EXECUTIVE ORDER NO. 10480

FURTHER PROVIDING FOR THE ADMINISTRATION OF THE DEFENSE
MOBILIZATION PROGRAM

By virtue of the authority vested in me by the Constitution and laws of the United States, including the Defense Production Act of 1950, as amended (50 U. S. C. App. 2061 et seq.), and as President of the United States and Commander in Chief of the armed forces of the United States, it is hereby ordered as follows:

PART I-GENERAL DIRECTION OF PROGRAM

SECTION 101. (a) The Director of the Office of Emergency Planning shall on behalf of the President, coordinate all mobilization activities of the executive branch of the Government, including all such activities relating to production, procurement, manpower, stabilization, and transport. Every officer and agency of the Government having functions under the Defense Production Act of 1950, as amended, delegated, redelegated, or otherwise assigned thereto by or under the authority of the President after the date of this order (whether heretofore or hereafter acquired, or acquired by this order) shall perform the said functions subject to the direction and control of the Director of the Office of Emergency Planning.

PART II-PRIORITIES AND ALLOCATIONS

SEC. 201. (a) The functions conferred upon the President by Title I of the Defense Production Act of 1950, as amended, are hereby delegated to the Director of the Office of Emergency Planning, who shall, in carrying out the said functions, provide by redelegation or otherwise for their performance, subject to the provisions of section 101 of this order, by

(1) The Secretary of the Interior with respect to petroleum, gas, solid fuels and electric power.

(2) The Secretary of Agriculture with respect to food and with respect to the domestic distribution of farm equipment and commercial fertilizer.

(3) The Commissioner of the Interstate Commerce Commission who is responsible for the supervision of the Bureau of Service of the Commission, with respect to domestic transportation, storage, and port facilities, or the use thereof, but excluding air transport, coastwise, intercoastal, and overseas shipping.

(4) The Secretary of Commerce with respect to all other materials and facilities.

AUTHORIZING CERTAIN FUNCTIONS OF HEADS OF DEPARTMENTS AND AGENCIES UNDER SECTION 16 OF THE FEDERAL AIRPORT ACT TO BE PERFORMED WITHOUT THE APPROVAL OF THE PRESIDENT

By virtue of the authority vested in me by section 301 of title 3 of the United States Code, it is hereby ordered as follows:

The authority vested in the heads of departments and agencies by subsection (b) of section 16 of the Federal Airport Act, approved May 13, 1946 (60 Stat. 179), with the approval of the President and the Attorney General of the United States, to perform any acts and to execute any instruments necessary to make conveyances requested by the Administrator of Civil Aeronautics under subsection (a) of the said section 16 may be exercised by such heads of departments and agencies without the approval of the President.

SUSPENSION OF THE EIGHT-HOUR LAW AS TO LABORERS AND MECHANICS EMPLOYED BY THE CIVIL AERONAUTICS ADMINISTRATION ON PUBLIC WORK ESSENTIAL TO THE NATIONAL DEFENSE.

WHEREAS by proclamation No. 2914 of December 16, 1950, the President proclaimed the existence of a national emergency, which requires that the military, naval, air, and civilian defenses of this country be strengthened as speedily as possible; and

WHEREAS by section 1 of the act of August 1, 1892, 27 Stat. 340, as amended by the act of March 3, 1913, 37 Stat. 726 (40 U.S.C. 321), the service or employment of all laborers and mechanics employed by the Government of the United States upon any public work of the United States is limited to eight hours in any one calendar day, except in case of extraordinary emergency; and

WHEREAS it is essential to the national defense that the Nation's system of air-navigation facilities be modernized in a very short period of time, and that such system be operated and maintained at the highest level of efficiency; and

WHEREAS I find that as to public work essential to the national defense being performed by the Civil Aeronautics Administration an extraordinary emergency exists:

Now, THEREFORE, by virtue of the authority vested in me by section. 1 of the said act of August 1, 1892, as amended by the said act of March 3, 1913, and as President of the United States, I hearby suspend the above-mentioned provisions of law prohibiting more than eight hours of labor in any one calendar day by laborers and mechanics employed by the Government of the United States as to all work performed by laborers and mechanics employed by the Civil Aeronautics Administration on any public work which is essential to the national defense: Provided, That the wages of all laborers and mechanics so employed shall be computed on a basic day rate of eight hours of work with overtime to be paid at a rate not less than time and one-half for all hours of work in excess of eight hours in any one day.

