Note 302 Anfwer of the Dutch Governor to the Summons fent for the Surrender of Fort Oftenburgh.

Hon. Excellency, Jan. 9, 1782. In answer to your Excellency's letter of fummons of the 9th of this month, received by me, but now a little before feven o'clock in the morning; I have to inform you, that, by every poffible means in my power, it is my duty to be faithful to my mafter, and for that reason I have resolved not to furrender Fort Oftenburgh, but to defend it to the last against all attempts that may be made to take it. The Governor, 1 Captain, 2 Lieutenants, 3 Enfigns, 250 European infantry, 1 Captain Lieutenant and Engineer, 2 Subalterns, 50 European artillery, 55 feamen from the fhips, and ten artificers, 1 Captain, I Lieutenant, 2 Enfigns, Malays.

In the harbour we found two of the enemy's fhips, one of the Company's, the other private, both richly laden, and several small veffels of no confequence.

Note 308. Articles of Capitulation, agreed upon between Bailli de Suffren de Saint-Tropez, Lieutenant-General in the service of his moft Chriftian Majefty; the Baron d'Agoult, Lieut.-Colonel and Capt. Hay Macdowal, in the service of his Britannic Majesty in Trincomalé.

I. The gate shall be delivered up as foon as the capitulation fhall be figned and approved.

The troops in marching out, fhall pile their arms, artillery, &c. on the glacis.

They shall march out to-morrow at funrife, with matches lighted, two field-pieces fix-pounders, one mortar, and every thing that belongs to them, with twelve charges, and thall be conducted on board of fhip, to be tranfported to Madras, by the fhortest way, in tranfports equipped and victualled for that purpose, at the expence of his moft Chriftian Majefty, and the English shall be victualled on board the fame as the crews of the King's (hips.

II. A particular veffel fhall be destined for the commanding officer, the officers and ftaff, engineer, commiffary, officer of artillery, furgeon, and their fuite. This veffel fhall likewife be victualled, and provided with neceffary conveniences. The faid officers fhall carry with them their papers, without being examined.

The transports shall be ready in ten days, and fooner if poffible, that is to fay, the 10th of September enfuing.

III. The befiegers fhall furnish a fufficient number of Coulis, to carry on board the tranfports the cannon and mortars mentioned in the first article, and the baggage of the officers and foldiers.

IV. The fick and wounded, who fhall not be in a condition to be embarked, and who, by that means, shall be obliged to remain in the place, shall have liberty to go to Mad as, as foon as they shall be able; in the mean time they shall be maintained and lodged at the expence of his mott Chriftian Majefty.

The commanding officer, all the other officers who are under his orders, thofe attached to the garrifon, and in general all those employed in the King's troops or thofe of the Company, shall be allowed to go out of the place at liberty, without being molefted in any manner whatever.

VI. The inhabitants, and all thofe depending on the place, shall be maintained in all their rights, privileges, and prerogatives.

The public magazines fhall be delivered up to the perfon named for that purpose by the commanders of the forces of his most Christian Majelly; but all the effects of individuals fhall be fecured to their prefent proprietors.

VIII. Deferters fhall be pardoned, but they shall be faithfully given up; and no means fhall be employed to oblige the troops, either European or Indian, to enter into the fervice of his moft Chriftian Majefty.

X. The officer commanding the forces of his moft Chriftian Majefty, fhall be refponfible for all the diforders which his troops may

commit.

X. The commanding officer, and all the other officers, fhall have permission to remain in their houses, until the veffel mentioned in the second article is ready to fail for Madras.

XI. The gate fhall be delivered up one hour after the capitulation is granted.

The garrifon fhall march out, as is faid, in article first, to be conducted on board the transport ships.

Finally, the prefent capitulation fhall be executed in all the eleven articles, with reciprocal good faith.
