over the territories lying between the River Wanx or Segovia and the Roman River, Her Britannic Majesty agrees to recommend to the Mosquito Indians to renounce any such rights in favour of the Republic of Honduras, on condition of receiving from the Republic some reasonable sum by way of annuity for a limited period to be paid half-yearly, as an indemnity and compensation for the loss and extinction of their interest in the said territory. When such an arrangement shall have been acceded to by the Mosquito Indians, Her Britannic Majesty engages to recognize the sovereignty over the said territory as belonging to the Republic of Honduras; and Her Britannic Majesty and the Republic will, within twelve months thereafter, appoint two Commissioners, one to be named by each party, for the purpose of determining the amount, the period of duration, and the time, place, and mode of payment of the annuity so to be paid to the Mosquito Indians as indemnity and compensation.

And whereas British subjects have, by grant, lease, or otherwise, heretofore obtained from the Mosquito Indians, interests in various lands situated within the territory above described, lying between the River Wanx or Segovia and the River Roman, the Republic of Honduras engages to respect and maintain such interests. And it is further agreed, that the Commissioners mentioned in the present

Cuando se haya accedido por los Indios Mosquitos á tal arreglo, Su Magestad Británica ofrece reconocer la soberania sobre el referido territorio, como perteneciente á la República de Honduras; y Su Magestad Británica y la República nombrarán, dentro de doce meses despues de tal accesion, dos Comisionados, uno por cada parte, para acordar la suma, el periodo de duracion, el tiempo, lugar, y modo en que la anualidad debe ser pagada á los Indios Mosquitos como indemnidad y compensacion.

Y en atencion á que algunos súbditos Británicos han obtenido, por concesion, arrendamiento, ó de otra manera, de los Indios Mosquitos, intereses en varias tierras situadas dentro del territorio referido, entre el Rio Wans ó Segovia y el Rio Romano, la República de Honduras se obliga á respetar y mantener los dichos intereses; y ademas es convenido que los Comisionados mencionados en el presente

Article shall investigate the claims of British subjects arising out of such grants or leases, or otherwise; and all British subjects, whose claims shall by the Commissioners be pronounced well founded and valid, shall be quieted in the possession of their respective interests in the said lands.

III. The Republic of Honduras further engages to carry into effect any agreements already made, and now in course of being carried out, for the satisfaction of British claims; and it is agreed between the Contracting Parties, that the Commissioners mentioned in the preceding Article shall also examine and decide upon any British claims upon the Government of Honduras that may be submitted to them, other than those specified in the preceding Article, and not already in a train of settlement.

IV. The Commissioners mentioned in the preceding Articles shall meet at Truxillo, at the earliest convenient period after they shall have been respectively named, and shall, before proceeding to any business, make and subscribe a solemn declaration that they will impartially and carefully examine and decide, to the best of their judgment, and according to justice and equity, without fear, favour, or affection to their own country, upon all the matters referred to them for their decision; and such declaration shall be entered on the record of their proceedinga.

Articulo investigarán los reclamos de los súbditos Británicos suscitados por tales concesiones ó arrendamientos; y todos los súbditos Británicos cuyos reclamos sean declarados fundados y validos por los Comisionados, permanecerán en quieta posesion de sus respectivos intereses en dichas tierras.

III. Ademas se obliga la República de Honduras llevar á efecto todos los arreglos hechos ya, y que estan en via de ejecutarse, en satisfaccion de los reclamos Británicos; y tambien es convenido entre las Partes Contratantes que los Comisionados mencionados en el precedente Articulo examinarán igualmente y decidirán sobre todos los reclamos Británicos contra el Gobierno de Honduras que se sometan á ellos, ademas de los especificados en el Articulo anterior, y no proximos á un arreglo.

IV. Los Comisionados espresados en los Articulos precedentes se reunirán en el Puerto de Trujillo, en el menos tiempo posible despues que hayan sido respectivamente nombrados; y antes de proceder al desempeño de su encargo, harán y suscribirán una solemne declaracion, manifestando que imparcial y cuidadosamente examinarán decidirán, de la mejor manera que puedan sus actos, conforme á la justicia y á la equidad, sin temor, favor ó afeccion á su pais, sobre todas las materias que se refieran á su decision; y tal declaracion encabezará sus procedimientos.

The Commissioners shall then, and before proceeding to any other business, name some third person to act as an arbitrator or umpire in any case or cases in which they may themselves differ in opinion. The person so to be chosen as arbitrator or umpire shall, before proceeding to act as such, make and subscribe a solemn declaration, in a form similar to that which shall already have been made and subscribed by the Commissioners, and which shall also be entered on the record of the proceedings. In the event of the death, absence, or incapacity of such person, or of his omitting, or declining, or ceasing to act as such arbitrator or umpire, another person shall be named as aforesaid to act as arbitrator or umpire in his place, and shall make and subscribe such declaration as aforesaid.

