§ 313.12 Officers authorized to certify requests for payment.

(g) Authorized officers in the Philippine Islands. In addition to the officers designated elsewhere in this section, the United States High Commissioner, his Administrative Assistant, and the Chief Clerk in his office, under the High Commissioner's seal; Provincial and Municipal Treasurers, and City Treasurers in Manila and Baguio, under their respective seals; Philippine postmasters under the stamp of their office; and, in Manila, Post Office inspectors assigned in Manila, under the seal of the Bureau of Posts: Provided, however, That the requests for payment witnessed and certified to by these officials shall be supported by the fingerprints of the veterans in the place provided therefor on the back of the bonds, and that the bonds be then forwarded to the Treasury of the Philippine Islands or to the Treasurer of the United States for payment. § 401.2 Secret Service Agents authorized to make seizures. All officers of the United States Secret Service engaged in the enforcement of counterfeiting laws are hereby authorized and designated to seize such vessels, vehicles, and aircraft as may be subject to seizure because of violations of the said Act of August 9, 1939, pertaining to contraband articles referred to in section 1 (b) (3) of said

Act.*+

§ 401.3 Custody. Each vessel, vehicle, or aircraft seized pursuant to the said Act of August 9, 1939 and the regulations in this part shall forthwith be placed by the seizing officer in the custody of the collector of customs for the customs district in which such seizure is made.

§ 401.5 Duties of Bureau of Customs. With respect to every vessel, vehicle, and aircraft seized and placed in the custody of a collector of customs pursuant to the said Act of August 9, 1939, and the regulations in this part, the appropriate officials of the Bureau of Customs are hereby authorized and designated as the officers who shall perform such administrative duties in connection with:

(a) the summary and judicial forfeiture and condemnation of such vessel, vehicle, or aircraft;

(b) the disposition of such vessel, vehicle, or aircraft or the proceeds from the sale thereof;

(c) the remission or mitigation of the forfeiture of such vessel, vehicle, or aircraft; and

award of compensation to informers in (d) the compromise of claims and the respect to such vessel, vehicle, or aircraft;

as may be necessary and proper by virtue of the provisions of said Act of August 9, 1939, and by virtue of the provisions of the customs laws which the said Act makes applicable in connection with seizures and forfeitures incurred or al

leged to have been incurred under the said Act and the regulations in this part. In the performance of said administrative duties the said appropriate officials of the Bureau of Customs shall be governed by the procedures established by the customs regulations, in so far as such procedures are applicable and not inconsistent with the provisions of the said Act of August 9, 1939, and the regulations in this part. Powers of the character of those exercised by the Secretary of the Treasury and the Commissioner of Customs in connection with the remission or mitigation of forfeitures under the customs laws and in connection with the compromise of claims and the award of compensation to informers under the customs laws shall be exercised by the Secretary of the Treasury in connection with the remission or mitigation of forfeitures under the said Act of August 9, 1939, and in connection with the compromise of claims and the award of compensation to informers under the said Act.*†

§ 401.6 Disposition. With respect to each vessel, vehicle, and aircraft seized pursuant to the said Act of August 9, 1939, and the regulations in this part, the Chief of the Secret Service shall promptly Division and the Commissioner of Cusnotify the Director of the Procurement toms whether the Secret Service Division desires to have such vessel, vehicle, or aircraft for its official use. When forfeiture of any vessel, vehicle, or aircraft has been perfected otherwise than by court decree, the collector of customs holding in custody such vessel, vehicle, or aircraft shall: (a) either return the same to the Secret Service Division, if the Chief of the Secret Service has requested it for the official use of the Secret Service Division, (b) or, if the Secret Service Division does not desire such vessel, vehicle, or aircraft for its official use, hold such vessel, vehicle, or aircraft subject to the instructions of the Director of the Procurement Division. GENERAL REGULATIONS AND SPECIAL
PROVISIONS

§ 1.1 Application for registration. All persons engaged in the business of manufactur11-ing, exporting, or importing any of the arms, are ammunition, or implements of war enumerated in § 1.49, shall register with the Secretary of State by duly filling out and transmitting to the Secretary of State an application for registration in the form printed below. The articles manufactured, exported, or imported shall be listed on the application for registration under the same categories and in precisely the same terms in which they are listed in § 1.49. Applications for registration must be signed and sworn to in the presence of a notary public before they are transmitted to the Secretary of State.** [Part III, (1)]
