Boundaries.

To incorporate the City of Gretna; to prescribe the boundaries of said city; to provide a Commission form of Government for the administration of the affairs of said city and to pro vide for the appointment and the election of its officers, due notice of the intention to apply for same having been given in accordance with the Constitution of this State.

Section 1. Be it enacted by the General Assembly of the State of Louisiana, That all the inhabitants of the Parish of Jefferson, situated on the right bank of the Mississippi River, included within the following boundaries; commencing at a point in the middle of the Mississippi River on the projected division line between the Parish of Jefferson and the Parish of Orleans, in the vicinity of Algiers, and thence along the said projected line to the right bank of said river, and thence along the division line between the Parish of Jefferson and the Parish of Orleans in the vicinity of Algiers, and thence along the said projected line to the right bank of said river, and thence along the division line between the Parish of Jefferson and the Parish of Orleans to a point on the lower or northeast line of the right of way of the Morgan's Louisiana and Texas Railroad and Steamship Company, thence along the lower or northeast line, including the entire right of way of the Morgan's Louisiana and Texas Railroad and Steamship Company, to a point intersecting the east boundary line of the New Orleans, Southern and Grand Isle Railroad, thence along the east boundary line of the right of way, including the right of way of the New Orleans Southern

and Grand Isle Railroad to a point on the projected rear protection levee in the rear of Gretna, thence along the projected rear protection levee on the upper line of the Village of New Mechanickham, thence along the upper line of the Village of New Mechanickham to the right bank of the Mississippi River, thence on a projected straight line to a point in the middle of the Mississippi River, thence along the middle of the Mississippi River to the point of commencement, are hereby created a body corporate and established as a political corporation by the name of the City of Gretna and with the following powers:

(a) It shall have perpetual succession, and by that name may sue and defend, plead and be impleaded, in all courts and places and in all matters and proceedings; may have and use a common seal and alter the same at pleasure; may purchase, receive, hold and enjoy, or sell and dispose of, real and personal property.

(b) It may receive bequests, gifts, donations of all kinds of property in fee simple, or in trust, for public, charitable or other purposes; and do all things and acts necessary to carry out the purpose of such gifts, bequests and donations, with power to manage, sell, lease or otherwise dispose of same in accordance with the terms of the gift, bequest or donation.

(e) The legislative, executive and judicial powers of the City of Gretna shall be vested in a Mayor and three commissioners, missioners to be who shall be first appointed by the Governor of Louisiana and thereafter elected by the voters of said City of Gretna as herein provided;

The Mayor shall be elected by a vote, at large, and the Commissioners shall be elected by Ward, not more than one commissioner being elected from each ward; said officers being designated as follows:

1. Commissioner of Public Affairs, who shall be ex-officio Mayor.

2. Commissioner of Finance, who shall be ex-officio Treasurer. 3. Commissioner of Public Health and Safety.

4. Commissioner of Public Parks and Streets.

The wards of said City shall be comprised within the following boundaries, viz.

The first ward shall be embraced within the territory beginning at a point on the Mississippi River, Right Bank, on the projected division line between the Parish of Jefferson and the Parish of Orleans, in the vicinity of Algiers and thence along the division line between the Parish of Jefferson and the Parish of Orleans to a point on the lower or northeast line of the right of way of the Morgan's Louisiana and Texas Railroad and Steamship Company, thence along the lower or northeast line, including the entire right of way of the Morgan's Louisiana and Texas

Railroad and Steamship Company, to a point intersecting
the east boundary line of the New Orleans,
Orleans, Southern
and Grand Isle Railroad, thence along the east boundary
line of the right of way of the New Orleans Southern
and Grand Isle Railroad to a point on the projected rear
protection levee as it now stands in the rear of the City of
Gretna, which line above shall be and constitute the lower line
or boundary of the first ward of said City of Gretna and thence
along the following upper line or upper boundary of said first
ward; from a point in the middle of the Mississippi River along
the projected lower boundary of the Village of New Gretna as
presently located and delineated on an old map or plat of said
Village, to the right bank of the Mississippi River, thence along
the lower boundary of the said Village of New Gretna, (upper
boundary of Brooklyn pasture) to the rear protection levee, or
rear boundary line of the City of Gretna, which line, shall con-
stitute the upper boundary of said first ward of the City of
Gretna, and thence across or along the rear boundary line to the
point of intersection with the lower boundary, and along the
middle of the Mississippi River, to the point of beginning.

The second ward shall be embraced within the territory beginning at a point in the middle of the Mississippi River, right bank, and shall have as its lower boundary, the upper boundary of the first ward as hereinabove described, the upper boundary shall commence at a point in the middle of the Mississippi River, on the projected center line of Lavoisier Street, thence along said. projected center line to the right bank of the Mississippi River, thence along the center line of Lavoisier Street to its point of intersection with the upper line of the presently constituted and delineated Village of Gretna as per map in Recorders Office of the Parish of Jefferson; thence along the upper line of the Village of Gretna, to its intersection with the rear protection levee or rear boundary of the City of Gretna, thence along said Levee or rear boundary to its intersection with the lower boundary of said ward.