Her Britannic Majesty and the Republic of Honduras hereby engage to consider the decision of the Commissioners conjointly, or of the arbitrator or umpire, as the case may be, as final and conclusive on the matters hereby referred to their decision; and they further engage forthwith to give full effect to the same.

V. The Commissioners and the arbitrator or umpire shall keep an accurate record, and correct minutes or notes, of all their proceedings, with the dates thereof, and shall appoint and employ a clerk or other persons to assist them in the transaction of the business which may come before them.

Asi mismo los Comisionados, antes de proceder á sus funciones, nombrarán un tercero, para que obre como arbitro en todos los casos en que puedan diferir en opinion. El tercero nombrado como arbitro, antes de proceder como tal, hará y suscribirá una solemne declaracion en la misma forma de la que hayan hecho y suscrito los Comisionados, y que tambien se incluirá en el proceso-verbal, ó acta de sus procedimientos. En caso de muerte, ausencia, ó incapacidad de dicho tercero, ó en el de omision, denegacion, ó cesacion de obrar como tal arbitro, se nombrará otro como queda dicho, para que obre en su lugar, el cual hará y suscribirá la declaracion que se ha indicado.

Su Magestad Británica y la República de Honduras se obligan en considerar las decisiones de los Comisionados por sí, ó por medio del tercero, si llega el caso, como final y concluyente en todas las materias que se remitan á su decision, y se obligan á hacerla llevar inmediatamente á su debido efecto.

V. Los Comisionados y arbitro llevarán un proceso-verbal exacto de todos sus escritos ó notas de sus procedimientos con las fechas respectivas, y nombrarán ó emplearán uno ó mas dependientes ó empleados, para que asistan en las transacciones ó asuntos que se remitan á sus

manos.

The salaries of the Commissioners shall be paid by their respective Governments. contingent expenses of the Commission, including the salary of the arbitrator or umpire, and of the clerk or clerks, shall be defrayed in equal moieties by the two Governments.

VI. The present Convention shall be ratified, and the ratifications shall be exchanged at London, as soon as possible within twelve months from this date.

In witness whereof the respective Plenipotentiaries have signed the same, and have affixed thereto their respective seals.

Las dietas de los Comisionados serán pagadas por los respectivos Gobiernos. Los gastos contingentes de la Comision, incluyendo el honorario del arbitro y dal empleado ó de los empleados, serán sufragados por iguales partes por los dos Gobiernos.

VI. La presente Convencion será ratificada, y las ratificaciones canjeadas en Londres en doce meses, ó antes si posible fuere, de la fecha.

Su Magestad la Reina del Reino Unido de la Gran Bretaña é Irlanda, y la República de Honduras, deseosos de arreglar de una manera amigable ciertas cuestiones relativas á los limites territoriales de la República, han resuelto concluir una Convencion con tal objeto, nombrando al efecto sus Plenipotenciarios, á saber:

Frederick, Earl of Clarendon, Baron Hyde of Hindon, a Peer. of the United Kingdom, a Member of Her Britannic Majesty's Most Honourable Privy Council, Knight of the Most Noble Order of the Garter, Knight Grand Cross of the Most Honourable Order of the Bath, Her Britannic Majesty's Principal Secretary of State for Foreign Affairs;

And His Excellency the President of the Republic of Honduras, Señor Doctor Juan Victor Herran, Minister Plenipotentiary of the Republic to Her Britannic Majesty ;

Who, after having communicated to each other their respective full powers, found in good and due form, have agreed upon. and concluded the following Articles:

ART. I. Taking into consideration the peculiar topographical position of Honduras, and in order to secure the neutrality of the islands adjacent thereto with reference to any railway or other line of interoceanic communication which may be constructed across the territory of Honduras, Her Britannic Majesty and the Republic of Honduras, agree to constitute and declare the Islands of Ruatan, Bonaca, Elena, Utile, Barbarete, and Morat, situated in the Bay of Honduras, a free territory, under the sovereignty of the Republic of Honduras.

The present legislative, judicial, and executive authorities in the said islands shall remain in the exercise of their functions

Y su Excellencia el Presidente de la República de Honduras, al Señor Doctor Juan Victor Herran, Ministro Plenipotenciario de la República cerca de Su Magestad Británica ;

Quienes, despues de haberse comunicado sus respectivos plenos poderes, encontrados en buena y debida forma, han convenido y concluido los Articulos. siguientes:

ART. I. Teniendo en consideracion la peculiar posicion topográfica de Honduras, y para asegurar la neutralidad de las islas adyacentes á ella, con respeto á todo camino de hierro ó otra linea de comunicacion interoceánica que pueda construirse á traves del territorio de Honduras, Su Magestad Británica y la República de Honduras convienen constituir y declarar las Islas de Roatán, Bonaca, Elena, Utila, Barbareta, y Morat, situadas en la Bahia de Honduras, territorio libre bajo la soberania de la República de Honduras.

Las presentes autoridades legislativas, judiciales, y ejecutivas de dichas islas permanecerán en ejercicio de sus funci
