An Act concerning the Title, Name, and Digninity of the Earl of Arundell, and for the annexing of the Castle, Honour, and Mannor and Lordship of Arundell in the County of Suffex, with the Titles and Dignities of the Baronies of Fitz Allen, Clun, and Oswaldeftre and Maltravers, and divers other Lands, Tenements, and Hereditaments, hereafter in this Act mentioned, being now Parfel of the Poffeffions of Thomas Earl of Arundell and Surrey, Earl Maribal of England to the faid Title, Name, and Dignity of the Earl of Arundell.

I

N all humble wife fheweth, &c. Thomas Earl of Arundell, &c. That whereas the Title, Name, and Dignity of Earl of Arundell

is, and from the time whereof the Memory of Man is not to the contrary, hath been Real and Local, and, &c. enjoined by himself, and

fuch of the Ancestors of the faid Earl as have enjoyed the Inheritance of the Castle, Lordship and Honour of Arundell, &c. and by reafon of the Inheritance and Sefin of the faid Castle, Honour, &c. The faid Earl and his Ancestors, &c. have been Earls of Arundell, &c. and thereby had their Places in your Majefty's Parliament and Council, and elsewhere as Earls of Arundell.

And whereas the large Revenues that were in former Times were wont to support the faid Title, Name, &c. have in the latter Ages been difmembred, and diminished by divers and fundry Alienations, &c. and in future Times may be much more leffened, if fome Prevention be not thereof had, which no way fo well be had, as by annexing as well of the faid Caftle, Honour, and Lordship, as alfo divers others of the Baronies, Lordfhips, &c. of the faid Earl herein mentioned, to be annexed to the faid Title, Name, and Dignity of Earl of Arundell in fuch fort, as that hereafter the faid Caftle, Honour, and Lordfhip, and other the Baronies, Lands, Tenements, &c. may continually remain to thofe of the Blood of the faid Earl that fhall be hereafter, as aforefaid, have, ufe, and enjoy the Title and Dignity of Earl of Arundell, that fo they may the better fupport the faid Titles, Names and Dignities, and be the more able to ferve your moft Excellent Majefty, your Heirs and Succeffors in their Eftates and Quality; He most humbly befeecheth Your moft Excellent Majefty, that it may be, &c. Enacted by the Authority aforefaid, That the faid Title, Name, and Dignity of Earl of Arundell, and Caftle, Honour, and Lordship of Arundell, and Baronies hereafter enfuing, that is to fay, the faid Titles, Names, and Dignities of Lord Fitz Allen,

Allen, Clun, and Ofwaldeftre, and Lord Maltra: vers, and all Places, Preheminences, Arms, Enfigns, and Dignities to the faid Earldom, Castle, Honour, and Baronies belonging, and the Borough and the Mannor of Arundell aforefaid,&c.and the Forest of Arundell, &'c. and the two Parks, &c. to the faid Castle and Mannor, &c. belonging, &c. [with divers other Lands in the Counties of Suflex, Surrey, and Hampshire,] Arundell House in the County of Middlefex, &c. may and fhall be for ever by virtue of this Act, &c. be and remain, &c. to him the faid Thomas Earl of Arundell and Surrey, and Heirs Males of his Body lawfully begotten, &c. and for default of fuch Iffue, &c. then to the Heirs of the Body of the faid Earl lawfully begotten, &c. and for default of fuch Iffue, then to the Right Honourable the Lord William Howard, Unckle to the faid Earl, [Son of Thomas late Duke of Norfolk,] and the Heirs Male of the Body of the faid Lord William, &c. and for default of fuch Iffue to the faid Thomas Earl of Arundell, and Surrey, and his Heirs for ever.

we repofing fpecial Truft and Confidence in your approved Wifdom, Fidelity, Valour, and great Abilities, have affigned, made, conftituted, and ordained, and by thefe our Letters Patents, do affign, make, conftitute, and ordain you to be our Captain General of all our Armies and LandForces, and Men whatfoever now levied or raised, or which hereafter fhall be raifed or levied in or out of our Realms of England, Scotland, and Ire. land, and Dominion of Wales, or any of them or any other our Dominions and Territories what foever, and Affembled, or to be. Affembled into an Army, or Armies, with them, both to refift and withstand all Invafions, Tumults, Seditions, Confpiracies, and Attempts, that may happen within our faid Realms, Dominions, and Territo ries, or any of them, to be made against our Perfon, State, Safety, Crown and Dignity, and to be led into of our faid Realms, Dominions, and Territories, or any of them, and there to invade, affault, re pel, refift, fight with, fubdue, flay, and kill all, every, or any Enemies or Rebels against us of what Nation foever, that in our faid Kingdoms, Dominions, Territories, or any of them any Part, or Parts thereof, fhall raife, make, caufe adhere to, or be part of any Infurrection, Commotion, Tumult, Sedition, Confpiracy, or Attempt whatfoever againft our Perfon, State, Crown and Dignity. And we further have affigned, made, conftituted, and ordained, and by these our Letters Patents, do affign, make, conftitute, and ordain you the faid Armies and Land Forces, and every part thereof; and all Officers, and others whatsoever employed, or to be employed in or concerning the fame, with all fuch other For ces of what Nation foever as fhall be hereafter

joined to the faid Armies and Land-Forces, or any part thereof, to rule, govern, command, difpofe, and imploy in For, or about fuch Defences, Offences, Invafions, Executions, and other Mili tary and Hoftile Acts and Services, as are and fhall be by us from time to time, and at any time refpectively directed, limited, or appointed in, or by thefe our Letters Patents, or by our Inftructions which we have delivered unto you under our Sign Manual, or which fhall be hereafter directed, limited, or appointed by any Inftructions under our Sign Manual, Signet, Privy Seal, or Great Seal delivered, or to be delivered unto you, or fent and received, or to be fent and received by you. And further, we have given and granted unto you full Power and Authority, and hereby do give and grant unto you full Power and Au thority the fame Armies and Land Forces, and every, or any part thereof, and the Men fo levied, raised, or affembled, or to be levied or af fembled, or fent, conducted, or brought, or that otherwife fhall come to you, either by any other fpecial Order or Command, or by any other Commiffion whatsoever given, and granted by us, or by Authority of this Commiffion, and according to the intent thereof as aforefaid by your felf, or by your Deputy, or Deputies, Commanders, Captains, or other Officer or Officers, as to you fhall feem meet, to try, exercise, array, and put in readinefs, and them, and every of them, after their Abilities, Degrees, and Faculties, or according to the Provifion of Arms appointed for them, well and fufficiently to caufe to be weaponed and armed, and to take, or caufe to be taken, the Mufters of them by the Commiffary General, or other Commiffaries, or Officers, whom you fhall affign as F 2 often
