Every Spiritual Perfon, above forty Years Refidence. of Age (the Chancellor, Vice-chancellor, 28 Henry Commiffary, Rulers of Colleges and Halls, 12. Doctors of the Chair, and Readers of Divinity in either Univerfity excepted) fhall be Refident on one of their Benefices.

And every Perfon, under the Age of forty Years, abiding in either University, fhall not enjoy the Privilege of Non-Refidence, unless he be present at ordinary Lectures, both in the House and Schools, and perform his Exercises according to the Statutes of the University.

Not to extend however to the Reader of any publick Lecture in Divinity, Law, Phyfick, Philofophy, Humanity, or any of the liberal Sciences, or to the Interpreters or Teachers of the Hebrew, Chaldee, or Greek, Tongues; or to any Perfon who shall repair to the Univerfity to proceed Doctor in Divinity, Law or Phyfick.

This Act confirms the Charter of IncorHen. VIII. poration of the College of Phyficians in London (dated September 13, 10 Hen. VIII.) whereby a perpetual College of Physicians is erected in London, and within feven Miles thereof, whereby all are excluded from practising Phyfick within that Compafs; unless approved by the faid College.

And none fhall practise Phyfick in the Country without a Testimonial of his Sufficiency from the faid College; unless he be a Graduate in one of the Univerfities.

It is provided by this Act, that no Purveyor of Provifion for the Crown fhall take Purveyors. any Victuals or Grain in the Markets of Oxford or Cambridge, or within five Miles of either, without the Confent of the Owner; nor fhall he take away, or bargain for any Commodity bought or provided by the Servant of any College or Hall to be spent therein, on Pain of forfeiting four times the Value, and fuffering three Months Imprifonment; but this Act fhall not be put in Execution, when the Queen her Heirs or Succeffors fhall be prefent in either of the faid Universities, or within feven Miles thereof.

This Act prohibits the felling Wine without License of the Juftices of Peace, &c. faving the Privileges of the Univerfities, provided there be no more Taverns

Firit-fruits

This Act was made for fettling the Profits of the Poft-Office, and granting Wine Licenfes, in which the Privileges of the Universities alfo are faved; and it is provided, that all Letters and other Things may be conveyed to and from the Universities, as before. It is provided, that all Grants, Eliz. Immunities and Liberties given to the Uni- c verfities of Cambridge and Oxford, or to any Privileges College or Hall in either of the faid Uni- of the University verfities, and to the Colleges of Eaton and faved. Winchester, and to every or any of them by King Henry VIII. or any other of the Queen's Progenitors, or Predeceffors; or by any Act of Parliament touching the Releafe or Discharge of First-Fruits and Tenths, or any Part thereof, fhall be and remain in their full Strength and Virtue, and all fuch lawful Conveyances or Affurances, as were made before this Act to either of the faid Universities, or to any College or Hall in any of them: Of any Parfonages or benefices impropriate, or of any Part of the fame; or of any Patronages for the Maintenance of Students or Learning, fhall be as good

If any Perfon fhall give Lands to a reMagna ligious Houfe, the Grant fhall be void, Mortmain, and the Land shall be forfeited to the Lord of the Fee.

7. Edw. I. If Lands fhall be alienated in Mortmain to a religious Perfon, or to another, the King, or other Lord immediate, may enter within a Year after fuch Alienation; and if fuch Lord neglect it, the next Lord to him may enter within half a Year, and on his Neglect the King may enter.

If Prelates, Clerks, or other religious Men, impeach'd of purchafing Lands in Mortmain, fhall fhew the King's Charter of Licenfe, and Procefs thereupon made by an Inquest, ad quod damnum or of the King's Grace, or by Fine, they shall be in Peace.

If a Grant fhall be made in Truft to the

Ufe of any Churches, Chapels, Guilds, Fraternities, Companies, or Brotherhoods, to have perpetual Obits, or a continual Service. of a Prieft for ever, or for fixty Years, or to fuch like Purposes, fuch Ufes and Purpofes, fhall be void, they being no Corporations, but erected either of Devotion, or by common Confent of the People; provided fuch Ufes may be declared to continue twenty Years, and no longer.

This Act shall not prejudice Corporations, Mortmain where there is a Custom to devife Lands in

Mortmain.

The King may grant to any Perfon, 7 and 8 Bodies politick or corporate, Licence to Alien in Mortmain; and also to purchase, acquire and hold in Mortmain in Perpetuity, or otherwise, any Lands, Rents, or Hereditaments whatsoever; and Lands fo aliened or acquired, fhall not be Subject to any Forfeiture by Reason of fuch Alienation or Acquifition.

No Lands, Advowfons, or other Here- 9 Geo. II. ditaments, or Money or other perfonal Ef- cap. 36. tate, to be laid out in Lands, &c. fhall be given to any Bodies politick, or charg'd in Truft for charitable Ufes; unless such Gift (other than Stocks in the Funds) shall be made by Deed indented, attefted by two Witneffes, one Year before the Death of the Donor, and enroll'd in Chancery within fix Calendar Months after Execution; and unlefs fuch Stock be transferr'd fix Months before the Death of the Donor, and be made to take Effect in Poffeffion from the making thereof, and do not contain a Power of Revocation; provided, that this Act shall not extend to any Purchase for a valuable Confideration.

And all Gifts of Lands, &c. for charitable Uses made in any other Manner after the 24th of June, 1736, fhall be void.
