STATEMENT OF THE MANAGERS ON THE PART OF THE HOUSE

The managers on the part of the House at the conference on the disagreeing votes of the two Houses on the amendments of the Senate to the bill (H. R. 4278) to provide for the control and eradication of certain animal and plant pests and diseases, to facilitate cooperation with the States in fire contro, to provide for the more efficient p otection and management of the national forests, to facilitate the carrying out of agricultural conservation and related agricultural programs, o facilitate the operation of the Farm Credit Administration and the Rural Electrification Administration, to aid in the orderly marketing of agricultural commodities, and for other purposes, submit the following statement in explanation of the effect of the action agreed upon by the conferees and recommended in the accompanying conference report:

Amendment No. 1: This amendment adds to title III of the bill a new section which authorizes appropriations to enable the Secretary of Agriculture, through the War Food Administration, to continue to carry out for each of the fiscal years 1944-45 and 1945-46, the rural-rehabilitation program of the Farm Security Administration in the manner provided in the Department of Agriculture Appropriation Act, 1944, under the item "Loans, grants, and rural-rehabilitation,' with a proviso that no part of the sums authorized to be appropriated by this section shall be available for the promotion or aid of any program of medical care which prevents the patient from having the services of any practitioner of his own choice so long as there is compliance with State laws. The House recedes with an amendment limiting the continuance of such program to the fiscal year ending June 30, 1945.

Amendment No. 3: This amendment adds to title IV of the bill a new section which authorizes the continuation for 2 years of the schoollunch program by the Secretary of Agriculture, through the War Food Administration, in the same manner as it is now being administered. The amendment makes available fo this purpose, during the fiscal years ending June 30, 1945, and June 30, 1946, funds appropriated by and pursuant to section 32 of the act of August 24, 1935, as amended, and also authorizes the appropriation of such additional funds only for the year ending June 30, 1945, as the Congress may deem necessary. The House recedes with the following amendments:

(1) An amendment limiting the expenditures which may be made during the fiscal years ending June 30, 1945, and June 30, 1946, for the school-lunch program to not more than $50,000,000 of the funds appropriated by and pursuant to section 32 of the act of August 24, 1935, as amended.

(2) An amendment limiting the amount which may be expended by the Secretary of Agriculture in any State during any fiscal year for the school-lunch program to an amount not exceeding the amount furnished by the State or local school authorities of such State for such purpose.

(3) An amendment which strikes out the language which limits the authorization of additional amounts for the school-lunch program to the fiscal year ending June 30, 1945.

(4) An amendment adding an additional paragraph to section 403 of the bill. This paragraph further amends section 32 of the act of August 24, 1935, as amended, so as to make available, until expended, sums appropriated by such section.

The Committee on Claims, to whom was referred the bill (S. 1355) for the relief of Robert C. Harris, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

The facts will be found fully set forth in Senate Report No. 699, Seventy-eighth Congress, second session, which is appended hereto and made a part of this report.

The purpose of the proposed legislation is to appropriate the sum of $4,435 to Robert C. Harris, of Fort Hancock, N. J., in full settlement of all claims against the United States for loss of wages, medical and hospital expenses, and personal injuries sustained by him on March 17, 1943, when the automobile which he was driving was struck by a United States Army truck.

STATEMENT OF FACTS

The report of the War Department states that "on March 17, 1943, at about 9:30 a. m., an Army -ton carry-all, operated by an enlisted man on official business, was proceeding east on Rumson Road about 2 miles from Rumson, N. J., at a speed variously estimated at from 35 to 50 miles per hour. The highway had a 12-foot macadam pavement, which was wet and slippery because of recent rain, but visibility was good. As the Army driver approached a sharp curve in the road he reduced his speed to approximately 30 miles per hour and swung wide on the curve. While rounding the curve his right wheels left the pavement and struck the soft shoulder., The Army driver brought his vehicle back on the pavement, but it then began to skid from one side of the road to the other, and he finally lost control of the machine. At the same time a 1942 Willys pick-up truck, owned by the International Committee of the Young Men's Christian Association, 347 Madison Avenue, New York, N. Y., and operated by Robert C. Harris, was proceeding west on Rumson Road, traveling on its proper side of the highway at a speed of from 25 to 30 miles per hour. Mr. Harris H. Repts., 78–2, vol. 3- -45