This order shall continue in effect until terminated or revoked by the President.

TRANSFERRING FUNCTIONS OF THE AIRWAYS MODERNIZATION BOARD TO THE ADMINISTRATOR OF THE FEDERAL AVIATION AGENCY

By virtue of the authority vested in me by section 304 of the Federal Aviation Act of 1958 (Public Law 85-726, 72 Stat. 749) and by section 202(b) of the Budget and Accounting Procedures Act of 1950 (64 Stat. 838; 31 U.S.C. 581c(b)), and as President of the United States, it is ordered as follows:

SECTION 1. All functions (including powers, duties, activities, and parts of functions) of the Airways Modernization Board, including those of the Chairman thereof, are hereby transferred to the Administrator of the Federal Aviation Agency; and all records, property, facilities, employees, and unexpended balances of appropriations, allocations, and other funds of the Airways Modernization Board, are hereby transferred to the Federal Aviation Agency.

SECTION. 2. Such further measures and dispositions, if any, as the Director of the Bureau of the Budget shall determine to be necessary in connection with the transfers provided for hereinabove in respect of records, property, facilities, employees, and balances shall be carried out in such manner as he shall direct and by such agencies as he shall designate.

SECTION 3. The provisions of this order shall become effective concurrently with the entering upon office as Administrator of the Federal Aviation Agency of the first person appointed as Administrator. The functions transferred by section 1 hereof may be performed by the Administrator until the effective date of the repeal of the Airways Modernization Act of 1957 effected by section 1401 (d) of the Federal Aviation Act of 1958.

DELEGATING TO THE DIRECTOR OF THE BUREAU OF THE BUDGET CERTAIN AUTHORITY VESTED IN THE PRESIDENT BY THE FEDERAL AVIATION ACT OF 1958

By virtue of the authority vested in me by section 301 of title 3 of the United States Code, and as President of the United States, it is ordered as follows:

SECTION 1. There is hereby delegated to the Director of the Bureau of the Budget all authority vested in the President by the last sentence of section 304, and by sections 1502 (a) and 1502(b), of the Federal Aviation Act of 1958 (72 Stat. 749, 810), relating, respectively, (1) to providing, in connection with transfers of functions made under other provisions of section 304, (i) for appropriate transfers of records and property, and (ii) for necessary civilian and military personnel to be made available from any oflice, department, or other agency from which transfers of functions are so made; (2) to determining the employees and property (including office equipment and official records) employed by the Civil Aeronautics Board in the exercise and performance of those powers and duties which are vested in and imposed upon it by the Civil Aeronautics Act of 1938, as amended, and which are vested by the Federal Aviation Act of 1958 in the Federal Aviation Agency, and to specifying the date or dates upon which the transfers of officers, employees, and property (including office equipment and official records) under section 1502 (a) shall occur; and (3) specifying the date or dates upon which transfers of unexpended balances of appropriations under section 1502 (b) shall occur. Such further measures and dispositions as the Director of the Bureau of the Budget shall determine to be necessary in connection with the exercise of the authority delegated to him by this section shall be carried out in such manner as he shall direct and by such agencies as he shall designate.

SECTION 2. Executive Order No. 10731 of October 10, 1957, delegating to the Director of the Bureau of the Budget the authority vested in the President by a certain provision of the Airways Modernization Act of 1957, is hereby revoked, such revocation to become effective on the date the repeal of that act takes effect under sections 1401 (d) and 1505(2) of the Federal Aviation Act of 1958 (72 Stat. 806, 811).

SECTION 3. Except as otherwise provided in section 2 hereof, the provisions of this order shall become effective immediately.
