Present: Senators Sutherland (chairman) and Chamberlain and Hon. Reuben O. Moon, Member of the House of Representatives; also the secretary, Launcelot Packer, Esq. The CHAIRMAN. At the last session of Congress a law was passed providing for the appointment of a joint commission, consisting of two members of the Senate, two Members of the House, and two members to be appointed by the President, for the purpose of making an investigation of the subject of employers' liability and workmen's compensation. The commission heretofore met and made a division of the work, appointing a portion of its members as a subcommittee on the law and the remaining members a subcommittee on the questions of fact. This meeting has been called for the purpose of hearing what any interested parties may have to say with respect to the law applicable to the questions which have been submitted to the commission. Unfortunately some of the members of the commission are unable to be here, but we have received word from some of them that they will be here a little later, and in the meantime they request that we go ahead. I see a number of gentlemen present. There has been no program arranged, so I will ask whether or not there is anyone present who desires to be heard upon the subject matter for which this hearing has been called? STATEMENT OF ALFRED P. THOM, ESQ., GENERAL COUNSEL SOUTHERN RAILWAY CO. Mг. THOм. Mr. Chairman and gentlemen, I am general counsel of the Southern Railway Co. The railroad companies of the country, having learned of the investigation that was to be made by this commission, have undertaken to give consideration to the question through their own counsel; and to that end a committee has been appointed consisting of counsel from various portions of this country-seven from the western portion of the country, seven from the eastern, and seven from the southern-making a committee of 21, on which, however, there are two vacancies. This committee of 21 has taken up the question in both its legal and its economic features and have been studying it, in order that it might afford such assistance as was possible to this commission in arriving at some just conclusion. It appointed a subcommittee to assemble the facts and to study the law; and having received notice from the commission that a meeting would be held to-day, the full 30198°-S.
