A.D. 1869.

BIDEFORD.

Provisional Order putting in force the Lands Clauses Consolidation
Act, 1845, within the District of the Bideford (Devonshire)
Local Board, for the Purchase of Lands by the said Board for
Works of Water Supply.

WHEREAS the Local Board for the district of Bideford, in the county of Devon, have, in pursuance of the provisions of the 75th section of the Local Government Act, 1858, and after complying with the requirements of that section by duly giving and serving all notices thereby directed, presented a petition, under the seal of the said Board, to one of Her Majesty's Principal 10 Secretaries of State for authority to put in force the Lands Clauses Consolidation Act, 1845, to enable the aforesaid Local Board to purchase certain pieces of land for works of water supply within their district :

And whereas the said petition duly set forth in the schedule annexed thereto the several pieces of land intended to be taken by such Board for such 15 purposes as shown in the plan accompanying such petition, and the names of the owners, lessees, and occupiers of the aforesaid land who have assented, dissented, and are neuter in respect of the taking thereof, or who have returned no answer to the notice issued to such Board; and such petition prayed that the said Board might, with reference to such lands, be allowed to put in force 20 the powers of the Lands Clauses Consolidation Act aforesaid with respect to the purchase and taking of land otherwise than by agreement; and on the receipt of such petition Her Majesty's Principal Secretary of State for the Home Department directed Robert Morgan, Esquire, the inspector appointed for the purpose, to visit the said district, and the said inspector has now 25 inquired in the district aforesaid into the subject matter of such petition, and has duly reported to me thereon:

Now, therefore, I, as one of Her Majesty's Principal Secretaries of State, do hereby, in pursuance of the powers vested in me by the Local Government Act, 1858, make order and direct,—

30 That from and after the passing of any Act of Parliament confirming this Order,

1. The Local Board for the district of Bideford, in the county of Devon,
shall be empowered to put in force, with reference to the lands referred
to and described in the schedule to this Order annexed, the powers of 35
the Lands Clauses Consolidation Act, 1845, with respect to the purchase
and taking of land otherwise than by agreement for the purposes herein-
before set forth and described.

Given under my hand this second day of April one thousand
eight hundred and sixty-nine.

The Pieces of Land proposed to be taken as described in the foregoing Order are the following; and the numbers in column 1 refer to those on the Plan accompanying the Petition of the Local Board aforesaid,

A.D. 1869.

BOURNEMOUTH.

Provisional Order altering the Bournemouth Improvement Act, 1856. WHEREAS the Commissioners acting under the Bournemouth Improvement Act, 1856, as the Local Board in and for the district of St. Peter, Bournemouth, in the parishes of Christchurch and Holdenhurst, in the county of South- 5 ampton, have, in pursuance of the provisions of the Local Government Act, 1858, and after complying with the requirements thereof, duly presented a Petition to one of Her Majesty's Principal Secretaries of State for alteration and repeal of their Local Act:

And whereas after due inquiry and report by Arnold Taylor, Esquire, 10 the Inspector appointed by me for the purpose, I am of opinion that the prayer of such Petition should be granted, so far as is herein-after set forth; but the same cannot be done without the consent of Parliament:

Now, therefore, in pursuance of the power now vested in me as one of Her Majesty's Principal Secretaries of State as aforesaid, I do hereby, by this 15 Provisional Order under my hand, direct as follows:

That from and after the passing of any Act of Parliament confirming this
Order,-

1. The sections of the Local Act aforesaid numbered respectively 3 and 5,
fixing the number of the said Commissioners and the manner of their 20
election, shall be and the same are hereby altered by the substitution in
section 3 of fourteen for thirteen as the number of the said Com-
missioners, and by the substitution in section 5 of the words "in
manner prescribed by the Local Government Act, 1858," for the
words "in manner prescribed by the Commissioners Clauses Act, 25
1847," and the incorporation of the Commissioners Clauses Act, 1847,
with the said Local Act, by the 7th section thereof, shall not extend.
to the provisions of the said Commissioners Clauses Act prescribing
the manner of election.

2. The section of the Local Act aforesaid numbered 19, and incorporating 30
the Harbours, Docks, and Piers Clauses Act, 1847, shall be and the
same is hereby altered by excepting from such incorporation sections
from 14 to 19 of the said Harbours, Docks, and Piers Clauses Act,
1847, and by omitting the proviso of the said 19th section, that the
said Commissioners need not provide a tide and weather gauge.

3. The section of the Local Act aforesaid numbered 20, giving power to
levy tolls on the pier constructed under the powers of the said Act,
shall be and the same is hereby altered by inserting before the proviso
of the said section the words "the Commissioners shall have power
"from time to time by byelaws to be published, deposited, and con- 40
"firmed by the Secretary of State in the same manner as byelaws
"under the Local Government Act, 1858, to regulate the use of the
"said pier, and to restrict the same to such purposes as they shall
"think fit."

4. The section of the Local Act aforesaid numbered 26, incorporating A.D. 1869.
certain sections of the Markets and Fairs Clauses Act, 1847, shall be
altered by excepting from such incorporation the section of the said
Markets and Fairs Clauses Act numbered 13, and prohibiting under
a penalty sales elsewhere than in the market.

5.-The sections of the Local Act aforesaid numbered respectively 9, 10, 11,
12, and 30 to 36, both inclusive, shall be and the same are hereby
repealed.

Given under my hand this ninth day of April in the year one
thousand eight hundred and sixty-nine.

BOWNESS.

Provisional Order for altering the Boundaries of the District of Bowness in the County of Westmoreland under the Provisions of the Local Government Act, 1858.

WHEREAS a petition has been duly presented to one of Her Majesty's Principal Secretaries of State, under the provisions of the 77th section of the Local Government Act, 1858, signed by owners of a certain portion of the district of Bowness in the county of Westmoreland herein-after described, 20 and to which the Local Government Act, 1858, does not extend, praying for the addition to such district of Bowness of all that part of the Kendal turnpike road leading from Kendal to Ferry Nab on Windermere Lake marked D to E on the plan accompanying the aforesaid petition, and described therein, and for the addition to the district of Bowness aforesaid of the herein25 before mentioned portion of such road:

And whereas it appears expedient to issue a Provisional Order in relation to the said matters, but no such Order can be valid without confirmation by Parliament:

Now, therefore, in pursuance of the powers vested in me by the said Local 30 Government Act, I, as one of Her Majesty's Principal Secretaries of State, do, by this Provisional Order under my hand, direct,

That from and after the passing of any Act of Parliament confirming this
Order,-

1.-The district of Bowness aforesaid, in which the Local Government Act,
1858, is now in force, be altered by the addition to the said district of
the portion of the turnpike road from Kendal to Ferry Nab on Win-
dermere Lake that lies between the points marked D and E on the plan
accompanying the petition aforesaid.

2. At every election of members of the Bowness Local Board aforesaid,
which shall take place after the passing of the Act of Parliament
confirming this Order, the members to be elected shall be elected for
the whole of the district of such Board, as altered by this Order, and
