PREFACE.

The text of this work is that of the Ohio Statutes as enacted April 17, 1902, found in 95 Ohio Laws, 162.

The original draft of a Negotiable Instruments Law, designed for general adoption, was made in 1896, by the Commissioners on Uniformity of Laws, and first enacted by New York, followed by several other states, with slight modifications in a few instances.

The Ohio enactment follows that of New York, except that the Article, Subdivision and Section numbers have been changed, and headings introduced, to conform to the system of the Ohio Revised Statutes.

The annotations herein have been carefully and systematically prepared directly from the cases, and all interpretations and speculations as to the law have been strenuously avoided.

Each decision, inserted in its proper place, stated as briefly and concisely as is consistent with clearness, presents a complete verified key to the highest Ohio authority extant upon the questions involved. As in most cases, this code presents only the law as it has been, the decisions are as authoritative as if enacted under the law itself. The citations are mostly made from the syllabi of the cases; the syllabus since and including the 5th Ohio State Reports (1855) being the authoritative statement of the law. A complete table of cases also appears, by the aid of which the application and relation of every Ohio case to the present act can be readily ascertained.
