I.. Before a general court-martial which convened at Jefferson Barracks, Missouri, pursuant to Special Orders, No. 87, dated April 16, 1885, and No. 152, dated July 6, 1885, Headquarters of the Army, Adjutant General's Office, Washington, District of Columbia, and of which Major JOHN K. MIZNER, 4th Cavalry, is president, was arraigned and tried—

Recruit John Nye, General Mounted Service U. S. Army.

CHARGE." Desertion, in violation of the 47th Article of War." Specification [Deserted September 17, 1883; apprehended September 21, 1885.].

PLEA.

To the Specification, "Guilty."
To the CHARGE, "Guilty."

FINDING.

Of the Specification, "Guilty."
Of the CHARGE, "Guilty."

SENTENCE.

And the court does therefore sentence him, Recruit John Nye, General Mounted Service U. S. Army, “To be dishonorably discharged from the service of the United States; to forfeit all pay and allowances that are now due or which may become due; and to be confined at hard labor in such military prison as the reviewing authority may direct for the period of three (3) years."

II..The proceedings, finding, and sentence of the general courtmartial in the foregoing case of Recruit John Nye, General Mounted Service U. S. Army, are approved, and the sentence will be duly executed.

The Leavenworth Military Prison is designated as the place for the execution of so much of the sentence as relates to confinement at hard labor.

I..Before a general court-martial which convened at Davids' Island, New York Harbor, pursuant to Special Orders, No. 238, Headquarters of the Army, Adjutant General's Office, October 16, 1885, and of which Lieutenant Colonel ALFRED L. HOUGH, 16th Infantry, is president, were arraigned and tried

1. Private Thomas F. Higgins, Company H, 18th Infantry. CHARGE.-"Desertion, in violation of the 47th Article of War." Specification-[Deserted July 1, 1882; surrendered himself September 26, 1885.]

And the court does therefore sentence him, Private Thomas F. Higgins, Company H, 18th Infantry, “To be dishonorably discharged the service of the United States; to forfeit all pay and allowances now due or that may become due; and to be confined at hard labor in such military prison as the reviewing authority may direct for the period of five (5) years."

2. Private Henry P. Neels, Troop I, 6th Cavalry.

CHARGE." Desertion, in violation of the 47th Article of War." Specification-[Deserted September 10, 1871; surrendered himself August 22, 1885.]

And the court does therefore sentence him, Private Henry P. Neels, Troop I, 6th Cavalry, "To be dishonorably discharged the serv

ice of the United States; to forfeit all pay and allowances now due or that may become due; and to be confined at hard labor in such military prison as the reviewing authority may direct for the period of five (5) years."

3. Recruit Julius Franck, General Service U. S. Army. CHARGE. "Desertion, in violation of the 47th Article of War." Specification-[Deserted September 27, 1885; apprehended October 7, 1885.]

And the court does therefore sentence him, Recruit Julius Franck. General Service U. S. Army, "To be dishonorably discharged the servic of the United States; to forfeit all pay and allowances now due or that may become due; and to be confined at hard labor in such military prison as the reviewing authority may direct for the period of five (5) years,” 4. Recruit Patrick O'Brien, General Service U. S. Army. CHARGE. "Conduct prejudicial to good order and military discipline, in violation of the 624 Article of War."

Specification 1st-"In that Recruit Patrick O'Brien, Company C of Instruction, General Service Recruits, was disorderly in the mess-hall of his company during dinner, and, when ordered by the sergeant in charge of the kitchen, the said sergeant being in the execution of his duty, to refrain from his disorderly conduct, did fail to obey the said order. This at Davids' Island, New York Harbor, on the 24th day of September, 1885."

Specification 2d-"In that Recruit Patrick O'Brien, Company Cof Instruction, General Service Recruits, when ordered to the guard-house by Sergeant Bingham, who was in the execution of his duty, did, without just cause or provocation, assault
