pacity, payable to the commonwealth of Kentucky, or in any other manner now binding in law, the penalty of such bend, shall not limit the recovery thereon against the principal and security, or securities ; but they, and each of them, shall he liable according to law. to the full extent of the official obligations of such officer, as the same are enumerated in the condition of such bond.

temt has issued to Edmund Talbot of Henderson county, for two hundred acres of land, dated the tenth of December, one thousand eight hundred and eight, in which the words "poles and ine," are necessary; which words are also omitted in the platt upon which the patent aforesaid issued:

Sec. 1. Be it therefore enacted, That the register of the land office, be empowered and required, to add the word poles after the word forty' in the beginning of the thirteenth line; and line after the word military,' at the end of the thirteenth line of the patent aforesaid; and mend the platt aforesaid, by inserting therein the said word, so as the platt and patent aforesaid, may correspond: Provided, that nothing herein contained shall, in any manner, prejudice the right of any other person.

For the relief of RICHARD EVANS, former Sheriff

of Floyd county.

HEREAS it is represented to the present general assembly, that by an act passed on the 27th day of December, 1806, Richard Evans, late sheriff of Floyd county, was exempted from the payment into the treasury, of one hundred and eighty-three dollars, sixty-three cents, seven mills, being the amount of his delinquent list; and whereas it is also represented, that the present sheriff of said county, is demanding from the securities of said Richard Evans, eighteen per centum per annum, on the said $183 63 7, from the time the tax was due until the passage of the said recited act, amounting to 844 28 7 mills :

BE it enacted by the General Assembly, That the present sheriff of Floyd county be, and he is hereby directed, to credit the execution now in his hands against the said Evans and his securities, for the said sum of $44 28 7, any law to the contrary notwithstanding.

CHAP. CCXIX.

AN ACT

To amend the act entitled an act to amend an act establishing the town of Shepherdsville, and for other pur

poses.

Sec. 1.BE it enacted by the general assembly, That a survey of Shepherdsville, made by James

Shanks, surveyor of Bullitt, and the plan or platt thereof, made out by him, and dated the eighteenth day of July, in the year one thousand eight hundred and nine, be established as the true plan of said town, and of the situation and boundaries of luts, streets and alleys therein and that all disputes or controversies that may arise, relative to their situation or extent, shall be determined by the afore said plan or platt.

CHAP. CCXX.

AN ACT

For the division of Henderson county.

SECT. 1. BThat from and after the first day of

May next, all that part of the county of Henderson,
included in the following bounds, to wit:- Begin-
ring at the upper point of the eighteen mile Island,
formerly called Elk island, on the Ohio river; thence
a straight line, to Highland creek, one mile above
Higgins' mill, measured along the meanders of the
creek; thence up the said creek, to the White-lick
fork thereof; thence a direct and straight line, by
"Harper's Head," to the line of Hopkins county;
thence with that line, to Trade water river; thence
down the same, to the Ohio river; and up the Ohio,
to the beginning, shall be one distinct county, and cal-
led and known by the name of UNION. A court for
the said county, shall be held by the justices thereof,
on the second Monday in every month, in which the
circuit courts are not hereafter directed to be held.

soon thereafter as the said commissioners can; and each having taken an oath, before some justice of the peace, to discharge the duty of a commissioner, in fixing on the seat of justice for the county of Union, without favor, affection, partiality or prejudice, according to the best of his skill and ability, they or a majority thereof, shall proceed to fix on a place for the permanent seat of justice of said county, having due regard to public convenience of water, and situation, as it respects the capacity of the lands in said county, for sustaining present and future popu lation; and having ascertained the place aforesaid, they shall, under their hands, certify the same to Commission the county court. SEC. 3. Be it further enacted, That the circuit court for the said county of Union, shall be held annually, on the first Monday in the months of March, June and September.

SEC. 4. It shall be lawful for the sheriff of Henderson, to collect and make distress for any public dues and officers fees, which shall remain unpaid by the inhabitants of the said county of Union, at the

time such division shall take place, and shall be accountable for the same, in like manner as if this act

had not been made; and the courts of the county jurisdiction of Henderson shall have jurisdiction in all actions of Henderson and suits, either in law or equity, which shall be de. Courts pending before them, at the time of such division;

and shall try and determine the same, issue process, and award execution therein.
