CHAP. 1319.-An Act To correct the military record of Reinhard Schneider. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War Reinhard is hereby authorized and directed to correct the military record of Rhinehart Schneider, late a private in the Seventy-ninth Regiment of New York Infantry Volunteers, and issue to him an honorable discharge from said regiment in the name of Reinhard Schneider as of the date of September fifteenth, eighteen hundred and sixty-one: Provided, That no pay, bounty, or allowance shall become due or payable by reason of the passage of this Act. Be it enacted by the Senate and House of Representatives of the United [Private, No. 1123.] States of America in Congress assembled, That the Secretary of War be, and he is hereby, authorized to amend the military record of James M. Olmstead so as to fix September eighth, eighteen hundred and sixty-three, as the actual date of said Olmstead's discharge from the service as second lieutenant Company F, Eleventh Regiment Kentucky Volunteer Cavalry, the same being the date to which he was paid and upon which his service terminated.

CHAP. 1340.-An Act Correcting the record of Levi Wells.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, and he is hereby, authorized and directed to remove the charge of desertion on the records of the War Department against Levi Wells, now of Spencerville, Allen County, Ohio, late a private of Company F, Twenty-fifth Ohio Volunteer Infantry, and a detail to the Twelfth Ohio Battery, and without leave from September eighth, eighteen hundred and sixty-three, until January sixteenth, eighteen hundred and sixty-four, when he reenlisted under the name of John Dolve in the United States Navy and served faithfully until December thirty-first, eighteen hundred and sixty-four, when he was honorably discharged: Provided, That no pay, bounty, or other emoluments shall become due or payable by virtue of the passage of this Act. CHAP. 1342.-An Act To authorize the Secretary of the Navy to appoint George H. Paul a warrant machinist in the Navy.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the warrant machinist in Navy is hereby authorized to appoint George H. Paul to fill an original vacancy in the one hundred warrant machinists in the Navy, authorized by section fourteen of the Act approved March third, eighteen hundred and ninety-nine, entitled "An Act to reorganize and increase the efficiency of the personnel of the Navy and Marine Corps of the United States," notwithstanding he was about seven months beyond the age limit at the time of examination, he having passed the examination, near the top of the list, under a misapprehension as to the age limit, and having served twelve months at the Naval Academy and four years at sea in the Government service as an engineer. Be it enacted by the Senate and House of Representatives of the United Adelaide G. Hatch. States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, authorized and directed to place on the pension roll, subject to the provisions and limitations of the pension laws, the name of Adelaide G. Hatch, widow of John P. Hatch, late colonel Second Regiment United States Cavalry and brigadier-general United States Volunteers, and pay her a pension at the rate of thirty dollars per month in lieu of that she is now receiving. CHAP. 1344.-An Act For the promotion of First Lieutenant Joseph M. Simms, Revenue-Cutter Service.

Be it enacted by the Senate and House of Representatives of the United Joseph M. Simms. States of America in Congress assembled, That the President of the Service United States be, and he is hereby, authorized to advance Lieutenant Joseph M. Simms, Revenue-Cutter Service, one grade, from first lieutenant to that of captain, on the "Permanent waiting orders" list in the Revenue-Cutter Service, for meritorious acts of public service and wounds received in the United States service, as appears upon the public records of the volunteer service of the Army and Navy and of the Revenue-Cutter Service: Provided, That this Act shall not increase the pay of said Simms above that provided for a first lieutenant on the retired list, to wit, one thousand eight hundred and ninety dollars. Approved, June 30, 1902.

CHAP. 1345.—An Act Granting an increase of pension to Clayton P. Van Houten. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, authorized and directed to place on the pension roll, subject to the provisions and limitations of the pension laws, the name of Clayton P. Van Houten, late captain Company D, First Regiment South Dakota Volunteer Infantry, war with Spain, and pay him a pension at the rate of fifty dollars per month in lieu of that he is now receiving: Provided, That at the expiration of two years after the passage of this Act, if the said Clayton P. Van Houten, be then living, a medical examination shall be ordered and the rate of pension allowed by this Act shall be subject to change to accord with the degree of disability then existing. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Solicitor of the Treasury be, and he is hereby, authorized and directed to convey, in tain land in Dothan. the name of the United States, to Daniel Cherry, of Henry County, Ala., to. Alabama, all right, title, and interest that the United States has in or to the property formerly belonging to said Daniel Cherry, described as follows: One house and lot situated in the town of Dothan, Alabama, and bounded on the north by Washington street, on the east by H. V. Lee's lot, on the south by lot owned by Dave Walden, and on the west by lot owned by B. M. Stripling, containing one and one-half acres, more or less, being fractional part of the northeast quarter of the southeast quarter of section twenty-four, township three, and range twenty-six, in the county of Henry, State of Alabama; the said property being the same that was levied on, sold, and conveyed to the United States in satisfaction of a certain judgment recovered by the United States in the United States circuit court for the middle district of Alabama in a suit on the forfeited bail bond of said Daniel Cherry, the said Cherry having afterwards appeared and was tried and acquitted on the charge made in the case in which said bail bond was given: Provided, That before such deed is delivered by the Solicitor of the Treasury the sum of fifty dollars and thirty cents shall be paid proceedings. over to the Secretary of the Treasury to cover the cost of such forfeiture proceedings in the United States circuit court for the middle district of Alabama.

