Inclosing Lands in the Parish of Bampton, in the
County of Oxford.

[Royal Affent, 5 May 1812.]

#HEREAS there are several Open and Common Fields, Preamble. and other Commonable and Waste Lands, and old inclosed Lands and intermixed Grounds, within the several Townships or Hamlets of Bampton, Weald, and Lew, in the Parish of Bampton, in the County of Oxford:

And whereas the Right honourable Charles Earl of Shrewsbury, and the Honourable John Coventry, are Lords of the Manor of Bampton, which extends over the said several Townships or Hamlets:

And whereas the Dean and Chapter of the Cathedral Church of Saint Peter in Exeter are Lords of the Manor of Bampton Deanery in the said Parish of Bampton, and are also Impropriators of the Great and Small Tythes arising and renewing from and out of certain Lands in the said Townships or Hamlets, subject to Two subsisting Leases for Twenty-one Years each, of the said Manor and Tythes respectively, the beneficial Interest in which Leases now belongs to Edward Whitaker, Esquire; and the said Dean and Chapter are also entitled to the Tythes issuing and renewing out of certain Pasture Lands in the said Townships, or Hamlets of Bampton and Weald, held by Lease for Twenty-one Years by Joseph Carter, Gentleman:

And

And whereas the Reverend Robert Hughes, Clerk, is Rector of Yelford in the said County, and as such is entitled to the Great and Small Tythes arising and renewing in and upon certain Lands in the said Hamlet of Lew; and Charles Bourchier, Esquire, is also entitled to certain Great Tythes arising and renewing in and upon certain other Lands in the same Hamlet:

And whereas the said Dean and Chapter are Patrons of the Vicarage of the Parish Church of Bampton aforesaid; and the Reverend George Richards, Hugh Owen and Thomas Burrow, Clerks, are the present Vicars and Incumbents of the Vicarage and Parish Church of Bampton aforesaid, and as such are entitled to certain Glebe Land; and also to the Remainder of all the Great and Small Tythes arising and renewing within the said several Townships or Hamlets of Bampton, Weald, and Lew:

And whereas the Reverend James Tyrrell, Clerk, as Vicar of the Vicarage and Parish Church of Beedon, in the County of Berks, is entitled to certain Land and Right of Common in the said Township or Hamlet of Bampton :

And whereas the said Earl of Shrewsbury, John Coventry, Edward Whitaker, Caroline Anne Horde, Spinster, and others, are Owners and Proprietors of the said Common Fields, Commonable Lands, and of all inclosed Lands and Grounds within the said several Townships or Hamlets:

And whereas an Act was passed in the Forty-first Year of the Reign of His present MAJESTY, intituled, "An Act for consolidating "in one Act certain Provisions usually inserted in Acts of Inclosure, "and for facilitating the mode of proving the several Facts usually required on the passing of such Acts :"

And whereas the said Common Fields and Commonable Lands lie intermixed and dispersed, and in their present state are incapable of any considerable Improvement; and it will be advantageous to the several Proprietors thereof, and Persons interested therein, to have the same divided and allotted among them in specific Shares, and to have their several Allotments inclosed, and their old Inclosures discharged from Tythes; Bur as such several Purposes cannot be effected without the Authority of Parliament;

May it therefore please Your MAJESTY,

That it may be Enacted; And be it Enaded by the KING' Most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, That Stephen Godson, of Hook Norton in the County of Oxford, Richard Davis, of the Parish of Lewknor in the said County of Oxford, and William Collisson, of Brackley in the County of Northampton, Gentlemen, and their Successors to be appointed in manner hereinafter mentioned, shall be and they are hereby appointed Commissioners for dividing, allotting, and directing the Inclosure of the said Common Fields, Meadows, Pastures, and Commonable Lands, and for exercising the other Powers, and executing all the Trusts hereby reposed in them, subject to the Rules, Orders and Directions of the said recited Act, (except where the same are hereby varied or altered); and that all acts, matters and things authorized and directed to be done or executed by the said Commissioners, may be done and executed by any Two of them; and the same shall be as valid and effectual as if done and executed by all the said Commissioners.

And be it further Enacted, That in case any or either of the said Commissioners hereinbefore named and appointed, or to be appointed as hereinafter is mentioned, shall, previous to the finishing and completing of the said Division and Allotnient, or before the execution of the Award, die, neglect or refuse to act, or become incapable of acting as a Commissioner in the execution of this Act, a new Commissioner or Commissioners shall and may be nominated, elected and appointed in manner following; (that is to say) if the said Stephen Godson shall die, neglect or refuse to act, or become incapable of acting as aforesaid, the surviving or remaining Commissioner or Commissioners shall within Ten Days next after such Death, Neglect, Refusal or Incapability shall be known to him or them, give Notice thereof in writing to the said Earl of Shrewsbury, and John Coventry, their Heirs or Assigns, or their known Agents; and thereupon it shall be lawful for the said Earl of Shrewsbury and John Coventry, their Heirs or Assigns, at any time within Fourteen days after such Notice, by any writing under their Hands and Seals, to appoint one other Commissioner (not interested in the said Division, Allotment aud Inclosure) in the room of the said Stephen

Godson, and so from time to time as often as any Commissioner to be appointed by the said Earl of Shrewsbury and John Coventry, their Heirs or Assigns, shall die, neglect or refuse to act, or become incapable of acting as aforesaid, and if the said Richard Davis shall die, neglect or refuse to act, or become incapable of acting as aforesaid, it shall and may be lawful for the major part in Value (to be ascertained by the Land Tax Assessment in the said Townships or Hamlets) of the other Proprietors of the Lands and Grounds directed by this Act to be divided, allotted or inclosed, or for the known Agents or Attornies of any of them (except the said Earl of Shrewsbury and John Coventry) who shall be present at a Meeting to be held for that purpose at some place in Bampton aforesaid, in pursuance of Notice, to be advertised by the surviving or remaining Commissioner or Commissioners, in one or more Newspapers published or circulated in the said Country of Oxford, and affixed on the principal Door of the Parish Church of Bampton, at least Fourteen days before such Meeting, to appoint One other Commissioner (not interested in the said Division, Allotment or Inclosure) in the room of the said Richard Davis, and so from time to time as often as any Commissioner to be appointed as last aforesaid shall die, neglect or refuse to act, or become incapable of acting as aforesaid; and if the said William Collison shall die, neglect or refuse to act, or become incapable of acting as aforesaid, it shall and may be lawful for the said Dean and Chapter, and the said Edward Whitaker as Lessee of the Tythes as aforesaid, and the said Vicars and their Successors, to appoint One other Commissioner (not interested in the said Division, Allotment and Inciosure) in the room of the said William Collison, and so from time to time and as often as any Commissioner to be appointed by the said Dean and Chapter, and the said Edward Whitaker, and the said Vicars or their Successors, fhall die, neglect or refuse to act, or become incapable of acting as aforesaid; and in case the said respective Parties, or any of them, shall make default in appointing a new Commissioner within the times, or at the said Meeting respectively as aforesaid, it shall be lawful for the surviving or remaining Commissioner or Commissioners, and he and they is and are hereby required, by writing under his or their hand or hands, to appoint a new Commissioner (not interested in the said intended Division and Inclosure) in the room of such Commissioner so dying, neglecting or refusing to act, or becoming incapable of acting as aforesaid, and the several Writings appointing such new Commissioner or Commissioners (if any) shall be annexed to and deposited with the Award to be made by the said
