(2) The hospital accommodation will be divided between appli cants from the military and naval services and the Marine Corps. The length of treatment in hospital will be determined by the medical officer in charge.

1252. Officers and enlisted men of the Navy and Marine Corps Persons sent to when on duty at a place where there is no naval hospital, may be other than naval sent to other hospitals upon the order of the commander in chief, or the senior officer present, and the expenses of such persons shall be paid from the naval hospital fund; and no other charge shall be made against their accounts than such as are made for persons under treatment at naval hospitals.

1253. Whenever any officer, seaman, or marine entitled to a pension is admitted to the Naval Home, Philadelphia, or to a naval sons in Naval hospital, his pension, while he remains there, shall be deducted from Home or hospihis accounts and paid to the Secretary of the Navy for the benefit of the fund from which such home or hospital, respectively, is maintained. 1254. (2) All claims for expenses incurred for medicines and medical attendance shall be forwarded to the Surgeon General of the Navy for examination and approval. When approved, the claim will be forwarded to the Paymaster General for payment by such officer as he may designate. Claims should be accompanied by receipted bills, and all other vouchers and papers pertaining thereto.

1256. Enlisted men of the Navy, not under instruction nor diving for practice, shall, when employed in submarine diving, receive extra compensation therefor, to be charged to the bureau for which the service is performed, at the rate of one dollar and twenty cents per hour for the actual time so employed under water. 1257. 1260. (1) The actual expenses only of enlisted men suminoned as witnesses before a court-martial shall be paid, and shall be provided by the pay officer upon order of the commanding officer of the ship or station to which they belong.

(2) Citizens not in the employ of the United States, when summoned as witnesses before naval courts, shall be paid one dollar and fifty cents per diem and five cents per mile from and to their domiciles. Judge advocates shall, in their certificates of attendance, discriminate between citizen witnesses and those who are in the employ of the Government of the United States.

1261. Marine officers are entitled to draw forage from the Quartermaster's Department if it be allowed by law and army regulations, but no commutation for forage shall be paid.

SECTION 9.-PERSONS DECEASED.

1262. (1) When an officer of the Navy on duty dies in a foreign penses of naval country, the expenses of his funeral, not exceeding his sea pay for one month, will be defrayed by the Government and paid by the pay officer upon whose books the name of such officer was borne for pay. Should the funeral expenses exceed the amount_so allowed, the excess shall be charged against his account, and a separate bill for that amount must accompany the transfer to the Auditor for the Navy Department.

1266. (1) Any disabled enlisted man who has not been discharged for misconduct shall, after ten years' service in the Navy sions to disabled or Marine Corps, be entitled to a pension, if a board of survey consisting of three naval officers, one of whom shall be a medical officer, appointed by the Secretary of the Navy, shall recommend it. (See sec. 4757, R. S.)

(2) After twenty years' service, any enlisted man disabled from sea service by reason of age or infirmity, who has not been discharged for misconduct, shall, if he so elect, be entitled to a pension equal to one-half the pay of his rating when last discharged, in lieu of being provided with a home in the Naval Home, Philadelphia. . 1268. In all cases of injury by accident to persons in the Navy, not recorded in the medical journal by reason of the absence of the eye witnesses to medical officer or otherwise, the commanding officer shall direct a statement of the facts in the case to be made to the Surgeon General by an officer or, in the absence of an officer, by any other trustworthy person who was a witness to the accident. The statement shall show where the accident occurred, what the injured person was doing at the time, and how the accident was caused. It shall be as brief as possible consistent with clearness. The commanding officer shall indorse his opinion upon it, and it shall be referred to in the medical journal and be forwarded to the Surgeon General. 1269. In case of death, injury, or disability, where the official medical record may be incomplete, the Surgeon General shall decide eral to decide if as to whether such death, injury, or disability was received in the line of duty.

CHAPTER XXVI.

SUPPLIES ON SHORE.

SECTION 1.-CUSTODY AND CARE ON SHORE.

1270.
