(2) the effect on safety, health, and convenience of

the passengers of such vehicles if such operators are authorized to use such radios.

(b) The Secretary of Transportation shall request the 5 National Academy of Sciences to submit to the Secretary and 6 the Congress, within six months after entering into arrange7 ments with the National Academy of Sciences for conducting 8 the study under subsection (a) of this section but in no case 9 later than one year after the effective date of this Act, a 10 report on the results of such study along with its recommen11 dations concerning whether operators of motor vehicles pro12 viding transportation of passengers should be allowed to use 13 citizen band radios. The Secretary shall furnish to such 14 Academy, at its request, any information which such Acade15 my deems necessary for the purpose of conducting such 16 study.

(c) Not later than sixty days after the National Academy 18 of Sciences submits its report to the Secretary of Transporta19 tion under subsection (b) of this section, the Secretary of 20 Transportation shall initiate a rulemaking proceeding to de21 termine whether operators of motor vehicles providing trans22 portation of passengers subject to the jurisdiction of the In23 terstate Commerce Commission under subchapter II of chap24 ter 105 of title 49, United States Code, should be allowed to 25 use citizen band radios in such vehicles. In making such de

1 termination, the Secretary of Transportation shall give sub2 stantial weight to the recommendations and conclusions of 3 the National Academy of Sciences. Such rulemaking pro4 ceeding shall be completed not later than one hundred and 5 twenty days after such proceeding is commenced. If the Sec6 retary issues a rule or regulation which recommends that op7 erators of such vehicles be allowed to temporarily install and 8 operate citizen band radios in such vehicles, the Secretary of 9 Transportation shall issue regulations establishing guidelines 10 for the use of such radios in such vehicles in order to ensure 11 that the public safety is adequately protected.

(d)(1) Subchapter I of chapter 111 of title 49, United 13 States Code, is amended by adding at the end thereof the

14 following new section:

15 "§11111. Use of citizen band radios on buses

16

"(a)(1) A motor carrier of passengers providing

17 transportation subject to the jurisdiction of the Commission 18 under subchapter II of chapter 105 of this title shall allow 19 the operator of any motor vehicle providing such transporta20 tion to temporarily install and operate a citizen band radio in 21 such vehicle if the Secretary of Transportation issues a rule 22 or regulation which recommends that operators of such vehi23 cles be allowed to temporarily install and operate such radios 24 in such vehicles.

1 “(2) Citizen band radios installed and operated in motor 2 vehicles providing transportation of passengers subject to the 3 jurisdiction of the Commission under subchapter II of chapter 4 105 of this title shall be installed and operated in accordance 5 with the guidelines established by the Secretary of Transpor6 tation under section 25(c) of the Bus Regulatory Reform Act 7 of 1981.

"(b) The Commission shall issue such regulations as it 9 considers necessary to carry out this section.".

(2) The analysis for subchapter I of chapter 111 of title

11 49, United States Code, is amended by inserting

"11111. Use of citizen band radios on buses."

12 after

13

"11110. Household goods carrier operations.".

(e) Section 11702(a)(2) of title 49, United States Code,

14 is amended by inserting "or 11111" after "11109".

15 (f) This section shall not be construed to provide new

6 spending authority within the meaning of section 401(c)(2)(A)

7 of the Congressional Budget Act of 1974.

BUS TERMINAL STUDY

SEC. 26. (a) The Secretary of Transportation and the ) Interstate Commerce Commission shall conduct a full investigation and study of the ownership, location, and adequacy of bus terminals and their capacity to provide passenger service in accordance with the transportation policy set forth in sec

1 tion 10101 of title 49, United States Code. A report on the 2 results of such investigation and study, including legislative

3 recommendations, shall be submitted to the President and 4 Congress not later than December 31, 1982.

5 (b) The report under this section shall include an analy6 sis of at least the following:

(1) the pattern of ownership of bus terminals, including public and private ownership;

(2) the desirability of terminals for more than one mode of transportation and their impact on urban development;

(3) the desirability of governmental assistance in the construction of nonurban bus terminals.

EMPLOYEE PROTECTION

SEC. 27. (a)(1) Each individual who is eligible for pro

16 tection under this section and whose employment is terminat17 ed by a motor common carrier of passengers (other than for 18 cause) prior to the last day of the ten-year period beginning 19 on the date of enactment of this Act shall have a right of 20 priority reemployment, in his or her occupational specialty, 21 by such carrier at such time as such carrier is hiring addition22 al employees.

(2) Any motor common carrier of passengers hiring ad24 ditional employees shall have a duty to hire an individual 25 eligible for protection under this section, in his or her occupa

1 tional specialty, before hiring any other individual if such in

2 dividual

(A) was terminated previously by such carrier;

(B) has applied for a vacant position for which such carrier is accepting applications; and

under this section.

(C) at the time the application is filed, has notified such carrier that he or she is eligible for protection

(b)(1) Each individual who is eligible for protection

10 under this section and whose employment is terminated by a 11 motor common carrier of passengers (other than for cause) 12 prior to the last day of the ten-year period beginning on the 13 date of enactment of this Act shall have a right of considera14 tion for employment, in his or her occupational specialty, by 15 any other motor common carrier of passengers who is hiring 16 additional employees.

17 (2) Each motor common carrier of passengers who is 18 hiring additional employees shall have a duty to consider for 19 employment, in his or her occupational specialty, an individu20 al who is eligible for protection under this section if such 21 individual

(A) has applied for a vacant position for which such carrier is accepting applications; and
