AN ORDINANCE For regulating the markets of the towns of Quebec and Montreal. T is ordained and enacted by his excellency the captain general and governor in chief of this province, by and with the advice and confent of the legislative council of the fame, that from and after the publication of this ordinance, all kinds of live ftock (horned cattle excepted) and all kinds of provifion and provender whatfoe ver, which fhall be brought to the towns of Quebec and Montreal for fale, fhall be carried to the public market places of these towns, and there exposed; and if any butcher, huckster or other person, buying to fell again, shall buy or contract for, or cause to be bought or contracted for, any kind of provifion or provender in the road, or in the street, coming to market; fuch butcher, huckfler, or other perfon, buying to fell again, fhall for every fuch offence, forfeit the fum of five pounds; and any perfon who does not buy to fell again, fhall, if guilty of the faid offence, forfeit the fum of twenty fhillings. And if any perfon whatfoever fhall diffuade or deter any perfon from bringing any kind of provifion or provender to market, or from felling the fame when brought to market, or fhall perfuade any perfon to enhance the price of fuch provifion or provender; fuch perfon, fo offending therein, fhall forfeit the fum of five pounds. II. No butcher, huckster, or other perfon buying to fell again, fhall, on any pretence, purchase or contract for, or caule to be purchased or contracted for, any kind of provifion or provender brought to the market of either of the faid towns, before the hour of ten in the forenoon, from the first day of May to the thirtieth day of September, nor before the hour of twelve at noon, from the first day of October to the thirtieth day of April; under a penalty on such butcher, huckster, or other perfon buying to fell again, before the faid hours, of five pounds for every fuch offence. Et fi quelques Bouchers, Regratiers ou tous autres qui achetent, pour revendre, achetent ou retiennent, ou font acheter ou retenir aucunes efpéces de denrées ou fourages dans les chemins ou dans les rues venants aux marchés, tels Bouchers, Regratiers ou tous autres qui acheteront pour revendre, encourront pour chaque contravention l'amende d'une fomme de Cinq livres; et tous autres qui n'acheteront point pour revendre, s'ils font coupables de telles contraventions encourront l'amende de Vingt fhellings. Et fi qui que ce foit détourne ou empêche quelqu'un d'aporter toutes elpéces de denrées ou de fourages au Marché, ou de les vendre étant dans les Marchés, qu'un d'aporter ou qui engagera à furfaire le prix de telles denrées ou de tels fourages, tel contrevenant encourra l'amende d'une fomme de Cinq livres.. II. Aucuns Bouchers, Regratiers ou autres qui achetent pour revendre, n'acheteront fous quelque prétexte que ce foit, ne retiendront, ou ne feront acheter et retenir aucunes fortes de denrées et de fourages apportées fur les marchés d'aucunes des dites villes, avant dix heures du matin depuis le premier Mai jufqu'au trente Septembre, ni avant midi depuis le premier Octobre jufqu'au trente Avril, à peine contre tels Bouchers, Regratiers, ou autres qui acheteront pour revendre avant les dites heures, de Cinq livres d'amende pour chaque contravention.. III. Tout particulier qui aportera dans l'une ou l'autre des dites villes des animaux vivans ou toutes autres efpéces de denrées ou fourages, dans des goëlettes, batteaux ou autres chaloupes, aura la liberté de les vendre à bord une heure après que l'huiffier crieur en aura, au fon de la cloche, averti les habitans de la ville. Tout particulier qui achetera quelqu'un des articles ci-dessus à bord, avant le dit avertiffement, encourra l'amende d'une fomine de Vingt fhellings; et tout Boucher, Regratier ou autre qui achete pour revendre n'achetera aucunes telles denrées ou fourages que trois heures après tel avertiffement, à peine de Cinq livres d'amende pour chaque contravention. Amende contre les regratiers, &c. qui acheteront fur les chemins. Amende contre tous autres. Amende pour empêcher quelles denrées aux marchés. V Toute viande foufflée ou frauduleufement accommodée, tout veau au deffous de l'age de trois femaines, et toutes viandes, poiflons ou autres provifions que ce foient, gatés, feront confifqués pour en être difpofé de la maniére que le Commiffaire de la paix, devant qui la plainte en fera faite, l'ordonnera. All penalties and forfeitures incurred by offences against this ordinance, fhall be recovered by information before any one commiffioner of the peace, who fhall hear and determine the fame in a fummary manner, upon the oath of one credible witnefs (being fome other than the informer) and fhall caufe the fum forfeited, together with the cofts of fuing for the fame, to be levied by a warrant under his hand, to seize and fell the goods of the offender; one half of fuch forfeitures (except in the cafe of the fifth article) shall belong to his Majefty the King, and the other half to the informer. And it shall be lawful for any commiffioner of the peace, to convict any perfon, be on view, by a guilty of any offence against this ordinance, on his own view of fuch offence; in which cafe, the whole forfeiture (except in the case mentioned in the fifth article) shall belong to his faid Majefty. Conviction may semmifhoner of the peace. Profecutions to commence within fifteen days. All profecutions for offences against this ordinance, shall be begun within fifteen days from the commiffion of the offence.
