House concurrent resolution No. 38: Be it resolved by the Legislature of the State of Texas. that the committee, or other persons, who have the management and control of the erection of a monument to the Confederate dead be, and they are hereby, restrained and prohibited from erecting such monument at the front and end of the walk leading south from the capitol to Congress avenue in the city of Austin.

The provisions of the law as to size of type and thickness of leads to be used in this work have not been observed (strictly speaking), in that the law required the reports to be printed from long primer and minion type. "same States Supreme Court Reports." whereas the type used has been uniformly larger and leads thicker; and said reports are provisions, at a greater cost to the State now being printed contrary to these would entail. than a strict compliance with the law pages to be 26 ems (pica) wide, and we The law also requires the find that the pages of volume 71. Also, That the Postmaster be allowed five days, at five dollars per day. for the purpose of arranging the postoffice, and of receiving and forwarding all mail.

Also, that the Calender Clerk be allowed ten days at four dollars per day for the purpose of properly posting up the cal

endar.

Also, that the Journal Clerk be allowed forty-five days at five dollars per day for the purpose of indexing the Journal,

etc.

Also that the Assistant Journal Clerk be allowed thirty-five days at five dollars per day for the purpose of assisting the Journal Clerk.

Also, that the Enrolling Clerk be allowed three days and the Engrossing Clerk be allowed three days at four dollars per day each for the purpose of transferring to the Chief Clerk all books, bills, etc., on hand at close of session.

Be it further resolved, That the Speaker and Chief Clerk be authorized to draw all of above named certificates for the pay of the respective officers on the date of final adjournment and deliver same to the respective parties.

The resolution was read second time, and

Mr. Robbins moved that it be referred to the Committee on Contingent Expenses.

Mr. Allen of Dallas moved to table the motion to refer, and the motion to table was lost.

The motion of Mr. Robbins to refer prevailed, and the resolution went to the Committee on Contingent Expenses.

Senate bill No. 217, providing for a school of dentistry in the medical department of the University of Texas. and the motion to suspend was lost.

By unanimous consent, Mr. O'Connor offered the following resolution:

Whereas, The several clerks of the House are being paid $4 and $5 each per day: and

Whereas, Earl Smith, the clerk in the Sergeant-at-Arms' office, has been and is being paid only $3 per day; and

Whereas, The said Smith, like all the other Smiths. has been a faithful officer and has proven himself worthy, efficient and true to his trusts; and

Mr. Smith of Brazos offered the following amendment:

Whereas. The following officers of the House, viz: Reading Clerk, Assistant Reading Clerk, Calendar Clerk, Engrossing Clerk. Enrolling Clerk, Doorkeeper and Assistant Doorkeeper, Assistant Sergeant-at-Arms. and Chaplain, have been faithful, efficient, and vigilant in the discharge of every duty; therefore, be it

Resolved, That they are entitled to the same compensation that has been paid the other officers of this House. and the Chief Clerk is hereby instructed to issue to each of the above named officers a certificate for one dollar per day for each day of the session, to be paid out of the amount heretofore appropriated for mileage and per diem of the Twentyfourth Legislature.
