1 propriated or otherwise obligated for a specific purpose or 2 project, or approves the impounding of such funds by any 3 officer or employee of the United States, he shall, within ten 4 days thereafter, transmit to the Senate and the House of 5 Representatives a special message specifying—

(1) the amount of the funds impounded;

(2) the date on which the funds were ordered to be

impounded;

(3) the date the funds were impounded;

(4) any account, department, or establishment of

the Government to which such impounded funds would

have been available for obligation except for such im

poundment;

(5) the period of time during which the funds are

to be impounded;

(6) the reasons for the impoundment;

(7) to the maximum extent practicable, the esti

mated fiscal, economic, and budgetary effect of the impoundment.

(b) Each special message submitted pursuant to sub21 section (a) shall be transmitted to the House of Representa22 tives and the Senate on the same day, and shall be delivered 23 to the Clerk of the House of Representatives if the House 24 is not in session, and to the Secretary of the Senate if the

1 Senate is not in session. Each such message shall be printed

2 as a document for each House.

3 (c) A copy of each special message submitted pursuant 4 to subsection (a) shall be transmitted to the Comptroller 5 General of the United States on the same day as it is trans6 mitted to the Senate and the House of Representatives. 7 (d) If any information contained in a special message 8 submitted pursuant to subsection (a) is subsequently revised, 9 the President shall transmit promptly to the Congress and 10 the Comptroller General a supplementary message stating 11 and explaining each such revision.

12 (e) Any special or supplementary message transmitted 13 pursuant to this section shall be printed in the first issue of 14 the Federal Register published after that special or supple15 mental message is so transmitted.

(f) The President shall publish in the Federal Register 17 each month a list of funds impounded as of the first calendar 18 day of that month. Each list shall be published no later than 19 the tenth calendar day of the month and shall contain the 20 information required to be submitted by special message 21 pursuant to subsection (a).

SEC. 2. The President shall cease the impounding of 23 funds set forth in each special message within sixty calendar 24 days of continuous session after the message is received by 25 the Congress unless the specific impoundment shall have

1 been ratified by the Congress by passage of a resolution in

2 accordance with the procedure set out in section 4 of this

3 Act.

4 SEC. 3. For purposes of this Act, the impounding of 5 funds includes

(1) withholding or delaying the expenditure or obligation of funds (whether by establishing reserves or otherwise) appropriated or otherwise obligated for projects or activities, and the termination of authorized projects or activities for which appropriations have been made, and

(2) any type of executive action which effectively precludes the obligation or expenditure of the appropriated funds.

SEC. 4. The following subsections of this section are 16 enacted by the Congress:

(a) (1) As an exercise of the rulemaking power of 18 the Senate and the House of Representatives, respec19 tively, and as such they shall be deemed a part of the rules 20 of each House, respectively, but applicable only with re21 spect to the procedure to be followed in that House in the 22 case of resolutions described by this section; and they shall 23 supersede other rules only to the extent that they are incon24 sistent therewith; and

(2) With full recognition of the constitutional right of

1 either House to change the rules (so far as relating to the 2 procedure of that House) at any time, in the same manner, 3 and to the same extent as in the case of any other rule of 4 that House.

5 (b) (1) For purposes of this section, the term “reso6 lution" means only a concurrent resolution of the Senate 7 or House of Representatives, as the case may be, which is 8 introduced and acted upon by both Houses before the end 9 of the first period of sixty calendar days of continuous session 10 of the Congress after the date on which the President's mes11 sage is received by that House.

(2) The matter after the resolving clause of each reso13 lution shall read as follows: "That the Senate (House of 14 Representatives) approves the impounding of funds as set 15 forth in the special message of the President dated

16 Senate (House) Document No.-".

(3) For purposes of this subsection, the continuity of

a session is broken only by an adjournment of the Congress 19 sine die, and the days on which either House is not in ses20 sion because of an adjournment of more than three days to a 21 day certain shall be excluded in the computation of the. 22 sixty-day period.

23 (c) (1) A resolution.croduced with respect to a special 24 message shall not be referred to a committee and shall be 25 privileged business for immediate consideration. It shall at

1 any time be in order (even though a previous motion to the 2 same effect has been disagreed to) to move to proceed to 3 the consideration of the resolution. Such motion shall be 4 highly privileged and not debatable. An amendment to the 5 motion shall not be in order, and it shall not be in order to 6 move to reconsider the vote by which the motion is agreed 7 to or disagreed to.

(2) If the motion to proceed to the consideration of a 9 resolution is agreed to, debate on the resolution shall be 10 limited to ten hours, which shall be divided equally between 11 those favoring and those opposing he resolution. An amend12 ment to the resolution shall not be in order. It shall not be 13 in order to move to reconsider the vote by which the resolu.14 tion is agreed to or disagreed to, and it shall not be in order 15 to move to consider any other resolution introduced with 16 respect to the same special messagé.

(3) Motions to postpone, made with respect to the 18 consideration of a resolution, and motions to proceed to the 19 consideration of other business, shall be decided without 20 debate.

(4) Appeals from the decisions of the Chair relating

22 to the application of the rules of the Senate or the House of

23 Representatives, as the case may be, to the procedure relat

24 ing to a resolution shall be decided without debate.
