school trustees of the school corporation of this state so situated are hereby empowered to enter into an agreement with the school authorities of said adjacent school corporation for the purpose of purchasing school grounds, repairing or constructing school building or buildings, purchasing school furniture, equipment, appliances, fuel, employing teachers and maintaining a school when, in the judgment of said school trustee or trustees of this state the best interests of the public school can be promoted by so doing; and such trustee or trustees of this state are hereby empowered to levy taxes and perform such other duties in maintaining such joint school as are otherwise provided by law for maintaining the public schools in this state. In carrying out the provisions of this act the school corporation shall pay such proportion of the cost of purchasing school grounds, repairing or erecting new building or buildings, and in maintaining the joint school as shall seem to be equitable and just in the judgment of the school trustees of the two adjacent school corporations.

Section 2 of this act provides that this act be in force and effect from and after its passage.

4230a. "Evansville College" trustees, powers of corporation.-1. Benjamin Bosse, John J. Nolan, Max J. Merritt, George S. Clifford, Howard Roosa, Wm. H. McCurdy, Francis J. Reitz, Bishop Wm. F. Anderson, E. V. Hawkins, Wilbur Erskine, Richard Rosencranz, L. C. Bentley, Alfred E. Craig, Jas. A. Hemenway, George H. Murphy, D. J. Terhune, John W. Hancher, John S. Ward, George S. Tarbox, E. A. Robertson, and Frank H. Hatfield, as trustees, and their successors be and they are hereby created a body corporate and politic by the name and style, "Evansville College," and by that title to remain in perpetual succession with full power to make contracts, to sue and to be sued, to plead and to be impleaded, to acquire, hold and convey property, both real and personal, manage and dispose of such property and all moneys belonging to said corporation in such manner as shall seem to the trustees best adapted to promote the objects and purposes of said college, to have and to use a common seal, to alter and renew the same at pleasure, to make such by-laws as are consistent with the charter of said college, and in conjunction with the faculty, to confer upon those whom they may deem worthy all such honors and degrees as are usually conferred by colleges and universities.

4230b. Objects of corporation.-2. The objects of such corporation shall be to promote the general interests of education, and to qualify men and women to engage in the several employments and professions of society and to discharge honorably and usefully the

various duties of life. The profession of any particular religious faith shall not be required of any who become students.

4230c. Location.-3. Said college shall be located at or near the city of Evansville, in the county of Vanderburgh, State of Indiana.

4230d. Board of trustees, number and election.-4. The trustees. of said college shall be thirty-six (36) in number, of whom nine (9) shall be elected by the chamber of commerce of the city of Evansville, Indiana, or its successor; eighteen (18) by the Indiana conference of the Methodist Episcopal church, of which last number three (3) may be nominated by the alumni association of said college; and the remaining nine (9) shall be elected by the members of the board of trustees of said college. Said trustees at their first meeting after the passage of this act shall by lot divide themselves into three (3) classes of equal number; in each class there shall be three (3) trustees elected by the chamber of commerce, and six (6) trustees elected by the Indiana conference, and three (3) of those elected by the board of trustees themselves; the term of office of each class shall be one (1), two (2) and three (3) years respectively after the day of said classification, and until their successors are elected and qualified. At the expiration of term of office of said classes in their order, their successors shall be elected in the same manner and by the same authority aforesaid. All of said trustees subsequently elected to be for a term of three (3) years and until their successors are elected and qualified." This section amends section 4, Acts 1919, p. 20.

4230e. Officers, bond of treasurer, quorum.-5. The officers of the trustees elected by them shall be a president, vice-president, secretary, and treasurer. The treasurer before entering upon the duties of his office shall give bond in such penal sum and with such securities as shall be approved by the trustees. Of such trustees fifteen (15) shall constitute a quorum for the transaction of all business, and the majority of members present at any meeting shall determine the action of the board."

This section amends section 5, Acts 1919, p. 20.

Section 3 of the above act provides that the act be in force and effect from and after its passage.

4230f. Faculty, tuition and fees, vacancy on board of trustees.-6. The board of trustees shall have full powers to elect in such manner, and for such time as they deem expedient, a president of the college, together with such professors and instructors as may be at any time necessary to form an efficient faculty for the instruction of students

in the various courses taught, which courses shall be arranged and determined by said trustees in conjunction with the faculty and university senate. No professor nor instructor may be elected by the trustees except upon nomination of the president of the college. Said trustees and faculty shall also fix the rate of tuition and fees to be paid by the students. The president of the college shall be exofficio a member of the board of trustees in addition to those above provided for, and except as to said president, no member of the board shall be a member of the faculty. If, at any time, a member of the board should become a member of the faculty, this shall create a vacancy on the board, and the vacancy shall be filled by the board, until the next regular election by the chamber of commerce or the Indiana conference, as the case may be. The trustees shall meet annually in the city of Evansville, Indiana, in the month of June on such day as the board may determine. Special meetings may be called by the president of the college, the president of the board of trustees, the faculty of the college, any five of the trustees, or the executive committee appointed by the board. Ten days' notice of all special meetings shall be in writing, mailed to all the members of the board of trustees at their last known address. A working majority of the trustees may, at any time, for good cause, declare a vacancy on said board by reason of lack of interest, or otherwise, on the part of any of its members, and appoint his successor, written notice of which action shall be given by mail to the last known address of member retired. Such trustee shall fill such vacancy until such time as the chamber of commerce of Evansville, Indiana, or the Indiana conference, as the case may be, shall fill the vacancy by election.

