than those to which subjects of the country are liable under similar circumstances.

XVII. The dwellings, manufactories, warehouses, and shops of the subjects of each of the Contracting Parties in the dominions and possessions of the other, and all premises appertaining thereto, destined for purposes of residence or commerce, shall be respected. If there should be occasion to make a search of, or a domiciliary visit to, such dwellings and premises, or to examine or inspect books, papers, or accounts, such measure shall be executed only in conformity with the legal warrant or order in writing of a tribunal, or of the competent authority.

The subjects of each of the two Contracting Parties in the dominions and possessions of the other shall have free access to the courts of justice for the prosecution and defence of their rights. They shall enjoy in this respect the same rights and privileges as subjects of the country, and shall, like them, be at liberty to employ, in all causes, their advocates,

I tutti questi casi essi non pagheranno sul valore delle loro proprietà altre o maggiori tasse, diritti, o carichi, di quelli che sarebbero dovuti dei sudditi nazionali. I sudditi di ciascuna delle Parti Contraenti potranno, in ogni caso, esportare le loro proprietà, od il ricavo della loro vendita, con tutta libertà, e senza essere sottoposti per tale esportazione al pagamento di alcun diritto come straniero, o di alcun diritto che sia differente da quelli cui andrebbero soggetti in simili casi i sudditi del paese.

XVII. Le abitazioni, gli stabilimenti industrili, i magazzini, e le botteghe tenute dai sudditi di ciascuna delle Parti Contraenti negli stati e possessi dell' altra, come pure i locali che loro appartengono, destinati al commercio, saranno rispettati. Nel caso di perquisizione, o di visita domiciliare, in tali abitazioni o locali, e nel caso di ricognizione di libri, carte, e conti, non vi si potrà procedere che dietro autorizzazione legale od ordine scritto di un tribunale, o altra autorità competente,

Essi in tal caso godranno dei diritti e privilegî de' nazionali, e potranno, al pari di questi, affidare la trattazione delle loro cause ad avvocati, procuratori, e agenti i quali abbiano diritto, secondo le leggi

XVIII. Any ship of war or merchant-vessel of either of the Contracting Parties which may be compelled by stress of weather, or by accident, to take shelter in a port of the other, shall be at liberty to refit therein, to procure all necessary stores, and to put to sea again, without paying any dues other than such as would be payable in a similar case by a national vessel. In case, however, the master of a merchantvessel should be under the necessity of disposing of a part of his merchandize in order to defray his expenses, he shall be bound to conform to the regulations and tarifs of the place to which he may have come.

If any ship of war or merchantvessel of one of the Contracting Parties should run aground or be wrecked upon the coasts of the other, such ship or vessel, and all parts thereof, and all furniture and appurtenances belonging thereunto, and all goods and merchandize saved therefrom, including any which may have been cast into the sea, or the proceeds thereof if sold, as well as all papers found on board such stranded or wrecked ship or vessel, shall be given up to the owners or their agents when claimed by them. I vascelli da guerra o bastimenti mercantili di una delle Parti Contraenti, i quali per necessità o per accidente trovinsi costretti a rifuggiarsi nei porti dell' altra, vi potranno essere riparati, e avranno facoltà di approvvigionarsi e riprendere il mare, e in tutti questi casi non saranno tenuti a pagare altri o maggiori diritti di quelli che sarebbero dovuti da navi nazionali. Però si il capitano di un bastimento mercantile si trovi nella necessità di disporre di una parte del carico pel pagamento delle sue spese, dovrà uniformarsi in tal caso ai regolamenti e alle tariffe locali.

Se avvenga che un vascello da guerra o bastimento mercantile dell' una delle Parti Contraenti s'arreni o faccia naufragio sulle coste degli stati o possessi dell' altra, queste navi, le loro parti o rottami, l'alberatura e ogni altro. oggetto che vi appartengano, come pure tutte le mercanzie che saranno state salvate, comprese quelle gettate in mare, o il ricavo della loro vendita, e le carte tutte rinvenute a bordo della nave arrenata o naufragata, saranno restituite al proprietario o chi per esso, appena siano reclamate. Nel caso manchi il proprietario o chi per esso, ogni cosa sarà consegnata al Console
