GENERAL FOOD STATUTES

Adulteration.-Provisions follow the national statute.
Preservatives-Colors.-General provisions of national statute except as

noted below:

Misbranding.-Provisions vary somewhat from the national. addition to the drugs mentioned in the national statute, the quantity or proportion of alcohol, phenacetin (acetphenetidine), antipyrine or any other of the coal tar preparations and belladona must be stated on the label. The clause relating to mixtures and compounds differs from the national statute.

Rules and regulations—standards.-Governor may appoint a deputy commissioner who shall from time to time promulgate such rules and regulations as are necessary and proper to enforce the law. There is no provision expressly authorizing the adoption of standards.

Weight or measure branding.-All food products in package form must be branded on the main label to show the net weight, measure or numerical count of the contents. Packages put up by the retailer are exempted.

All goods sold by weight, packed in kegs, barrels, tierces, casks, boxes, hogsheads or any case whatever, shall be marked with the gross and net weight.

Non-standard boxes of berries and small fruits must be labeled with a statement of the net contents.

Guaranty.—No dealer shall be prosecuted when he can establish a bona fide guarantee signed by a party in Nebraska and that he had no knowledge of the adulteration or misbranding at the time the food was purchased.

Hearings. No provision in the statutes.

SPECIAL FOOD STATUTES

There are special provisions as to non-alcoholic beverages, syrups, cider, cold storage, dairy products, flour and vinegar.

NEVADA

The food law is enforced by the Board of Control of Nevada Agricultural Experiment Station. Address: Reno.

GENERAL FOOD STATUTES

Adulteration.—Provisions follow the national statute with few exceptions. Clause as to external preservatives is omitted and food is also deemed adulterated if not at all times protected from filth, flies, dust or other contamination.

Preservatives—Colors.—General provisions of national statute except as above stated.

Misbranding.-Provisions substantially follow the national statute. Clauses regarding compounds and mixtures omitted.

Rules and regulations-standards.-The Commissioner of the Nevada Agricultural Experiment Station is authorized to make rules and regulations for the enforcement of the act and the board of control of said experiment station may adopt and fix standards of purity, quality or strength when such standards are not fixed by statute.

"The standard of purity of foods, drugs and liquors shall be that proclaimed by the Secretary of the United States Department of Agriculture and the regulations and definitions adopted for the enforcement of the National Food and Drugs Act of June 30, 1906, shall be adopted by the Nevada Agricultural Experiment Station for the enforcement of this act."

Weight or measure branding. All commodities in package form, including food products, must be labeled with the net weight, measure or numerical count of the contents. A slight variation is permissible provided such variation is as often above as below the amount stated, and it is provided that the usual and ordinary evaporation, leakage or waste shall be considered. The word “package” is defined. The statute does not apply to commodities which have been previously sold by net weight, measure or count and which are put into the package for the purposes of delivery and transportation.

Butter, berries and small fruits when not in standard containers must also be labeled to show the net weight.

Guaranty. No restriction on residence of guarantor.

Hearings. Notice and copy of findings shall be given to party from whom sample was obtained or to guarantor, and a hearing granted.

SPECIAL FOOD STATUTES

There are special provisions as to dairy products and bread.

NEW HAMPSHIRE

The food law is enforced by the State Board of Health. Address: Concord.

GENERAL FOOD STATUTES

Adulteration.-Provisions follow the national statute except as

noted below.

Preservatives.-Food is deemed adulterated if it contains any added antiseptic or preservative substance except common table salt, saltpetre, cane or beet sugar, vinegar, spices, or wood smoke. External preservatives may be used as provided in the national statute. Not more than 1/10 per cent. of benzoate of soda is permitted in cider, tomato catsup, fruit jams, jellies or preserves and such other perishable articles as the State Board of Health may determine cannot be successfully marketed without such preservative, but in all cases the presence and percentage thereof shall be stated on the label and if size of package permits, in at least 8-point cap type. Wood alcohol in food is prohibited. Colors.-General provisions of national statute.

Misbranding.—Provisions follow the national statute.

Rules and regulations-standards.-The State Board of Health shall make rules and regulations for the enforcement of the act. There is no provision expressly authorizing the adoption of standards.

Weight or measure branding.—Food in package form must be labeled with the weight, measure or numerical count of contents. Reasonable variations shall be permitted. Tolerances and also exemptions as to small packages shall be established by the State Board of Health.

Guaranty.— Must be to the effect that the article in original and unbroken packages is not adulterated or misbranded within the meaning of the act. Guarantor must reside in the United States.

Hearings. No provision in the statutes.

SPECIAL FOOD STATUTES

There are special provisions as to bread, candy, cider, dairy products, maple products and vinegar.

NEW JERSEY

The food law is enforced by the State Board of Health. Address: Trenton.

GENERAL FOOD STATUTES

Adulteration.-Similar to national statute.

Preservatives-Colors.-General provisions of the national statute. Misbranding.—Provisions differ slightly from the national statute. Acetphenetidine, phenacetin and antipyrine are added to the list of drugs which, when forming part of the contents of a package must be so stated on the label.

Rules and regulations—standards.-The State Board of Health is authorized to adopt and enforce such rules and regulations as shall promote the purposes of the act and may adopt the national standards of purity, quality and strength. Such standards when adopted shall be published at the end of the session laws. Cease to be operative when changed by national officials.

Unlawful to sell or manufacture any article of food which differs in purity, quality or strength from the standard so adopted and published.

Weight or measure branding.-Food in package form must be labeled with the weight, measure or numerical count of contents. Reasonable variations shall be permitted. The State Board of Health shall fix such tolerances and exemptions as to small packages as shall have been or may hereafter be fixed by the Secretary of the Treasury, the Secretary of Agriculture and the Secretary of Commerce and Labor of the United States and publish them at the end of the session laws. Guaranty.—No dealer shall be prosecuted provided the article of food or drug is sold in the original, unbroken package in which it was received from the dealer and, in case of an article purchased from a party residing in New Jersey, he can establish a guaranty signed by such party to the effect that the same is not adulterated or misbranded within the meaning of this act, designating it; or if the article was purchased from a party residing in the United States but outside of New Jersey and the dealer can establish a guaranty, signed by such party to the effect that the same is not adulterated or misbranded within the meaning of the national law; provided, however that that law as to the article guaranteed is identical with the New Jersey law. Hearings. No provision in the statutes.

SPECIAL FOOD STATUTES

There are special provisions as to dairy products, meal, grain, fruit, vegetables, condensed skimmed milk, non-alcoholic beverages, bread, cold storage, eggs, herring, honey, meat products, lard, and vinegar.

The food law consists of various general provisions which do not follow the form of the national statute. Communications should be addressed to Attorney General, Santa Fe.

GENERAL FOOD STATUTES

Adulteration. The general provisions contain much of the substance of the national statute and nothing that seriously conflicts therewith.

Misbranding.—The general provisions contain nothing that seriously conflicts with the national statute.

Rules and regulations-standards. No provision in the

statutes.

Weight or measure branding.—There is no general provision requiring the weight or measure to be stated. Special laws, however, require weight branding on non-standard containers for small fruits, butter, etc.

Containers of mill products must be branded with the weight of contents in letters and figures not less than one inch in length and not less than one-sixteenth inch in width.

Guaranty. In certain cases of adulteration the dealer is protected if he had no knowledge of the adulteration. Hearings.—No provision in the statutes.

SPECIAL FOOD STATUTES

There are no special statutes of importance except those mentioned above under "Weight or measure branding."