CHAP. 1348.-An Act For the relief of Joseph H. Penny, John W. Penny, Thomas Penny, and Harvey Penny, surviving partners of Penny and Sons.

Be it enacted by the Senate and House of Representatives of the United Joseph H. Penny, States of America in Congress assembled, That the Court of Claims is Thomas Penny, and hereby given jurisdiction to rehear and reconsider and determine the motion filed in said court by the claimants on the fifteenth day of April, eighteen hundred and ninety-eight, for a rehearing and new trial of the case of Penny and Sons versus the United States and Sioux Indians, numbered in said court as Indian depredations numbered forty-six hundred and thirty-four; and to that end the bar of the statute of limitations against said motion is hereby removed, and the said court is given jurisdiction to rehear and redetermine said motion in the same manner and with like effect as if said motion had been filed and pre sented within the time authorized by law and the rules of said court; and if said motion shall be sustained by said court, then, and in that event, the court shall proceed to retry and readjudicate the matter involved in said suit the same as if no former judgment had been entered therein.

CHAP. 1349.-An Act For the relief of John Hornick.

Be it enacted by the Senate and House of Representatives of the United Removal of disabil. States of America in Congress assembled, That John Hornick, having ities caused by defect- served in the infantry service of the United States for nearly three years during the war of the rebellion, and having been honorably discharged from such service, be, and he is hereby, relieved from any disability now or heretofore existing, since the date of his said discharge, by reason of any defective naturalization, or by reason of not having been duly naturalized under the laws of the United States; and he is hereby authorized to prosecute, in the Court of Claims of the United States, Indian depredation claim numbered in said court ten thousand three hundred and eighty-nine and entitled "John Hornick, Fred T. Evans, and Richard Dunn versus The United States and the Sioux Indians," in which cause judgment was rendered by said court on the fourteenth day of January, anno Domini nineteen hundred and one; and the said court is hereby authorized and directed to reinstate the said cause, so far as the same pertains to the claim of the said John Hornick, and upon the facts, as found and returned by said court, is authorized to enter judgment in said cause in favor of the said John Hornick for such sum as he would have been entitled to recover in said action, with such costs as he may be entitled to recover under existing law and the rules of said court, the same as if he had beer, a citizen of the United States at the time said depredation was committed.

CHAP. 1350.-An Act To pay the claim of Stephen B. Halsey.

Be it enacted by the Senate and House of Representatives of the United Stephen B. Halsey. States of America in Congress assembled, That there be, and is hereby, appropriated, out of any money in the Treasury not otherwise appropriated, the sum of fifty dollars, to be paid to Stephen B. Halsey, for the damage done to his dock at Astoria, Long Island, by the United States steamship Canby on August twenty-first, eighteen hundred and ninety-nine.

CHAP. 1387.-An Act For the relief of Angus A. McPhee.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Treasurer of the United States pay to Angus A. McPhee the sum of six hundred and seventy-six dollars and eighty-five cents, the same being the amount of a certain judgment recovered by the United States against said McPhee on the thirtieth day of April, eighteen hundred and ninetyfour, in the circuit court of the western district of Wisconsin, for six hundred and sixteen dollars and eighty-five cents, and sixty dollars expended for costs by said McPhee in defending the action, and which judgment was paid in full by said McPhee, it being for the value of timber cut from certain lands in sections one, thirteen, eleven, and twentythree, township forty-five north, of range four, Ashland County, Wisconsin, by said McPhee, and claimed by the United States, and which lands were subsequently determined by the Supreme Court, in the case of Wisconsin Central Railroad Company against Forsythe, to be owned by the said railroad company under the grant of May fifth, eighteen hundred and sixty-four.