Then running from the point of beginning of the upper boundry along the center of the Mississippi River, to the point of commencement of the lower boundary.

The third ward shall be embraced within the territory begining at a point in the middle of the Mississippi River, right bank, and shall have as its lower boundary, the upper boundary of the second ward as hereinabove described; the upper boundary shall commence at a point in the middle of the Mississippi River on the projected upper boundary line of the Village of New Mechanickham, thence along said projected line to the right bank of said river, thence along the upper boundary line of the Village of New Mechanickham to its intersection with the projected line of the rear protection levee.

The rear boundary shall commence at the intersection of the upper line of the Village of New Mechanickham and the projected line of the rear protection levee, thence along said projected rear protection levee to the bank of said rear protection levee, thence along the bank of the rear protection levee or the rear boundary of the City of Gretna, to its intersection with the lower boundary of the said third ward as hereinabove described; Thence from the point of commencement of the upper boundary line in the middle of the Mississippi River along the center of the Mississippi River to the point of commencement of the lower boundary of said third ward.

The Mayor and each of the Commissioners, except the Commissioner of Finance, shall give an official bond of Three Thousand ($3000.00) Dollars, with a solvent surety company as security, duly authorized to do business in this State, the charges of which Company for said bond shall be paid by the City. The bonds must be given before any of the officers shall enter upon the duties of his office.

The Commissioner of Finance shall give an official bond of ten thousand ($10,000.00), with a like surety as the other Commissioners, and the charges for said bond shall also be paid by the City.

The Council may increase but shall not decrease the amount of said bonds.

Each of said Commissioners shall take an oath to obey the Constitution and laws of the United States and of this State, and to faithfully discharge the duties of his office. They shall be of good moral character well qualified to discharge the duties of their offices. They shall devote as much of their time and attention to the business of their offices as shall be required, and shall receive from the City no other compensation than the salaries fixed herein, and shall be in no manner interested, directly or indirectly, in any work done for the City, or in any purchase of supplies or other material or articles for the said city.

The first Mayor and Board of Commissioners under this act First officers to shall be appointed by the Governor of Louisiana and said Mayor be appointed by and Board of Commissioners shall enter upon and discharge the duties of their offices at the expiration of the term of office of the present Mayor and Aldermen and they shall hold office until the 1st. Tuesday after the 3rd. Monday in April, 1920, at which time a Mayor and three Commissioners shall be elected by the qualified electors of the City of Gretna for a term of four years. or until their successors are elected and qualified.

The election of Mayor and Commissioners shall be held every four years thereafter.

Section 2. Be it further enacted, etc., That these four commisties of Commission- sioners shall be the only elective officers of the City of Gretna, and shall possess legislative, executive and police power, as hereinafter set forth, and while sitting together as council of the City of Gretna, they shall be presided over by the Commissioner of Public Affairs who shall be Mayor, and shall act as such, but he shall not vote on any question except in case of a tie existing when one of the three commissioners happens to be absent from a meeting, in which case he shall cast the deciding vote.

Said Commissioners shall meet twice a month in regular session at 7 o'clock P. M., on the second and fourth Tuesday of every month, in the City Hall of said City.

They shall also meet in special session at the City Hall whenever the public interest demands, which special session may be called by any two commissioners on written notice to the other commissioners. They shall also have power to hold joint meetings with the Commission Council of New Orleans and the Police Jury of the Parish of Jefferson, or either of them, in connection with any question which involves the joint interest of both, said meetings to be held when and where it may be deemed advisable by said Board of Commissioners.

Said Council shall have all authority and powers to pass ordinances, rules, and by-laws, and to select all the employees and assistants needed in the several departments of the City, and to fix their salaries, make contracts, levy taxes and generally to do and perform all acts necessary for the proper conduct of the affairs of said municipal corporation of the City of Gretna.

Section 3. Be it further enacted, etc., That the Commissioner of Public affairs shall superintend, govern and have charge of:

(1) The Police Department of said City.

(2) The Fire Department.

(3) The Legal Department.

(a) He shall be the executive officer of said City and all legal process against the City shall be served upon the Mayor or - acting mayor.

(b) He shall see that the laws of the State, the provisions of this charter, and the ordinances of the City are duly enforced.

(c) He shall sign all contracts, bond or other instruments requiring the assent of the City and take care that the same are duly performed.

(d) He shall personally select and recommend to the Council for appointment and election all the members, employees and assistants employed in the departments superintended by him subject to the approval or rejection of the Council. The council. shall fix the compensation of all help required by the several