There is no section 7 reported in this act.

4230g. Funds.-8. The trustees of said college shall faithfully apply all funds collected by them, according to the best of their judgment, in the erection of suitable buildings, purchase of equipment, care of building and grounds, the purchase of property real and personal, and in payment of salaries to instructors, officers and agents. Said trustees shall also have authority to receive for and on behalf of said college, donations, devises, and bequests made either generally for the benefit of the college or for purposes in harmony with objects. of the college.

4230h. Indiana conference of the Methodist Episcopal church.-9. Said college shall be under the patronage of the Indiana conference of the Methodist Episcopal church, and entitled to all the privileges and benefits accruing from time to time to institutions of said Methodist Episcopal church from patronizing conferences.

4230i. Acts of trustees of Moores Hill College legalized.-10. The acts and proceedings of the trustees of Moores Hill college above referred to, made on the fifth day of June, 1917, authorizing the removal of Moores Hill college to Evansville, Indiana, be, and the same hereby legalized and the individuals designated in the first section of this act, are hereby constituted the successors to the board of trustees of said Moores Hill college. Said board of trustees of Moores Hill college, is hereby authorized and empowered to transfer to the trustees of Evansville college upon such terms and conditions as shall be fixed and agreed upon by said boards, the college heretofore maintained at Moores Hill, Indiana, together with all the powers, rights, privileges, franchises, property, claims, trusts and estates appertaining in law or in equity to said Moores Hill college. When said transfer shall be agreed upon by said two boards, and a certificate to that effect signed by the respective presidents thereof shall have been filed in the office of the secretary of state, of the State of Indiana, the trustees of Evansville college shall thereupon take and enjoy all the powers, rights, privileges, franchises, property claims, trusts, and estates appertaining in law or in equity to said Moores Hill college, subject to all the duties, restrictions, and liabilities belonging thereto, and said Moores Hill college shall thereafter remain a corporate body only for the purpose of executing all such transfers, assignments, and conveyances as may be necessary to vest all such rights, property, claim and estates to the trustees of Evansville college, and when so done said corporate existence of said Moores Hill college shall cease, and evidenced by a certificate to that effect, filed with the secretary of the State of Indiana, and the alumni and former students of Moores Hill college shall thereupon automatically become alumni and former students of Evansville college.

4230j. Memorial to John C. Moore.-11. In order to honor and perpetuate the memory of the founder of Moores Hill college, one of the major buildings on the campus shall bear the name of John C. Moore.

Section 12 of this act provides that the act be in force and effect from and after its passage.

4230k. Central Academy, acts legalized.-1. All steps taken, and all acts done, in the proceedings for the incorporation of the Central Academy Association of Plainfield, in Hendricks County, State of Indiana, and that all steps taken in the changing of the relation of such corporation to the Friends Church having control or patronage of it, and the different articles filed in the secretary of state's office relating thereto, be and the same are hereby declared to be legally in

corporated and to be the successor of Central Academy Association, and the election of the board of trustees of said Central Academy as successors to the trustees of said Central Academy Association, are hereby legalized and rendered valid, and that the election of said board of trustees in each instance in the changing of the relation of said corporation to the Friends Church having control or patronage of it are hereby legalized and rendered valid and that the acts of said trustees of said Central Academy Association, Central Academy and the acts of said church, having control or patronage of it are hereby legalized and rendered valid.

Section 2 provides for the immediate taking effect of the act.

4276m.

Associations to prevent and cure diseases of fruit trees.— 1. That horticultural and quarantine districts, to be administered by voluntary associations and their duly elected officers, may be organized, under the provisions of this act, for any or all of the following purposes:

First. To prevent the spread of contagious diseases among fruit, fruit trees and fruit-bearing plants;

Second. To provide for the prevention, treatment, cure and extirpation of fruit pests and diseases of fruit, fruit trees and fruit-bearing plants;

Third. To provide for the purchase and maintenance of spraying machines, wagons or other necessary apparatus to adequately spray fruit trees or other fruit-bearing plants and to hire men and teams to perform the required labor, and to incur the necessary expense to carry out the purposes of this act;

Fourth. To hire experts to inspect the fruit trees and fruit-bearing plants found within such horticultural and quarantine district and to prescribe the proper methods of treatment of any diseases of such trees or plants which may be found to exist.
