the said certified copy of the record in the office of the prothonotary of
the said court of common pleas of Lancaster county, shall be the evi-
dence of such transfer and removal having been decided upon and made:
Provided That the said county of Lancaster shall not be subjected to Previso.
any costs or expense, in consequence or by reason of the transfer and
removal of the said actions, or any or either of them, but the same, or
such part thereof as would otherwise fall upon the county where the
said causes, or either, shall be tried, shall be paid by the losing party;
and that the final judgments in the cause or causes, so transferred and
removed, shall be subject to writs of error to the supreme court, as in
other cases.

AN ACT

To erect parts of Lower Mahantongo township, in the county of Schuylkill, into
a separate school district.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That all that part of Lower Mahantongo township, in Schuylkill county, lying within the boundaries hereinafter mentioned, viz: Beginning at a black Boundary. oak, corner of Lower Mahantongo, Porter, and Pine Grove townships; thence along the division line of the last two townships, north fifty-one degrees east four hundred and forty-two degrees to a pine; thence north sixty-seven degrees east seven hundred and eighty-one perches to the line of Branch township; thence along the line of Branch and Barry townships, north fifty degrees west to the south-east corner of the new school district, in the said township; thence along the south boundary of the said school district, westward to the south-west corner of the said district; thence northwardly to the north-west corner; thence westward for a new corner, so as to include the farm of Samuel Heeter; thence northward to the point at which the main road crosses the Mahantongo mountain, and on the division line of Upper and Lower Mahantongo townships; thence westward along the line of the said townships to a corner, so as to include the property of William Hoff; thence southward a straight line so as to strike what is called Jones' line, and then to follow the same to the line of Porter township; thence eastward along the said division to the corner of Porter township; thence southwardly

to the place of beginning, be and the same is hereby erected into a separate school district, to be called Well Made school district.

SECTION 2. That John Schrob, senior, be appointed judge, and John Herry and W. R. Hower, be and they are hereby appointed inspectors, to hold an election at the same time and place at which the township election is held, for the purpose of electing school directors for the above mentioned school district.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

the first seventeen sections of an act, entitled "An Act relative to roads Certain acts reand bridges, in the counties of Armstrong, Mercer and Crawford," ap- pealed. proved the third day of April, one thousand eight hundred and forty six, be and the same is hereby repealed: Be it further enacted, That

a certain bridge across Red Bank creek, near the house of Jacob Moh- Bridge across ney, where the state road leading from Kittanning, in Armstrong county, Red Bank creek to Brookville, in Jefferson county, crosses Red Bank creek, said creek to be rebuilt. being the line between Armstrong and Clarion counties, shall be rebuilt, at the joint expense of said counties of Armstrong and Clarion, in equal proportions.

To confirm the title of John S. Miller to certain real estate.

WHEREAS, "The Evangelical society of Philadelphia," did, by a Preamble. certain indenture, bearing date the twenty-second day of June, Anno Domini one thousand eight hundred and thirty-five, recorded in the office for recording of deeds, and so forth, for the city and county of Philadelphia, in deed book AM, number seventy-five, page one hundred and seventy-four, and so forth, grant and convey unto the First Presbyterian congregation in Kensington, and their successors and assigns forever, two certain adjoining lots of ground, therein particularly described, together with the appurtenances; being the same two lots of ground which Joseph Norris and Rachael, his wife, and Henry Miller and Elizabeth, his wife, by two several indentures, bearing date the twelfth day of February, A. D., eighteen hundred and thirteen, respect

ively, granted and conveyed unto The Evangelical society of Philadelphia" aforesaid, and their successors and assigns forever:

And whereas, The First Presbyterian congregation in Kensington, aforesaid, did, by a certain other indenture, bearing date the tenth day of April, A. D., eighteen hundred and thirty-nine, recorded in the office for recording of deeds, and so forth, for the city and county of Philadelphia, in deed book GS, number three, page three hundred and eighty-nine, and so forth, grant and convey the said two lots of ground, with the appurtenances, unto John S. Miller, of the city of Philadelphia, his heirs and assigns forever:

And whereas, No authority to convey real estate is expressly given in and by the charter of either of the said corporations, and it is represented to the legislature, that doubts are entertained respecting the right and power of the said corporations to hold and convey the said premises; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That Titles confirmed. the title of the said John S. Miller, and of all and every person or per

sons claiming, or to claim under him, by purchase, descent or other-
wise, to the said two lots of ground, or either of them, or any part
thereof, be and the same is hereby confirmed and made valid in all re-
spects whatever, as fully and effectually as if the right and power to
take, purchase, hold and convey real estate, in fee simple or otherwise,
had been expressly given, in and by the said charters of incorporation,
respectively, to "The Evangelical society of Philadelphia," and "The
First Presbyterian congregation in Kensington," aforesaid.

AN ACT

Authorizing certain cases to be certified from the court of common pleas, to the district court of Allegheny county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly registers' courts met, and it is hereby enacted by the authority of the sume, That shall be certified in all cases in which the register of Allegheny county, has issued or may issue, a precept to the court of common pleas of said county,

directing an issue to be formed under the provisions of "An Act relating to registers' courts," approved the fifteenth of March, one thousand eight hundred and thirty-two, it shall be the duty of the prothonotary of said court, at any time after the filing of such precept in said court, upon the request of the parties or their counsel, to certify such precept, and any proceedings that may have been had thereon into the district court of said county; and thereupon, said last mentioned court shall have power, and it shall be the duty of said court to proceed in the premises, and to certify the result of any trial or trials that may be had therein, into the office of said register, in the manner required by law of courts of common pleas; and the facts established by such proceedings and trials, and certified as aforesaid, shall have the same operation and effect, as if the same were had before and certified by said court of common pleas.

SECTION 2. That all judgments over one hundred dollars, remaining Judgments in unsatisfied in the court of common pleas of Allegheny county, on certain cases may which scire facias have issued, or may hereafter issue, to revive the be certified to dis same, the prothonotary of said court, on the application of either party trict court for or parties in the cause, or of their attorney or attorneys, shall forthwith trial. certify the same, with all the records and papers, to the district court of said county, which said court is hereby authorized to take jurisdiction of, hear and determine, all issues of law and fact arising in the said cause, subject to bills of exception, writs of error, as fully as if the same had been originally brought in said court.
